AT 2242 FOOTHILL BOULEVARD, TUSTIN
SUMMARY:
A request for detachment of a 0.18 -acre territory (the Territory) located adjacent to 2242
Foothill Boulevard, Tustin, CA 92705, from the City of Tustin to the County of Orange.
The majority of the property is located within unincorporated "North Tustin", and the
territory proposed for detachment is located within the City's jurisdictional boundary. The
purpose of the request is to place the entire property under a single jurisdiction for future
development of the property as a single-family residence.
RECOMMENDATION:
Adopt Resolution No. 22-28 approving the property tax exchange for the detachment of
0.18 -acre property from the City of Tustin to the County of Orange, located adjacent to
2242 Foothill Boulevard and owned by Leason Pomeroy.
FISCAL IMPACT:
No fiscal impact. The Territory will be detached from Tax Rate Area No. 13-077 and
consolidated within Tax Rate Area No. 89-095. There is no current assessed value
attributed to the Territory since the site is currently vacant, and given its small size, the
removal of the Territory from Tax Rate Area No. 13-077 would have an immaterial
negative impact on Tax Rate Area 13-077 apportionment factors.
CORRELATION TO THE STRATEGIC PLAN:
The proposed property detachment falls under Goal D of the City's Strategic Plan in that
the proposed detachment furthers the City's collaborative efforts with agencies within and
outside Tustin on issues of mutual interest and concern.

DISCUSSION:
The City of Tustin has received notice from the Orange County Local Agency Formation
Commission (LAFCO) of a request for detachment of a 0.18 -acre territory from the City
of Tustin in a letter dated February 1, 2022 (Attachment A). The majority of the property
is located within unincorporated "North Tustin", and the territory proposed for detachment
is located within the City's jurisdictional boundary. The purpose of the request is to place
the entire property under a single jurisdiction for future development of the property as a
single-family residence. The result of the action would place the entire property under the
jurisdiction of the County of Orange (Figure 1).

Section 99 of the Revenue and Taxation Code provides that prior to the effective date of
any jurisdictional change, the affected entities, i.e., the County and City, are required to
negotiate and agree to the amount of property tax revenues to be exchanged.
Following receipt of notification from the Orange County Assessor's office, the City and
County met and negotiated a property tax exchange conditional upon the detachment of
the Territory becoming final and effective. The Territory will be detached from Tax Rate
Area No. 13-077 and consolidated within Tax Rate Area No. 89-095. It was determined
that there is no current assessed value attributed to the Territory as the site is vacant and

given its small size, the removal of the Territory from Tax Rate Area No. 13-077 would
have an immaterial impact on the Tax Rate Area apportionment factors for that tax rate
area (Attachments B & C).
For the fiscal year commencing in the year after the filing of the statement of boundary
change for Project No. CD 20-13 with the Board of Equalization, pursuant to Government
Code sections 54902 and 57204, a base of Zero Dollars ($0.00) in property tax
attributable to the Territory, and 0.10295639373 of the annual property tax increment
attributable to the Territory shall be transferred from the City of Tustin to the County of
Orange, Structural Fire Fund and Orange County Public Library Fund. Further, the
property tax allocations that are applicable to Tax Rate Area No. 89-095 shall be applied
to the Territory and the City of Tustin's share in the Territory shall be reduced to zero.
CONCLUSION:
Staff recommends that the City Council adopt Resolution No. 22-28, approving an
exchange of property taxes between the City and the County, resulting from the
detachment proposal identified as Pomeroy Property Detachment from the City of Tustin
(CD 20-13), and direct staff to file a certified copy of Resolution No. 22-28 with LAFCO
and the Orange County Auditor -Controller.

Dear Mr. West:
On December 24, 2020, the Orange County Local Agency Formation
Commission (Orange LAFCO) received an application from a private
landowner requesting the detachment of approximately .18 acre from
the City of Tustin (See Exhibit B). The majority of the property is located
within an unincorporated area known as "North Tustin," and the parcel
proposed for detachment is located in the City of Tustin. The purpose
of this application is to place the entire property under a single
jurisdiction for future development of the property as a single-family
residence.

Attachment A
(b) No later than 60 days after the date that the proposal is on the commission's
meeting agenda, a city from which the detachment of territory is proposed
may adopt and transmit to the commission a resolution requesting
termination of the proceedings.
(c) If the city from which the detachment of territory is proposed has adopted
and transmitted to the commission a resolution requesting termination of
proceedings within the time period prescribed by this section, then the
commission shall terminate the proceedings upon receipt of the resolution
from the city.
(d) This section shall not apply if the city from which the detachment of
territory is proposed has adopted and transmitted to the commission a
resolution supporting the proposed change of organization or
reorganization.
The proposed detachment was noted as an informational item on the Commission's
January 13, 2021, regular meeting agenda. The 60 -day period for the City of Tustin to
submit a resolution requesting termination of the proceedings ends on March 14, 2021.

Revenue Impact of Proposed "Pomeroy Property Detachment from the City of
Tustin (CD 20-13)"
The Local Agency Formation Commission has notified us that your agency is involved in a
proposed jurisdictional change. Section 99(c) of the Revenue and Taxation Code provides that
prior to the effective date of any jurisdictional change the affected agencies of such change shall
negotiate the amount of property tax revenues to be exchanged. Section 99 of the Revenue and
Taxation Code requires our office to advise the governing body of each local agency involved in
a jurisdictional change of the amount of property tax revenue and the allocation factor for each
affected agency subject to a negotiated exchange.
To enable the annexing agencies to commence revenue negotiations with the affected agencies
for jurisdictional changes, we are providing the data required by R&T Section 99 on the enclosed
Revenue Impact Analysis Report. Negotiated revenue exchanges should be on an individual
jurisdictional change basis, with specific agreements for each tax rate area. The amount subject
to negotiation may be any amount of revenue not to exceed the amount indicated on column 4 of
the enclosed form, any percentage up to the allocation factor indicated under column 5, or a
combination of a revenue amount plus a percentage.
Annexing Agency's Responsibility
Revenue and Taxation Code Section 99(b)(4) requires this negotiating period to be concluded
within 60 days from receipt of this notification from our office.
Completion of Negotiations
Upon completion of these property tax revenue negotiations, each affected agency must adopt a
resolution, which specifies the following information:
A) Description of the jurisdictional change.
B) Names of the affected agencies.
C) Amount and/or percentage of property tax revenue, by tax rate area, agreed to be
exchanged.
Certified copies of these resolutions should to be sent to the Local Agency Formation Commission
and to our office. This will allow the County to process the jurisdictional change and to adjust
future property tax revenue distributions.

The proposed project is the construction of a single-family residence on currently two legal, vacant

adjacent parcels. The western parcel is Iocated within the unincorporated area of the County of Orange

and has the street/mailing address of 2242 Foothill Boulevard, Santa Ana, CA. The eastern parcel is

located within the City of Tustin and does not have a separate street/mailing address. The western parcel
is approximately 25,9oo square feet in area and the eastern parcel is approximately 7,900 square feet in
area, for a total combined area of approximately 83,800 square feet. In order for the proposed residence
to be constructed, the existing parcels need to be consolidated into a single parcel and located within a
single jurisdiction (County of Orange).

The City of Tustin's and County of Orange's boundary lines will be adjusted so that the eastern lot will be
located within the County's jurisdiction. The general plan designation of the eastern lot will be amended
from the City's Tustin Planned Community Residential to the County of Orange's 1B, Suburban
M
Residential (0.5 –18 DU/acre). The land use zoning of the eastern lot will be changed from the City of

Tustin's Planned Development District to the County's 125-E4-20000 District (Small Estates
(Residential)) in'order to be consistent with the western parcel and surrounding properties.
Therefore, the project process involves the detachment from the City of Tustin of the 7,900 square foot
(o.18 acres); and the County adopting a General Plan designation and pre -zoning to the County General
Plan/Zoning of 0 "Suburban Residential" and 125-E-4-20000 (Small Estates (Residential), respectively
for this parcel. The minimum lot size within this zoning is 20,000 square feet. The combined lots will
be approximately 33,800 square feet. Upon the completion of this process, the County General Plan
land use designation and zoning will be consistent.
The applicant has filed an application with the Orange County Local Agency Formation Commission
(LAFCO) to detach the existing eastern parcel from within the City of Tustin's jurisdiction and annex it
to the County of Orange's jurisdiction. Simultaneously the applicant has filed a building permit
application with the accompanying plans and a Lot Line Adjustment with the County of Orange.
Currently, water service is immediately available to the site from Foothill Boulevard and served by
Golden State Water Company. Sewer service is immediately available from Foothill Boulevard and

north of Padias Lane from the City of Tustin to the County of Orange ("County"); and
WHEREAS, the Territory is depicted and described in Exhibits A and B, attached
hereto and incorporated herein by reference; and
WHEREAS, Section 99 of the Revenue and Taxation Code provides that prior to
the effective date of any jurisdictional change, the affected entities, i.e., the County and
City, are required to negotiate and agree to the amount of property tax revenues to be
exchanged -and
WHEREAS, Section 95, Subdivision (g), of the Revenue and Taxation Code provides
that if the area subject to a jurisdictional change is within the same combinations of local
agencies and school entities as an existing tax rate area, the two tax rate areas may be
combined into one tax rate area; and
WHEREAS, the City and County have met and negotiated a property tax exchange
conditional upon the detachment of the Territory becoming final and effective; and
WHEREAS, the Territory will be detached from Tax Rate Area No. 13-077 and
consolidated within Tax Rate Area No. 89-095; and
WHEREAS, there is no current assessed value attributed to the Territory, given the
site is vacant and its small size and the removal of the Territory from Tax Rate Area No.
13-077 would have an immaterial impact on the Tax Rate Area apportionment factors for
that tax rate area.

NOW THEREFORE BE IT RESOLVED, the City Council of the City of Tustin
resolves as follows:
1. The City Council does hereby approve an exchange of property taxes
between the City and the County, resulting from the detachment proposal identified as
Pomeroy Property Detachment from the City of Tustin (CD 20-13).
2. For the fiscal year commencing in the year after the filing of the statement
of boundary change for Project No. CD 20-13 with the Board of Equalization pursuant
to Government Code sections 54902 and 57204, a base of Zero Dollars ($0.00) in
property tax attributable to the Territory, and 0.10295639373 of the annual property tax
increment attributable to the Territory shall be transferred from the City of Tustin to the
County of Orange, Structural Fire Fund and Orange County Public Library Fund and the
property tax allocations that are applicable to Tax Rate Area No. 89-095 shall be
applied to the Territory and the City of Tustin's share in the Territory shall be reduced to
zero.

filed in Book 772, Page 33 through 40, inclusive, of Miscellaneous Maps in the Office of the County Recorder
of said Orange County, described more particularly as follows:
COMMENCING at an angle point in the existing Boundary Line of the City of Tustin as described in the
Irvine/Peters Canyon Annexation No. 117, said angle point being the Southwesterly terminus of that certain
course described in said Irvine/Peters Canyon Annexation No. 117 as "North 39°46'54" East 1331.93 feet",
said angle point also being the Southerly corner of Tract No. 8640, in the Unincorporated Territory of the
County of Orange, State of California, as per map filed in Book 359, Pages 4 through 8, inclusive, of
Miscellaneous Maps, in the Office of the County Recorder of said Orange County; thence along the
Southeasterly boundary line of said Tract No. 8640, said Southeasterly boundary line also being the
