RESOLUTION NO. 22-28
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, APPROVING PROPERTY TAX EXCHANGE BETWEEN THE CITY
OF TUSTIN AND THE COUNTY OF ORANGE REGARDING THE DETACHMENT
OF PROPERTY LOCATED ADJACENT TO 2242 FOOTHILL BOULEVARD,
TUSTIN
WHEREAS, the Orange County Local Agency Formation Commission (LAFCO)
notified the City of Tustin ("City") of an application to detach an approximate 0.18 -acre
property (the "Territory") located adjacent to 2242 Foothill Boulevard Tustin, CA 92705 and
north of Padias Lane from the City of Tustin to the County of Orange ("County"); and
WHEREAS, the Territory is depicted and described in Exhibits A and B, attached
hereto and incorporated herein by reference; and
WHEREAS, Section 99 of the Revenue and Taxation Code provides that prior to
the effective date of any jurisdictional change, the affected entities, i.e., the County and
City, are required to negotiate and agree to the amount of property tax revenues to be
exchanged;and
WHEREAS, Section 95, Subdivision (g), of the Revenue and Taxation Code provides
that if the area subject to a jurisdictional change is within the same combinations of local
agencies and school entities as an existing tax rate area, the two tax rate areas may be
combined into one tax rate area; and
WHEREAS, the City and County have met and negotiated a property tax exchange
conditional upon the detachment of the Territory becoming final and effective; and
WHEREAS, the Territory will be detached from Tax Rate Area No. 13-077 and
consolidated within Tax Rate Area No. 89-095; and
WHEREAS, there is no current assessed value attributed to the Territory, given the
site is vacant and its small size and the removal of the Territory from Tax Rate Area No.
13-077 would have an immaterial impact on the Tax Rate Area apportionment factors for
that tax rate area.

NOW THEREFORE BE IT RESOLVED, the City Council of the City of Tustin
resolves as follows:
1. The City Council does hereby approve an exchange of property taxes
between the City and the County, resulting from the detachment proposal identified as
Pomeroy Property Detachment from the City of Tustin (CD 20-13).
2. For the fiscal year commencing in the year after the filing of the statement
of boundary change for Project No. CD 20-13 with the Board of Equalization pursuant
to Government Code sections 54902 and 57204, a base of Zero Dollars ($0.00) in
property tax attributable to the Territory, and 0.10295639373 of the annual property tax
increment attributable to the Territory shall be transferred from the City of Tustin to the
County of Orange, Structural Fire Fund and Orange County Public Library Fund and the
property tax allocations that are applicable to Tax Rate Area No. 89-095 shall be
applied to the Territory and the City of Tustin's share in the Territory shall be reduced to
zero.
PASSED AND ADOPTED by the City Council of the City of Tustin at a regular
meeting on the 7t" day of June, 2022.

In the City of Tustin, County of Orange, State of California, being all of Lot 'Q' of Tract No. 15563 as per map
filed in Book 772, Page 33 through 40, inclusive, of Miscellaneous Maps in the Office of the County Recorder
of said Orange County, described more particularly as follows:
COMMENCING at an angle point in the existing Boundary Line of the City of Tustin as described in the
Irvine/Peters Canyon Annexation No. 117, said angle point being the Southwesterly terminus of that certain
course described in said Irvine/Peters Canyon Annexation No. 117 as "North 39°46'54" East 1331.93 feet",
said angle point also being the Southerly corner of Tract No. 8640, in the Unincorporated Territory of the
County of Orange, State of California, as per map filed in Book 359, Pages 4 through 8, inclusive, of
Miscellaneous Maps, in the Office of the County Recorder of said Orange County; thence along the
Southeasterly boundary line of said Tract No. 8640, said Southeasterly boundary line also being the
aforementioned existing Boundary Line of the City of Tustin, North 39°46'54" East 1131.93 feet to the
Southwesterly corner of Lot 'Q' of said Tract No. 15563, said Southwesterly cornerbeing the TRUE POINT
OF BEGINNING; thence leaving the Southeasterly boundary line of said Tract No. 8640 and said existing
boundary line of the City of Tustin, along the Southerly, Easterly, and Northeasterly lines of said Lot'Q' the
following courses:
North 64°09'18" East 32.42 feet,
South 82°12'43" East 52.55 feet to the beginning of a curve concave Northwesterly and having
a radius of 40.00 feet;
thence Easterly and Northeasterly, along said curve, through a central angle of 81°06'31", an
arc length of 56.62 feet;
thence North 16°40'46" East 35.95 feet to the beginning of a non -tangent curve concave
Northeasterly and having a radius of 320.00 feet, a radial line to said beginning bears South
64°32'29" West;
thence Northwesterly, along said curve, through a central angle of 12°26'15", an arc length of
69.46 feet to the most Northerly corner of said Lot 'Q', said corner being a point on said
Boundary Line of the City of Tustin and the Northeasterly extension of the Southeasterly
Boundary Line of said Tract No. 8640;
thence Southwesterly along said Northeasterly extension and said Boundary Line of the City of Tustin, South
39°46'54" West 175.74 feet to the TRUE POINT OF BEGINNING.
The above described parcel contains 0.183 Acres (7,967 square feet), more or less.
Also as shown on Exhibit 'B' attached hereto and by this reference made a part hereof.
