CALL TO ORDER: 10:01 a.m. (via Zoom) ROLL CALL: Justina Willkom, Zoning Administrator PUBLIC CONCERNS: Vera confirmed no public concerns received. CONSENT CALENDAR: None PUBLIC HEARING: Opened at 10:02 a.m. 1. USE DETERMINATION (UD) 2021-0002 AND CONDITIONAL USE PERMIT (CUP) 2021-0016 APPLICANT: BRIAN KIM KAIROS UNIVERSITY 12741 MAIN STREET GARDEN GROVE, CA 92840 PROPERTY OWNER: BEN WELLS AAA QUALITY SELF STORAGE-TUSTIN LP 2681 WALNUT AVENUE TUSTIN, CA 92780 LOCATION: 2681 WALNUT AVENUE ENVIRONMENTAL STATUS: This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. REQUEST: To determine that a religious educational use is a conditionally permitted use within the Irvine Industrial Complex (IIC) Planned Community, and to establish a religious educational use at 2681 Walnut Avenue within an existing office space of a self-storage facility located in the IIC. Zoning Administrator Action Agenda November 18, 2021 Page 2 RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 21-011 approving UD 2021-0002 and CUP 2021-0016 to determine that a religious educational use is a conditionally permitted use within the IIC Planned Community, and to establish a religious educational use within an existing office space of a self-storage facility located in the IIC at 2681 Walnut Avenue. Maldonado provided a brief presentation of Item #1. Willkom asked about the synchronous session. Maldonado explained that through the COVID times, some classes are offered in a "hybrid" setting, which means students are able to participate from home or on-site. Synchronous means it is a class where the instructor would be teaching at the same time that the students would be present, whether virtually or physically, on-site as opposed to asynchronous instruction, where as a professor pre-records a lecture video and a student is able to review it and learn at any time. 10:02 a.m. -Willkom opened the Public Input for Item #1. The applicant was not present. Willkom did not have any questions regarding the Conditions of Approval. She adopted ZAA 21-011. Hurtado confirmed there was no public input. 10:11 a.m. -Willkom closed the Public Input for Item #1. 2. CONDITIONAL USE PERMIT (CUP) 2021-0028 APPLICANT: BONNIE BERGER, D.C. 195 SOUTH C STREET, SUITE 100 TUSTIN, CA 92780 PROPERTY OWNER: ROBERT E. PEARSON, TRUSTEE EMS DEVELOPMENT COMPANY 14081 YORBA STREET, SUITE 231 TUSTIN, CA 92780 LOCATION: 14081 YORBA STREET, SUITE 105 ENVIRONMENTAL STATUS: This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. Zoning Administrator Action Agenda November 18, 2021 Page 3 REQUEST: To establish a chiropractic office with accessory massage services provided by a non- exempted professional in a professional office building. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) No. 21-012 approving CUP 2021-0028 to allow accessory massages services provided by a non- exempted professional in a 200 square foot chiropractic office within an existing 1,014 square-foot office space located at 14081 Yorba Street, Suite 105. Maldonado provided a brief presentation of Item #2. 10:16 a.m. Willkom opened the Public Input for Item #2. Willkom asked the applicant, Bonnie Berger, D.C. if she had read the report and if she had questions of staff. D.C. Berger did not have any questions or concerns. Hurtado confirmed there was no public input. 10:16 a.m. Willkom closed the Public Input for Item #2. Willkom welcomed the applicant to the City of Tustin. Willkom adopted ZAA No. 21-012 approving the project. REGULAR BUSINESS: 3. MINOR ADJUSTMENT (MA) 2021-0001 APPLICANT/ SUSAN BERGEVIN PROPERTY OWNER: 178 NORTH C STREET TUSTI N, CA 92780 LOCATION: 178 NORTH C STREET TUSTIN, CA 92780 ENVIRONMENTAL STATUS: This project is Categorically Exempt (Class 1) pursuant to Section 15301 of the California Environmental Quality Act. REQUEST: To decrease the number of required off-street parking spaces by one (1) garage space in conjunction with the construction of an addition to an existing single-family dwelling. Zoning Administrator Action Agenda November 18, 2021 Page 4 RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action 21-010, approving MA 2021-0001 to allow a decrease in the number of required parking spaces in conjunction with an addition to single-family dwelling. Salman provided a brief presentation of Item #3. 10:20 a.m. Willkom opened the Public Input for Item #3. Willkom asked the applicant, Susan Bergevin, if she had read the staff report and if she had any questions of staff. Ms. Bergevin did not have any questions or concerns and she was in agreement with the staff report and the Conditions of Approval. Willkom had reviewed the staff report and she was in agreement with the Conditions of Approval. She congratulated the applicant and adopted ZAA 21-010. Hurtado confirmed there was no Public Input. 10:26 a.m. Willkom closed the Public Input for Item #3. 10:26 a.m. Meeting adjourned: The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
