HomeMy WebLinkAboutCC RES 85-072 RESOLUTION NO. 85-72 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING ITS INTENTION TO ORDER THE FORMATION OF TUSTIN LANDSCAPING AND LIGHTING DISTRICT AND TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 WHEREAS, the City Council of the City of Tustin, California, has adopted Resolution No. 85-43, initiating proceedings for the formation of an Assessment District pursuant to the Landscape and Lighting Act o~ 1972 for the maintenance and operation of street lighting and landscaping; and WHEREAS, the Engineer has prepared and filed with the City Clerk his report containing the matters specified in Section 22567 of the Streets and Highways Code of the State of California; and WHEREAS, the pub'lic interest and welfare require the maintenance and operation of street lighting and landscaping located within the proposed Assessment District which has been designated "Tustin Landscape and Lighting District". hereby NOW THEREFORE, the City Council of the City of Tustin does resolve as follows' SECTION 1' The foregoing so finds 'and determines. recitals are true and correct and SECTION 2' The City Council hereby declares its intention to , order the formation of an Assessment District designated "Tustin Landscape and Lighting District" the boundaries of which are generally described in Section 4, hereto, and to levy and collect assessments pursuant to Part 2 of Division 15 of the Street and Highway Code. SECTION 3' The improvements to be undertaken in the proposed Assessment District are the maintenance and operation of street lighting and landscaping. SECTION 4' The proposed Assessment District generally encompasses all of'the territories within the boundaries of Browning Avenue, Irvine Boulevard, Myford Road, and I-5 Freeway, within the City of Tustin including property owned by railroad and public utility companies. SECTION 5' Reference is hereby made to the Report of the Engineer on file With'"'the"City Clerk for a ~ull and detailed descrption of the improvements, the boundaries of the proposed Assessment District and any zones therein, and the proposed assessments upon assessable lots and parcels of land within the District. SECTION 6' Notice is hereby given that Monday, July 15, 1985, at the hour of 7'0'0 p.m. 'in the City Council Chambers, 300 Centennial Way, Tustin, California 92680, are hereby fixed as the time and place ~or a hearing by the City Council on the question of the formation of the Assessment District and levying of the proposed assessment. SECTION 7' The City Clerk is hereby directed to give notice of the hearing referred to in Section 6 by causing this Resolution of Intention to be published and mailed as required by Section 22556 of the Street and Highway Code. The foregoing Resolution was passed and adopted at at regular meeting of the Tustin City Council held on July 1, 1985.
