CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARINGS: 1. Conditional Use Permit 01-007 a request to allow an outdoor certified farmers' market on Saturdays and Wednesdays. The project is located at 250 South Prospect Avenue within the Central Commercial District (C-2) zoning district. APPLICANT: PHILIP K. COX, CHAIRMAN TUSTIN OLD TOWN ASSOCIATION PROPERTY OWNER: JOHN A. PRESCOTT RECOMMENDATION That the Zoning Administrator adopt Action 01-005 allowing an outdoor certified farmers' market on Saturdays and Wednesdays. The Public Hearing opened at 2:03 p.m. Lori Ludi, Associate Planner, presented the report. Trish Harrison, representing the Orange County Farm Bureau, stated the fOllowing objections to this action: 1) misleading information presented in the media suggests that the Saturday Farmers' Market is affiliated with the Wednesday Farmers' Market; 2) Wednesday vendors are concerned that the public will be confused by the fact that the markets will occupy the same space; suggested a Saturday market will dilute the Zoning Administrator Agenda April 2, 2001 Page 2 customer base; and 4) stated she might pass out flyers alerting residents that the two markets share no affiliation. The Zoning Administrator stated that staff does not control what is reported in the newspapers; staff took a request by the property owner and an applicant for basically the same use as Wednesday; and, asked if Ms. Harrison had addressed these issues with the property owner. Ms. Harrison answered that the property owner had mentioned this idea in the past at which time she requested Mr. Prescott speak with her manager; indicated that the prior Farm Bureau representative has been at the Wednesday market talking with vendors; both individuals are aware of her objections to this use of the same property. John Powers, president of Tustin Old Town Association, indicated that his group is more than willing to support both markets; indicated it was the goal four years ago to expand the market to Saturday; and, stressed his willingness to work with Ms. Harrison to discuss her concerns. The Zoning Administrator suggested that issue be addressed independently; and, asked if Mr. Powers had any questions or concerns regarding the staff report. Mr. Powers stated his approval of staffs report. Bonnie Bath, 240 South Prospect property owner north of the Farmers' Market, indicated she had not read any of the material; stated her misunderstanding that it would be the same group both days; indicated her attendance was related to the dust problem created by the Wednesday market; and, asked what would be going on Saturdays. The Zoning Administrator answered there would be a farmers' market similar to Wednesday, but not affiliated with the Farm Bureau. Ms. Bath asked if it would be a swap meet. The Zoning Administrator answered that staff is only approving a farmers' market similar to the one on Wednesdays. Ms. Bath then restated her concern regarding paving; stated that her husband had corne to a previous meeting where he was told the trash bins would be locked after the market on Wednesdays; however, the accumulation of boxes is too high to allow for locking the bin; the City should perhaps add another bin. The Zoning Administrator noted that Condition 3.1 addresses the dust suppression issue and Condition 3.3 provides for sufficient trash bins with locking devices; and, stated the code enforcement officers working Saturdays will follow up on the trash situation. Ms. Harrison stated the Farm Bureau has no ability to lock the bin; that she had never seen it overflowing; and, the bin may be receiving trash from other sources. Zoning Administrator Agenda April 2, 2001 Page 3 The Zoning Administrator stated this is an issue that will have to be resolved. Ms. Bath indicated that she is very happy with the people the market brings to Old Town; and, asked if the alleyway could be closed due to the accident risk involved. The Zoning Administrator indicated that may not be possible if the alley is a public right- of-way, but staff can investigate this possibility. The Public Hearing closed at 2:16 p.m. The Zoning Administrator indicated she had reviewed all the conditions of approval; these conditions allow for mitigation of potential negative impacts; staff has the ability to review the conditional use permit on a periodic basis to ensure there are no negative impacts; if there are, staff can bring the matter back to the Zoning Administrator or before the Planning Commission and recommend additional conditions of approval. The Zoning Administrator adopted Zoning Administrator Action No. 01-005 which replaces Resolution No. 3201 allowing an outdoor certified farmers' market on Saturdays and Wednesdays. The Zoning Administrator noted this decision will remain final unless appealed to the Planning Commission; the deadline for appealing this action is Monday, April 9, 2001, at 5:30 p.m. 2. Conditional Use Permit 01-006 a request to construct three (3) batting cages adjacent to the ball fields on the property located at 14702 Prospect Avenue (Columbus Tustin Park). The project is within the Public and Institutional (P&I) zoning district. APPLICANT: TOM ROWE - TUSTIN GIRLS SOFTBALL PROPERTY OWNER: CITY OF TUSTIN RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 01-003 approving Conditional Use Permit 01-006. The Public Hearing opened at 2:17 p.m. Karen Peterson, Senior Planner, presented the report. Mr. Tom Rowe, representing Tustin Girls Softball, asked if the foam baffling material he suggested would be satisfactory. Zoning Administrator Agenda April 2, 2001 Page 4 The Zoning Administrator indicated 1%-inch padding would be required; if this material is inadequate regarding violation of the City's noise ordinance, modifications would be required with discontinuance of operation while making those modifications. The Public Hearing closed at 2:20 p.m. The Zoning Administrator adopted Zoning Administrator Action 02-003 approving Conditional Use Permit 01-006. REGULAR BUSINESS: 3. Desion Review 00-032 a request for authorization to establish a roof-mounted wireless communication facility on an existing office building. The project is located at 15101 Red Hill Avenue within the Pacific Center East Specific Plan, "Office" land use designation zoning district and South Central Redevelopment Project Area. APPLICANT: TACIT COMMUNICATIONS ATTN: JEREME BRIXEY PROPERTY OWNER: INDUSTRIAL HILL HOLDINGS, LLC ATTN: KERRY A. DEAVER RECOMMENDATION: That the Zoning Administrator approve the proposed building-mounted wireless facility by adopting Zoning Administrator Action 01-004 approving Design Review 00-032. The Public Hearing opened at 2:22 p.m. No report was necessary. The Zoning Administrator adopted Zoning Administrator Action 01-004 approving Design Review 00-032. ADJOURNMENT: The meeting adjourned at 2:23 p.m. The date of the next regular meeting of the Zoning Administrator will be scheduled when items are set for hearing.
