WEST, CITY MANAGER ORDINANCE ADOPTING NEW CITY LOGO AND AMENDING THE CITY CODE REGARDING CITY SEAL AND CITY LOGO. An updated City Logo has been designed for the City Council's consideration. In order to designate the new logo as the City's official logo, the City Code will need to be amended. This item would approve the recommended amendments. RECOMMENDATION: That the City Council have first reading by title only of Ordinance No. 1521 entitled "An Ordinance of the City of Tustin, California, Replacing and Superseding Part 4 Of Chapter 2 Of Article 1 of the Tustin City Code Regarding the City Seal and Logo." FISCAL IMPACT: There is no fiscal impact associated with this item. BACKGROUND: Tustin City Code section 1240 and 1244 currently designate the following as the City's official City Seal and City Logo, respectively: CURRENT CITY SEAL: CURRENT CITY LOGO: TUSTIN BUILDING OUR FUTURE HONORING OUR PAST DocuSign Envelope ID: F5AAB750-D243-4FB0-A521-EE7F836FBF11 Amendments to the City Code re City Logo May 17, 2022 Page 2 A new City Logo is proposed to be adopted which appears as follows: PROPOSED CITY LOGO iUJ-=000=00 IIN Remembering what connects us. Proposed Ordinance 1521 largely resembles the existing provisions in Tustin City Code 1240 through 1249, with some clarifications: Ordinance 1521 would clarify that the use of the City Seal or the new City Logo for private or commercial purposes, for campaign purposes, to influence the electorate in any election, or for any purpose other than for the official business of the City is prohibited without the approval from the City Clerk or City Manager. (See sections 1245 and 1246.) 2. Also, in order to avoid confusion that could result if the past City Logo was used by other unauthorized individuals for unauthorized purposes, proposed Ordinance 1521 would also prohibit the use of the Past City Logo without the approval from the City Clerk or the City Manager. (See sections 1245 and 1246.) And, 3. The proposed Ordinance would authorize the City Manager to develop, implement and administer appropriate policies and guidelines for use of the City Logo consistent with the Ordinance. Part 4 of Chapter 2 of Article 1 of the Tustin City Code regarding City Seal and Logo is replaced in its entirety to read as follows: PART 4. CITY SEAL AND LOGO Sections: 1240 City Seal --Designation. 1241 City Seal Use. 1242 City Seal Omission, Effect. 1243 City Seal Loss. 1244 City Logo --Designation. 1245 Prohibited Uses of City Seal and Logo. 1246 Use of Seal or Logo by Person Other than Officers and Employees. 1247 Policies For the Use of the City Logo. 1248 Manufacture and Sale of Souvenirs and Decorative Items. 1249 Authority of City Clerk 1240. City Seal --Designation. The City Seal is the property of the City of Tustin. The City Seal is the impression made by that certain instrument retained and used by the City Clerk for the purposes set forth in section 1241. City Seal Use. The City Seal, or any facsimile thereof, shall not be affixed to any document or writing, except by the City Clerk or such assistants to the Clerk as may be authorized by the City Clerk, for the purpose of certifying official records and instruments of the City of Tustin. Such records include any ordinance, resolution, proclamation, commendation, certificate or other instrument approved by the City Council or executed by the Mayor or other City officers or officials, and other official documents in the conduct of official City business as may require authentication by the City Clerk. 1242. City Seal Omission, Effect. No act of the City Council or document in evidence thereof shall be invalid by reason of the omission of the City Seal. 1243. City Seal Loss. In the event of loss of the instrument used for affixing the Seal, the words "Seal, City of Tustin, California", written by the City Clerk in attestation of a document, shall constitute the city Seal. 1244. City Logo --Designation. A. The City Logo is the property of the City of Tustin. The City Logo is a graphic symbol used to identify City programs, initiatives, partnerships and sponsorships. The general design and the details of the City Logo shall correspond substantially with the following representation thereof: Remembering what connects us. B. Past City Logo. Prior to adoption of Ordinance 1521, the prior City Logo corresponded substantially with the following representation. Prohibited Uses of City Seal and Logo. It shall be unlawful for any person to make or use the City Seal, the City Logo, or the Past City Logo, or any cut, facsimile or reproduction thereof, or make or use any design, symbol, emblem, insignia or similar device that is an imitation of the City Seal, the City Logo or the Past City Logo, or that may be mistaken therefor, that is designed, intended or likely to confuse, deceive or mislead the public, for private or commercial purposes, for purposes of campaigning for candidates or ballot measures, on any writing distributed for purposes of influencing the action of the electorate, or any part thereof, in any election, or for any purpose other than for the official business of the City, its Council members, officers or departments, without the express consent of the City Clerk or City Manager or their designees under the authority granted by the City Council. The word "person," as used in this Part, shall include a person, firm, association or corporation, and whether acting as principal agent, employee or otherwise. 1246. Use of Seal or Logo by Person Other than Officers and Employees. No person, other than an officer or employee of the City of Tustin, shall use the City Seal, the City Logo, or the Past City Logo, or any cut, facsimile or reproduction thereof, or make or use any design, symbol, emblem, insignia or similar device that is an imitation of the City Seal, the City Logo or the Past City Logo, or that may be mistaken therefor, that is designed, intended or likely to confuse, deceive or mislead the public, for any purpose except to the extent such officer or employee may be authorized to do so by resolution of the City Council. 1247. Policies For the Use of the City Logo. Ordinance No. 1521 Page 3 of 5 DocuSign Envelope ID: F5AAB750-D243-4FB0-A521-EE7F836FBF11 The City Manager is authorized to develop, implement and administer appropriate policies and guidelines for use of the City Logo consistent with this Part, including, without limitation, use in multi -communication mediums by authorized outside entities. Any person granted consent to use the City Logo shall fully comply with such policies and guidelines. 1248. Manufacture and Sale of Souvenirs and Decorative Items. Nothing in this Part shall prevent a person from manufacturing or selling non -documentary objects, such as souvenirs or decorative items, bearing the City Logo or Past City Logo as part of the design, provided that such person undertakes such activity pursuant to agreement with the City, approved by the City Council or by such officer as the City Council may designate, containing such requirements and limitations as the City Council or such officer shall deem appropriate to assure that such use of the City Logo or Past City Logo is in good taste and in the best interests of the City of Tustin. The City Seal may only be used in accordance with Section 1241. 1249. Authority of City Clerk. The City Clerk or the City Clerk's representative shall be the custodian of the City Seal, the City Logo, and the Past City Logo of the City of Tustin. SECTION 2. The Mayor shall sign and the City Clerk shall certify to the passage and adoption of this Ordinance and shall cause the same to be published and posted pursuant to the provisions of law and this Ordinance shall take effect thirty (30) days after passage.
