WEST, CITY MANAGER FROM: COMMUNITY DEVELOPMENT DEPARTMENT SUBJECT: PROPERTY TAX EXCHANGE BETWEEN THE CITY OF TUSTIN AND THE COUNTY OF ORANGE - DETACHMENT OF PROPERTY LOCATED AT 2242 FOOTHILL BOULEVARD, TUSTIN SUMMARY: A request for detachment of a 0.18 -acre territory (the Territory) located adjacent to 2242 Foothill Boulevard, Tustin, CA 92705, from the City of Tustin to the County of Orange. The majority of the property is located within unincorporated "North Tustin", and the territory proposed for detachment is located within the City's jurisdictional boundary. The purpose of the request is to place the entire property under a single jurisdiction for future development of the property as a single-family residence. RECOMMENDATION: Adopt Resolution No. 22-28 approving the property tax exchange for the detachment of 0.18 -acre property from the City of Tustin to the County of Orange, located adjacent to 2242 Foothill Boulevard and owned by Leason Pomeroy. FISCAL IMPACT: No fiscal impact. The Territory will be detached from Tax Rate Area No. 13-077 and consolidated within Tax Rate Area No. 89-095. There is no current assessed value attributed to the Territory since the site is currently vacant, and given its small size, the removal of the Territory from Tax Rate Area No. 13-077 would have an immaterial negative impact on Tax Rate Area 13-077 apportionment factors. CORRELATION TO THE STRATEGIC PLAN: The proposed property detachment falls under Goal D of the City's Strategic Plan in that the proposed detachment furthers the City's collaborative efforts with agencies within and outside Tustin on issues of mutual interest and concern. DocuSign Envelope ID: 79268796-7620-44CD-A6D2-5682707D1ADA Pomeroy Detachment June 7, 2022 Page 2 DISCUSSION: The City of Tustin has received notice from the Orange County Local Agency Formation Commission (LAFCO) of a request for detachment of a 0.18 -acre territory from the City of Tustin in a letter dated February 1, 2022 (Attachment A). The majority of the property is located within unincorporated "North Tustin", and the territory proposed for detachment is located within the City's jurisdictional boundary. The purpose of the request is to place the entire property under a single jurisdiction for future development of the property as a single-family residence. The result of the action would place the entire property under the jurisdiction of the County of Orange (Figure 1). Location Map Section 99 of the Revenue and Taxation Code provides that prior to the effective date of any jurisdictional change, the affected entities, i.e., the County and City, are required to negotiate and agree to the amount of property tax revenues to be exchanged. Following receipt of notification from the Orange County Assessor's office, the City and County met and negotiated a property tax exchange conditional upon the detachment of the Territory becoming final and effective. The Territory will be detached from Tax Rate Area No. 13-077 and consolidated within Tax Rate Area No. 89-095. It was determined that there is no current assessed value attributed to the Territory as the site is vacant and DocuSign Envelope ID: 79268798-7820-44CD-A6D2-5682707D1ADA Pomeroy Detachment June 7, 2022 Page 3 given its small size, the removal of the Territory from Tax Rate Area No. 13-077 would have an immaterial impact on the Tax Rate Area apportionment factors for that tax rate area (Attachments B & C). For the fiscal year commencing in the year after the filing of the statement of boundary change for Project No. CD 20-13 with the Board of Equalization, pursuant to Government Code sections 54902 and 57204, a base of Zero Dollars ($0.00) in property tax attributable to the Territory, and 0.10295639373 of the annual property tax increment attributable to the Territory shall be transferred from the City of Tustin to the County of Orange, Structural Fire Fund and Orange County Public Library Fund. Further, the property tax allocations that are applicable to Tax Rate Area No. 89-095 shall be applied to the Territory and the City of Tustin's share in the Territory shall be reduced to zero. CONCLUSION: Staff recommends that the City Council adopt Resolution No. 22-28, approving an exchange of property taxes between the City and the County, resulting from the detachment proposal identified as Pomeroy Property Detachment from the City of Tustin (CD 20-13), and direct staff to file a certified copy of Resolution No. 22-28 with LAFCO and the Orange County Auditor -Controller. The City Council does hereby approve an exchange of property taxes between the City and the County, resulting from the detachment proposal identified as Pomeroy Property Detachment from the City of Tustin (CD 20-13). 2. For the fiscal year commencing in the year after the filing of the statement of boundary change for Project No. CD 20-13 with the Board of Equalization pursuant to Government Code sections 54902 and 57204, a base of Zero Dollars ($0.00) in property tax attributable to the Territory, and 0.10295639373 of the annual property tax increment attributable to the Territory shall be transferred from the City of Tustin to the County of Orange, Structural Fire Fund and Orange County Public Library Fund and the property tax allocations that are applicable to Tax Rate Area No. 89-095 shall be applied to the Territory and the City of Tustin's share in the Territory shall be reduced to zero.
