CONSENT CALENDAR: No Items on Consent Calendar PUBLIC HEARINGS: 1. Conditional Use Permit 01..Q20 a request for authorization for the on-site sale of beer and wine (ABC license Type "41") in the expansion area of an existing restaurant. The project is located at 13882 Newport Avenue, Suites G & F within the Commercial General (CG) zoning district. APPLlCANTI RED HAT RESTAURANT ATTN: HASSAN KEIVANNIA PROPERTY OWNER: ELDON PRIMROSE RECOMMENDATION That the Zoning Administrator adopt Zoning Administrator Action 01-007 approving Conditional Use Permit 01-020, which is an amendment to Conditional Use Permit 99-023. Presentation: Matt West, Assistant Planner The Public Hearing opened at 10:36 a.m. No staff presentation was necessary. The Zoning Administrator asked the applicant if the conditions were understood and agreed to. Zoning Administrator Agenda April 2, 2001 Page 2 Ms. Carolyn Tajik, on behalf of the applicant, responded affirmatively. When asked if there were any questions, Ms. T ajik indicated that the applicant questioned the number of parking spaces and suggested that the applicant's need for parking will occur when the other businesses do not require parking. Ms. Tajik stated that a Traffic Study would involve an expense that would be difficult for Mr. Keivannia to bear during these times of reduced restaurant business and asked if there are alternatives available. The Zoning Administrator asked staff if the applicant's providing a schedule of uses and times of those uses in order to address the availability of the parking spaces used by other businesses, for approval by the Traffic Engineer, would be appropriate in this case. Staff responded affirmatively and indicated Condition 3.12 is sufficient to address that issue without modification. The Zoning Administrator adopted Zoning Administrator Action 01-007 approving Conditional Use Permit 01-020, which is an amendment to Conditional Use Permit 99-023, provided the applicant can provide the necessary parking information. The Zoning Administrator stated there is a seven-day appeal period regarding this approval. The Public Hearing closed. REGULAR BUSINESS: ADJOURNMENT: The meeting adjourned at 10:40 a.m. The date of the next regular meeting of the Zoning Administrator will be scheduled when items are set for hearing.
