RECOMMENDATION: That the Planning Commission adopt Resolution No. 4448 approving Conditional Use Permit (CUP) 2021-0018 to authorize the establishment of a master sign plan for the multi-tenant commercial shopping center at 1091 Old Irvine Boulevard. APPROVAL AUTHORITY: Pursuant to Tustin City Code (TCC) Section 9403(h), a master sign plan is required for developments in multi-tenant centers to encourage coordinated and quality sign design. In accordance with Section 9404(b)(6) of the TCC, an approval of a CUP by the Planning Commission is required for master sign plans that request deviations from the sign standards provided that the DocuSign Envelope ID:388014FC-6BFD-4810-9C2A-D25FF09A6405 PC Report April 12, 2022 CUP 2021-0018 Page 2 project is a center and a single development project of at least thirty thousand (30,000) square feet or one (1) acre in project size. The applicant has requested deviations from the TCC sign standards for a center that is over 30,000 square feet; therefore, a CUP is required. BACKGROUND: Site and Surrounding Properties The project site is located at 1091 Old Irvine Boulevard, between Elizabeth Way and Newport Avenue. The property is located within the Retail Commercial (Cl)zoning district and the General Plan land use designation is Community Commercial. The subject property is approximately 2.6 acres and is developed with a 39,827 square foot, unoccupied commercial building (Figure 1). Figure 1 - Existing Building On June 22, 2021, the Planning Commission adopted Resolution 4433 approving DR 2021-0005 to remodel a vacant commercial building into a multi-tenant commercial building, including exterior fagade renovations and parking lot improvements; and CUP 2021-0007 to establish joint-use parking for all on-site tenants. A rendering of the approved building improvements is shown below in Figure 2. The building was previously occupied by a bowling alley business and a home and garden business. The project is currently under construction. F RM ED - X11-1 Figure 2—Approved Building Improvements The site is in close proximity to Irvine Boulevard, which is a major arterial road through the City that eventually connects to the City of Irvine to the east and the City of Santa Ana to the west. The property is bounded by a medical office center to the southeast, a commercial center to the northwest, commercial properties across Old Irvine Boulevard to the southwest, and residential condominiums to the northeast. An aerial view and corresponding zoning is shown below for reference (Figure 3). ' •�' AW C—CO ✓ tia DISCUSSION: Project Summary The proposed master sign plan (Attachment C) is a comprehensive program to address signage requirements for the shopping center. The master sign plan proposes sign configurations and dimensions that are unique to the development and deviate from the City's sign standards. The proposed master sign plan considers the architectural features throughout the project and incorporates signage standards that establish project identity through enhanced and themed community signage. The proposed master sign plan addresses two (2) tenancy options to accommodate flexibility in the total number of tenant spaces to be established and descriptions of each tenancy options are provided below. It should be noted that each option includes an interior window display with changeable graphics associated with the major tenant and a description and analysis is included later in this report. The sign will be located on the primary building elevation above the main entrance of"tenant 1", oriented toward the parking lot and Old Irvine Boulevard. The wall sign will consist of reverse- pan halo illumination, highlighting the store name and logo that will be digitally printed in custom colors. In the daytime, the wall sign will display custom colors of blue, white, yellow and orange and will change to white and two (2) shades of dark and light blue at nighttime. Although the proposed sign is larger than what is currently permitted by the TCC, the proposed size would be consistent with the scale of the primary elevation of the major tenant space. The primary elevation of the major tenant space has a total width of 143 feet and eight (8) inches. Figure 6 below provides a rendering of the proposed major tenant signage applicable to both tenancy options. Each sign will not exceed a maximum height of four(4) feet two (2) inches, maximum width of eighteen (18)feet, maximum allowable sign area of 75 square feet, and a maximum of two (2) lines of text. The signs would be designed with face- lit channel lettering and channel letter returns painted slate grey. The exact sign text, size and color of the signs will be reviewed by City staff during plan check of the requested sign permits. This option will identify one(1) minor tenant space that would be approximately 21,200 square feet. The proposed sign will be located above the main entrance on the exterior wall of the tenant space. The two (2) lines of text for the minor tenant space wall sign will have a maximum height of four (4) feet two (2) inches, maximum width of eighteen (18) feet, and a maximum allowable sign area of 75 square feet. The sign will be designed to include face-lit channel lettering and channel letter returns painted to match the color slate grey. The exact sign text, size and color will be determined by the tenant and will be reviewed by City staff during plan check for the requested sign permit. The proposed monument sign will include signage for one (1) major tenant and either the two (2) minor tenant names (Figure 10) or one (1) minor tenant name(Figure 11) depending on the tenancy configuration. The overall dimension of the monument sign will be the same for both options and measures approximately seven (7) feet wide, six(6) feet high and approximately one (1)foot and seven (7) inches wide. The sign base will consist of wood-like tile veneer in a brown ("bark") hue, and will display the shopping center identification name and address. The address numerals will be one-half inch (1/2")thick acrylic painted white. The overall area of the tenant identification portion of the monument sign will be approximately 25 square feet and the base will be approximately 23 square feet. The Public Works/Engineering Division has reviewed the proposed Master Sign Plan and determined that the proposed monument sign conforms to the City's sight distance requirements to ensure adequate visual clearance is provided. The display will provide for changeable graphics that display lifestyle and product imagery associated with the business. A condition of approval (Condition No. 2.6) is included that would prohibit text, advertising, and animated copy to be displayed on the interior window display. The vertical display consists of one (1) upper and one (1) lower section. The upper larger portion consists of three (3) panels and will be located above the proposed awning above the main entrance. The second lower portion consists of two (2) panels and will be located below the awning and adjacent to the doors to the main entrance. I n order to provide the tenant flexibility relative to the frequency that the images can be changed, the applicant would be allowed to change the graphics based on their business needs. Staff was advised that the applicant proposes to change the graphics on an annual basis. The display's overall dimension is approximately five (5) feet wide and 24 feet long and an overall sign face area of 127 square feet. A colored rendering of the display is provided in Figure 12. Each address sign is approximately one and one-half (1.5) feet high and widths ranging from approximately four (4) feet to four (4) feet one (1) inch wide. One (1) tenant address sign is proposed for each tenant space and each sign will be painted in a metallic silver color with three (3) inch returns and spacers that will be painted to match the proposed wooden wall color. Table 1 provides a comparison between the proposed Master Sign Plan and the TCC. Per TCC 9404 (b)(6), a master sign plan is required for proposals that deviate from the sign standards contained in the City's sign code provided that the project is a center and a single development project that contains a building of at least 30,000 square feet or one (1) acre in project size. The project site is 2.6 acres and the building is 39,827 square feet; therefore, a CUP and associated master sign plan is required. Analysis of CUP 2021-0018 has determined that the proposed master sign plan is consistent with the Tustin General Plan in that the property has a Community Commercial land use designation which allows for commercial uses and their supporting signs. Findings to support the request have been included in Resolution No. 4448. Accordingly, staff recommends that the Planning Commission approve the proposed project. SIGNS&SERVICES ATTACHMENT D RESOLUTION NO. 4448 EXHIBIT A - CONDITIONS OF APPROVAL RESOLUTION NO. 4448 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, APPROVING CONDITIONAL USE PERMIT 2021-0018 FOR THE ESTABLISHMENT OF A MASTER SIGN PLAN FOR A COMMERCIAL SHOPPING CENTER LOCATED AT 1091 OLD IRVINE BOULEVARD The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application, Conditional Use Permit (CUP) 2021-0018, was filed by Matthew Baca, representing Aldi Incorporated, requesting authorization to establish a master sign plan for the Aldi Shopping Center located at 1091 Old Irvine Boulevard. B. That pursuant to Tustin City Code (TCC) Section 9404b.6, master sign plans for centers of at least thirty thousand (30,000) building square feet or one (1) acre in project size may deviate from the TCC standards upon approval of a CUP. The Planning Commission is the review authority for the proposed CUP in accordance with Section 9404b. of the TCC. C. The proposed Master Sign Plan complements and enhances the shopping center and offers a different design and scale than what is allowed by the TCC with the approval of a CUP and the context, scale, and purpose of the proposed signage in the Master Sign Plan is consistent with the project site's contemporary architecture. D. That the proposed Master Sign Plan is consistent with the Tustin General Plan in that the property has a Community Commercial land use designation which allows for commercial uses and their supporting signs. In addition, the project has been reviewed for consistency with the Air Quality Sub- element of the City's General Plan and has been determined to be consistent with the Air Quality Sub-element. E. That a public hearing was duly called, noticed, and held for said application on April 12, 2022, by the Planning Commission. F. That in determining whether to approve the CUP for the proposed Master Sign Plan, the Planning Commission must determine whether or not the proposed signage will be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare of the City of Tustin. A decision to approve this request may be supported by the following findings: 1. Pursuant to TCC Sections 9404b6 and 9403h, a master sign program is required for multi-tenant centers and an applicant may follow a comprehensive master sign plan that differs from the Tustin Sign Code standards provided that the project is a center in a single development project with at least thirty thousand (30,000) square feet of building area or one (1) acre in project size, upon submittal of an application and approval of a conditional use permit. 2. The proposed Master Sign Plan complies with TCC Section 94031.1 in that sign standards are contained within the Master Sign Plan to reflect a common theme, incorporate design elements in terms of sizing, scale, massing, materials, letter styles, colors, sign type and sign shape to ensure that signage has been coordinated throughout the project site. 3. The proposed Master Sign Plan complies with TCC 940312 that establishes criteria that master sign program must meet: a) Signs would reflect a common theme, incorporating design elements in terms of materials, letter styles, colors, illumination, sign type and sign shape in that wall sign criteria will unify the design features of wall signs and monument sign for multiple tenants and would be limited to the locations approved in the master sign plan. b) Signs would utilize materials, colors, and a design motif which are compatible and which reflect the special qualities of the architecture of the buildings on the site in both daytime and nighttime situations. c) Any existing signage on the site will be removed and replaced with new signs are described in the proposed Master Sign Plan. d) The Master Sign Plan designates the property owner/management as the primary liaison with the City for the purpose of requesting approval of the Master Sign Plan and for submitting sign permit requests in conformance with the approved Master Sign Plan. e) The project site is comprised of a single development project containing more than thirty thousand (30,000) square feet of building area and therefore allows the Master Sign Plan to deviate from the specific sign standards for permanent business identification upon approval of a CUP. 4. The requested deviations from the Tustin Sign Code are minor and keeps the proposed signs within the context and scale of the building and surrounding uses. Signs will be appropriately visible while at the same time maintaining the visual quality of the site. 5. The proposed Master Sign Plan will provide coordinated and quality sign design in a development that will require a multiple wall signs and provide an opportunity for a coordinated monument sign for the center, avoiding uncoordinated and mismatched signs that would detract from the visual quality of the development. The signs proposed within the master sign plan are typical of a shopping center development. Similar sign plans have been provided in the development of other shopping centers. 6. The maintenance and removal of any future signs are adequately addressed in the proposed Master Sign Plan. 7. The Traffic Engineering Division of the Public Works Department has reviewed the proposed Master Sign Plan and has concluded that, as conditioned, the monument sign will be required to comply with sight distance visual clearance to ensure there will be no adverse traffic impacts resulting from the authorized sign. G. This project is Categorically Exempt pursuant to Section 15311, Class 11 of the California Code of Regulations (Guidelines for the California Environmental Quality Act). This exemption is for construction of accessory structures including on-premise signs. II. If within such forty- Resolution 4448-Exhibit A April 12, 2022 Page 3 eight (48) hour period the applicant has not delivered to the Community Development Department the above-noted check, the statute of limitations for any interested party to challenge the environmental determination under the provisions of the California Environmental Quality Act could be significantly lengthened. (1) 3.2 Construction and Demolition Waste Recycling and Reduction Plan (WRRP) a) The applicant/contractor may be required to submit a WRRP to the Public Works Department. The WRRP must indicate how the applicant will comply with the City's requirement (TCC Section 4351, et al) to recycle at least 65 percent of the project waste material. b) The applicant may be required to submit a fifty-dollar ($50.00) application fee and a cash security deposit. Based on the review of the submitted Waste Management Plan, the cash security deposit will be determined by the Public Works Department in an amount not to exceed five (5) percent of the project's valuation. c) Prior to issuance of a permit, if WRRP is required, the applicant shall submit the required security deposit in the form of cash, cashier's check, personal check, or money order made payable to the "City of Tustin".
