SUBJECT: POLICE DEPARTMENT VEHICLE PURCHASES
SUMMARY
Purchase nine (9) 2006 Dodge Charger police units to replace older model high mileage
vehicles. Purchase one (1) Dodge Durango to replace older model high mileage
parking control truck. Award contract for police equipment conversion work for newly
purchased police units.
RECOMMENDATION
It is recommended that the City Council approve the purchase of:
1. Nine (9) 2006 Dodge Charger police vehicles from Moss Brothers Dodge in
Riverside, California in the amount of $213,431.49 (including tax and license).
2. One (1) 2006 Dodge Durango police vehicle from the CMAS state contract
through Lasher Dodge in Sacramento, California in the amount of $23,808.26
(including tax and license.)
3. Police equipment conversion packages for the conversion of nine (9) 2006
Dodge Charger police vehicles and one (1) 2006 Dodge Durango police vehicle
from Northstar Graphics in Downey, California in the amount of 7,133.81 per
conversion, for a total cost of $71 ,338.10.
FISCAL IMPACT
Adequate funds are currently available in account #84-801-9730 (Vehicle Equipment
Lease and Replacement Fund) in the amount of $ 308,577.85.
BACKGROUND
In fiscal year 2006/2007 it is necessary to replace several existing vehicles in the police
fleet due to age, mileage and/or safety history. The proposed vehicle purchases will
serve as replacement vehicles for these designated vehicles.
Dodae Charaer Police Vehicle Purchases:
The purchase of the proposed Dodge Charger police vehicles represents the beginning
of a police fleet conversion process which will migrate the fleet from the Ford Crown
Victoria to the Dodge Charger. The decision to convert the fleet to the Dodge product
is based on multiple criteria, the most significant factors include:
1. Safety factor of Dodge's Electronic Stability Program (ESP)
2. Safety of acceleration due to Dodge's Electronic Traction Control System (ETCS)
which stabilizes control of the vehicle while accelerating.
3. Superior four-wheel independent suspension.
4. Safety factors specific to Dodge which include: emergency brake assist; multi-
stage air bags; constant force seat belts with pretensioners.
5. Standard features available in police package, i.e. auxiliary wiring harness;
improvements to auxiliary power supply.
6. Overall safety of Dodge when compared to Ford Crown Victoria. Ford has yet
been able to correct the gas tank concerns which have resulted in multiple gas
tank explosions on impact of police units.
Staff conducted exhaustive research into the available police package vehicles on the
market today. In addition to our own test drive and evaluation process, we also
consulted the test process conducted by Los Angeles County Sheriff's office. LASO
rated the Dodge Charger in ten (10) police use specific test scenarios. The Dodge
Charger was rated highly in all areas of evaluation, including: pursuit course handling;
high speed evaluation; brake testing; acceleration; fuel efficiency and many others.

The final decision to convert to Dodge was predominantly based on the increased
safety of the vehicle. Ford, while an adequate supplier in the past, has not made any
safety improvements or enhancements to the Crown Victoria in over five years. Ford
engineers continue to struggle with the gas tank placement concerns and no adequate
correction has been established to date. Because of Ford's lack of development on
their police model cars; it has been widely rumored that Ford is preparing to get out of
the police package manufacturing business to concentrate on their public consumer
offerings. Safety specific features for the Dodge Charger are outlined in the fleet
coordinator's memorandum dated 4/27/06. (Refer copy attached, Dodge Charger
Recommendation by Fleet Coordinator, Ralph Casiello.)
Unfortunately, the Dodge Charger was not included in the State of California vehicle
and equipment contracts for the 2006/2007 fiscal year. Accordingly, these vehicles are
not being purchased through the state bid process. The state contract pricing is,
however, based upon large volume purchases which result in lower purchase prices
overall to participating agencies. In order to insure large volume purchase discounts,
one Southern California dealership with fleet sales history elected to make large volume
purchases of the Dodge Charger to service all southern California law enforcement
agencies. This dealership, Moss Brothers Dodge in Riverside, CA has been the primary
supplier to all law enforcement agencies since they are able to bid the Dodge Charger
at a significantly reduced price due to their inventory volume.
The Tustin Police Department purchase through Moss Brothers Dodge is based upon
the formal bid process conducted by Orange County Sheriff's Office for the purchase of
their Dodge Charger police units. Tustin Police Department was able to negotiate the
same purchase price with Moss Brothers Dodge as that awarded to O.C. Sheriffs, at
$21,348 per unit. (Refer copy attached, County of Orange Transportation Fleet
Management Division bid process # EBZ8-A3; and copy attached, Moss Brothers quote
for the City of Tustin.)
In addition to the competitive price, the choice of Moss Brothers Dodge as the supplier
will allow Tustin Police Department to immediately take delivery of the purchased
vehicles, as Moss Brothers has all nine vehicles in stock. This is a significant
advantage as well, since our historical wait time on ordered vehicles is generally 6-9
months through the state contracted dealers. This will allow us to put the new vehicles
on the street with a much improved turn-around time from delivery through conversion.
To insure that the offered price from Moss Brothers Dodge is competitive, staff reviewed
published prices obtained from local vendors and compared those prices to that offered
by Moss Brothers Dodge. Staff also contacted Tustin Dodge in the Tustin Auto Center
and received a quote for a Dodge Charger police package vehicle. Tustin Dodge does
not have the police series vehicle in stock and would have to order them from the
manufacturer. In addition, Tustin Dodge will not be able to order the 2006 model Dodge
Charger since that year model is no longer being produced; and the 2007 year model
for the same vehicle reflects a price increase of approximately $3000 per vehicle. (Refer

2006 Dodae Duranao Purchase:
The single Dodge Durango being purchased will replace the existing Parking Control
Truck due to age, mileage, and safety concerns. The existing Parking Control truck is a
specialty designated vehicle, used only by the Parking Control Officer during designated
hours. With fiscal responsibility at the forefront, we are in the process of replacing all
single use vehicles with multi-purpose vehicles. This will enable us to keep these
vehicles in service around the clock, thereby reducing the size of the fleet necessary.
Accordingly, the parking truck will be replaced with a Dodge Durango chosen
specifically to match the civilian fleet of vehicles. These vehicles were chosen for their
utilitarian body style enabling the conversion of the cabin area for storage of equipment
and supplies necessary for Crime Scene Investigation and Traffic Collision reporting.
Each year, since the State of California buys in large volume, they are able to receive a
more competitive price for vehicles than the City would be able to obtain independently.
For that reason we will purchase the Durango through the CMAS established contract.
To insure that the offered price on the CMAS contract is competitive, staff reviewed
published prices obtained from local vendors and compared those prices to that offered
by CMAS. Staff also contacted Tustin Dodge in the Tustin Auto Center and received a
quote for a Dodge Durango. (Refer City of Tustin Open Market Purchase Quotes for

Purchase of Police Eauipment Conversion Services:
Police equipment conversion services for the Dodge Charger will be significantly less
expensive than those previously paid to convert the Ford Crown Victoria due to the
standard equipment options available on the Dodge Charger police package. Each
vehicle comes equipped with the necessary wiring harness which streamlines the
conversion process and reduces the costs for initial wiring. This is significant in the
overall price of the converted vehicle. The base price on the Dodge Charger is slightly
higher than that of the Ford Crown Victoria; however, the conversion costs for the
Dodge Charger, due to standard features in the police package, are significantly lower;
making the overall price of the converted Dodge Charger equivalent to the price of a
converted Crown Victoria.
In pricing conversion services, it is important to note that, while there are a number of
vendors available in a tri-state area including Nevada and Arizona, proximity to the
Police Department is a major factor in the decision making. The proximity factor is
significant with regards to transporting the vehicles to and from the vendor's facility and
in the oversight of the conversion process. Since all police agencies operate under
slightly different conversion specifications, it is the duty of the fleet coordinator to
oversee the conversion process by inspecting the vehicle at various stages of
development (i.e. wiring schematics, equipment mounting devices and location, etc.)
With this oversight, the coordinator makes multiple personal trips to and from the
conversion vendor's location and is also responsible for scheduling necessary
personnel to deliver and pick-up vehicles from the vendor's facility. With these factors,
we are limited to the selection of a vendor within a 100 mile or less radius of the Police
Department, as any further distance would be counterproductive, staff time and
personnel intensive, and costly.
The second consideration for a conversion vendor is the size of their operation. The
size of the operation directly correlates to the amount of time the conversion process
will take. Smaller operations with fewer employees will obviously require a longer
processing period than those larger companies with more available manpower.
Conversions can take anywhere from One week to three months to complete. The
longer processing period requires more time from the fleet coordinator and delays the
availability of the vehicle.
With these considerations in mind, staff solicited bids from all vendors within a feasible
proximity to the Police Department and with sufficient staff to process the vehicles within
a reasonable time frame. Staff is recommending that we award the bid to Northstar
Graphics in Downey, CA. The recommendation for Northstar is based solely on them
being the low bid in the process. They are our current conversion vendor and their work
lately has been substandard and their turn-around time extended. Due to the fact that
their bid is significantly lower than all other bids, we feel that it is in the City's best fiscal
interest to work with Northstar to improve their work product and turn-around time. We
will accomplish this through close scrutiny of their work product and agreeing upon due
dates for work completion prior to drop off. Refer to the Open Market Purchase

FULL-SIZE 4-DOOR BLACK AND WHITE RWD SEDANS WITH POLICE PACKAGE (QUANTITY 4)
These specifications are provided in accordance with the policies of the County of Orange, to obtain equipment
suitable for the service demands of the Agency or Department involved.
All installations shall be made in a neat and professional manner. All equipment furnished shall be of
standard manufacture. All work and material furnished shall be subject to inspection and approval through the
Manager, Resources Development Management Department. Transportation Fleet Management Division.
This equipment and all its components shall be of the latest model and shall not have been used in
demonstration or other service
Where specifications for specific items are not included, manufacturer's standard specifications are
satisfactory or they are not applicable to this equipment,
All equipment and accessories shall be installed and comply with the requirements of applicable California
Vehicle Codes and Federal Safety Regulations currently in force.
Quality, construction details, materials, performance characteristics and price quotations will be analyzed by
competent County authorities and the equipment which, in their opinion, best serves the interest of the County
will be purchased.
The County specifically reserves the right to reject any or all quotatlons, The County shall not be required
to make a statement of the reason for rejection.
It is desired that the manufacturer, in the selection of components to build these automobiles. will use
materials and design practices that are the best available in the industry for the type of operating conditions
to which the vehicles will be subjected. Engine, transmission, drive line differential, brake, suspension,
wheel, tire and other component parts of the vehicles shall be so designed or selected to give maximum
performance, service life and safety, and not merely meet the minimum requirements of this specltlcatlon.
The term HEAVY-DUTY as applied shall exceed the usual quality or capacity supplied with standard production
vehicles and shal I be able to withstand unusual strain, exposure, temperature, wear, and use.
If the manufacturer certifies that the components marked "HEAVY-DUTY" in the specifications are heavy duty,
this will be acceptable to the County. If any problems are encountered in the operation of the vehicles due to
the heavy-duty components not satisfactorily performing. these problems are to be corrected and the parts
replaced at the manufacturer's expense.

It is mandatory that the vehicles be completely assembled by manufacturer using factory-engineered component,
parts, and accessories Modification or alteration of vehicles at the dealer level will NOT be acceptable.
Prior to the award of a purchase order by the County. the manufacturer may be required to submit for test and
evaluating a "demonstration" vehicle equal in all respects to the unit proposed to be furnished. Arrangements
will be made by RDMD/Transportation Fleet Management Division. The manufacturer submitting equipment for test
and evaluation shall assume the entire responsibility for any/all damage that might occur to the vehicle and
shall hold the County harmless for vehicle damages of any nature.
Quality, construction details. materials. performance characteristics and price quotations will be analyzed by
competent County authorities and the equipment which. in their opinion. best serves the interest of the County
will be purchased. The County specifically reserves the right to reject any or all proposals. The County shall
not be required to make a statement of the reason for rejection.
Deviations from these specifications which exceed specified dimensions. capacity. quality or performance. may
be considered unless specific or maximum requirements are set. provided that the manufacturer submits full
description and explanation of and justification for proposed deviation based on acceptable engineering
practices.
No quotations will be considered which in any manner decrease the quality. or work performance of the equipment

I. GENERAL INFORMATION
1. RDMD/Purchasing regular business hours are 8:00 a.m. to 12:00 p.m. and 1:00 p.m. to 5:00 p.m.,

3. Throughout this document, its attachments and any resulting contract the terms "price agreement",
"contract", "purchase document", and "purchase order" may be used interchangeably and refer to the
proposed contract and its attachments. The terms "change order" and "modification" may be used
interchangeably and refer to a written document which changes one or several term(s), condition(s) or
requirement( s) of the proposed contract or its attachments. The terms "bid" and "quote" may be used
interchangeably and refer to your response to this document and its attachments. Whenever used
herein and any resulting contract "COUNTY" shall mean County of Orange, a political subdivision of
the State of California.
II. BID INSTRUCTIONS - GENERAL
I. A failure to respond to this solicitation may eliminate your firm from the County Purchasing
system for this commodity/service. Returning a "NO BID" response by the bid due date and time
will keep your firm in the system. If you choose to "NO BID" this IFB, please complete the
appropriate section on the cover sheet of the IFB, indicating the reason( s) why you have chosen
not to bid.
2. This Invitation For Bid consists of the Cover Page, Attachments A through D. Responsive bids
will inclnde the following completed pages: Cover Sheet, signed and dated by authorized
company representative; Vehicle Specifications, Attachment B - Contractor Bid,
Attachment D (4 pages) - Company Profile, Child Support & EDD Requirement Form.
Bid submission forms must be properly filled out. Failure to comply to bid specifications will
result in disqualifications of the bid. Specifications. Clear, concise specifications must be
provided. Frequently, specifications state "brand name or equal." "Brand name" includes
identification of products by manufacturer, make, and model. If vendor bids an "or equal",

vendor must state the brand name and submit complete specifications and/or samples with their
bids. Determination or equality shall be at the sole discretion of the County. If it has been
justified and accepted by the requesting agency/department and the Purchasing Agent or
Standards Committee that only one brand can meet the County's needs, "no exceptions" shall be
noted in the specifications. Any alternate manufacturers are not being solicited and are therefore
subject to the approval of the using department. A wards may be made in any combination that is
most beneficial to the County of Orange. Including no award, if in the best interest of the County
of Orange. NO LATE BIDS WILL BE ACCEPTED REGARDLESS OF THE REASON.
3. The cover sheet of a responsive bid must be signed appropriately and completed with the date,
company name, and name and title of two corporate officers authorized to sign on behalf of the
company. The first signature must be that of either the chairman of the board, president or any
vice president. The second signature may be secretary, an assistant secretary, the chief financial
officer or any assistant treasurer.
4. Bids must be provided for each item separately; "all-or-none" bids will not be accepted unless in
the best interest of the County.
5. All bids must be received by RDM/Purchasing, 300 N. Flower Street, Room 838, Santa Ana CA
92703, time- and date-stamped prior to 2:00 p.m. on the date bids are due, unless other
instructions are provided.
6. TELEFAXED OR E-MAILED BIDS will not be accepted.
7. MAILED BIDS may be returned via the mail or hand delivered to the RDMD/Purchasing
Division located at 300 N. Flower Street, Santa Ana, CA 92703, Attn: Josie Alfaro. All
envelopes containing mailed bids must be marked with the date and time ofthe bid closing for
that solicitation. It is the bidder's responsibility to verify that the closing date on the bid envelope
matches the closing date of the bid. Only one bid submittal will be accepted per envelope.
8. Any questions or requests for interpretations or clarifications shall be requested in writing 4 (four)
working days prior to the date bids are due. If clarification of the IFB is considered necessary, a
written addendum shall be issued. Oral statement(s) concerning the meaning of the contents of
this IFB by any person is unauthorized and invalid. All inquiries concerning this IFB should be

9. Contractors shall take all responsibility for any errors or omissions in their bids. Any
discrepancies in numbers or calculations shall be interpreted to reflect the lowest price to the
County of Orange.
10. The County shall not be liable for any expenses incurred by potential contractors in the
preparation or submission of their bids.
III. PROTEST PROCEDURES
Prospective contractors are advised that protests of specifications, terms, conditions or any other aspect of
this solicitation must be made prior to the bid or proposal due date. Protest of specifications and
solicitation terms and conditions made after that date will not be considered by the Deputized Purchasing
Agent. Protest of award must be made immediately, and in no event later that five days after the
aggrieved party knows, or should have known, the facts giving rise thereto. All protests must include the
following:

A. The name, address and telephone number of the protester;
B. The signature of the protester or protester's representative;
C. The solicitation or contract number;

Note: The Board of Supervisors may not consider the protest if the above administrative procedure has
not been followed.
IV. ACCEPTANCE/REJECTION/REVIEW/AWARD
I. The County, at its sole discretion, reserves the right to accept or reject any or all quotations
received as a result of this solicitation, or to cancel in part or in its entirety this solicitation. The
County shall not be required to make a statement of reason for rejection. All opened bids
received will be public record.
2. The County reserves the right to waive, at its discretion, any irregularity or informality, which the
County deems correctable or otherwise not warranting rejection ofthe bid.
3. The County reserves the right to waive any reqnirement specified in this solicitation if the
best interest of the County will he served in so doing.
4. When more than one line item is specified in a solicitation, the County of Orange reserves the
right to determine the lowest responsible bidder on the basis of individual items, groups of items,
or all items included in the solicitation, unless otherwise expressly provided for in the solicitation.
The County may accept any item or group of items included in the bid unless the bidder expressly
objects in its response to the solicitation and conditions its response on the County purchasing all
items for which the bidder provided bids. In the event that the bidder so objects, the County may
consider the bidder's objection non-responsive and may render the bidder ineligible for award.
5. Final award determination will be based primarily on the lowest responsive, responsible bid, but is
contingent upon the using agency's approval, which may include a qualifications appraisal of
Contractor based on response to the solicitation, products/equipment offered, references, service,
experience and facility inspection, if deemed appropriate. No quotations will be considered which
in any manner decreases the quality, or work performance of the equipment described in
Attachment B, specifications.
6. The County reserves the right. at its sole discretion. to make multiple awards to bidders/proposers
for goods/services requested in this solicitation. Contract awards may be made in any
combination of items included in the bid solicitation that is most advantageous to the County of
Orange. The County may choose not to issue any contract resulting from this solicitation if it is
in the best interests ofthe County.
7. Any exceptions to the County's terms and conditions must be clearly stated in your response to
the request under separate Section entitled "Exceptions." Any exception must include the details
of the exception and the reasons for it. The County reserves the right to disqualiJy vendors taking

exception to its terms and conditions. Vendors taking exception after notice of award will be
disqualified from receiving Purchase Order award.
8. Vendor agrees to supply items shown, as needed by the Couuty, at prices listed upon Purchase
Order.
9. All vehicles must meet California Motor Vehicle, CAL-OSHA regulations and all other
applicable codes required for use on highways in the State of California.
7. By participating in this solicitation, bidders agree to accept the decision of the County Purchasing
Agent as final.
8. The lowest responsive, responsible bid may be subject to further negotiations.
V. SPECIAL REQUIREMENTS
I. Bidders may be required to present satisfactory evidence that they have been regularly engaged in
the business of providing services or commodities required by this solicitation or are reasonably
familiar therewith and that they are fully prepared with the necessary capital, materials, and
machinery as may be required or specified in this solicitation to complete the work to be
contracted to the satisfaction of the County.
2. Bidders may be required to provide information regarding and/or proof of the number of years
they have provided the commodity/services requested in this solicitation.
3. No bid shall be considered from a Contractor who, at the time the bid is submitted, is not licensed
to contract for this project in accordance with the law under provisions of Division III, Chapter 9,
of the Business and Professions Code of the State of California. In the event of a dispute as to the
classification of license required, the opinion of the Contractor's State License Board shall
prevail. This requirement is not an informality and shall not be waived.
VI. COMPENSATION/INVOICING
I. Invoice Submittal: Contractor will submit invoice(s) to County of Oranee/RDM: Attn:
Accounts Pavable. 300 N. Flower Street # 838. Santa Ana. CA 92703. Each invoice will have
a number and will include the following information:
A. Name of user agency/department;
B. Address of user agency/department;
C. Contract number;
D. Date of service;
E. Service description;
F. Name and address of contractor; and
G. Contractor's federal taxpayer's ill number.
2. Acceptance of Services: Payments made by the County shall not preclude the right of the
County to thereafter dispute any services involved or billed under this agreement and shall not be
construed as acceptance of any part of the services.

3. Method of Compensation: Invoices are to be submitted in arrears for services provided. Billing
shall cover services and/or goods not previously invoiced. Payment will be net 30 days after
receipt of an invoice in a format acceptable to the County of Orange, and verified and approved
by the agency/department and subject to routine processing requirements. The responsibility for
providing acceptable invoices rests with the Contractor.

I. GENERAL TERMS AND CONDITIONS
A. Governing Law and Venue: This Contract has been negotiated and executed in the state of
California and shall be governed by and construed under the laws of the state of California. In the event of
any legal action to enforce or interpret this Contract, the sole and exclusive venue shall be a court of
competent jurisdiction located in Orange County, California, and the parties hereto agree to and do hereby
submit to the jurisdiction of such court, notwithstanding Code of Civil Procedure Section 394.
Furthermore, the parties specifically agree to waive any and all rights to request that an action be
transferred for trial to another county.
B. Entire Contract: This Contract, when accepted by the Contractor either in writing or by the
shipment of any article or other commencement of performance hereunder, contains the entire Contract
between the parties with respect to the matters herein, and there are no restrictions, promises, warranties
or undertakings other than those set forth herein or referred to herein. No exceptions, alternatives,
substitutes or revisions are valid or binding on County unless authorized by County in writing. Electronic
acceptance of any additional terms, conditions or supplemental contracts by any County employee or
agent, including but not limited to installers of software, shall not be valid or binding on County unless
accepted in writing by County's Purchasing Agent or his designee, hereinafter "Purchasing Agent."
C. Amendments: No alteration or variation of the terms of this Contract shall be valid unless made in
writing and signed by the parties; no oral understanding or agreement not incorporated herein shall be
binding on either of the parties; and no exceptions, alternatives, substitutes or revisions are valid or
binding on County unless authorized by County in writing.
D. Taxes: Unless otherwise provided herein or by law, price quoted does not include California state
sales or use tax.
E. Delivery: Time of delivery of goods or services is of the essence in this Contract. County reserves the
right to refuse any goods or services and to cancel all or any part of the goods not conforming to
applicable specifications, drawings, samples, or descriptions or services that do not conform to the
prescribed statement of work. Acceptance of any part of the order for goods shall not bind County to
accept future shipments nor deprive it of the right to return goods already accepted at Contractor's
expense. Over-shipments and under-shipments of goods shall be only as agreed to in writing by County.
Delivery shall not be deemed to be complete until all goods or services have actually been received and
accepted in writing by County.
F. AcceptancelPayment: Unless otherwise agreed to in writing by County, I) acceptance shall not be
deemed complete unless in writing and until all the goods/services have actually been received, inspected,
and tested to the satisfaction of County, and 2) payment shall be made in arrears after satisfactory
acceptance.
G. Warranty: Contractor expressly warrants that the goods/services covered by this Contract are 1) free
of liens or encumbrances, 2) merchantable and good for the ordinary purposes for which they are used,
and 3) fit for the particular purpose for which they are intended. Acceptance of this order shall constitute
an agreement upon Contractor's part to indemnity, defend and hold County and its indemnities as
identified in paragraph "P" below, and as more fully described in paragraph "P", harmless from liability,
loss, damage and expense, including reasonable counsel fees, incurred or sustained by County by reason
of the failure of the goods/services to conform to such warranties, faulty work performance, negligent or
unlawful acts, and non-compliance with any applicable state or federal codes, ordinances, orders, or
statutes, including the Occupational Safety and Health Act (OSHA) and the California Industrial Safety
Act. Such remedies shall be in addition to any other remedies provided by law.

H. Patent/Copyright MaterialslProprietary Infringement: Unless otherwise expressly provided in
this Contract, Contractor shall be solely responsible for clearing the right to use any patented or
copyrighted materials in the performance of this Contract. Contractor warrants that any software as
modified through services provided hereunder will not infringe upon or violate any patent, property right,
or trade secret right of any third party. Contractor agrees that, in accordance with the more specific
requirement contained in paragraph "P" below, it shall indemnify, defend and hold County and County
IndemniteEs harmless from any and all such claims and be responsible for payment of all costs, damages,
penalties and expenses related to or arising from such claim(s), including, but not limited to, attorneys
fees, costs and expenses.
I. Assignment or Sub-Contracting: The terms, covenants, and conditions contained herein shall apply
to and bind the heirs, successors, executors, administrators and assigns of the parties. Furthermore, neither
the performance of this Contract nor any portion thereof may be assigned or subcontracted by Contractor
without the express written consent of County. Any attempt by Contractor to assign or sub-contract the
performance or any portion thereof of this Contract without the express written consent of County shall be
invalid and shall constitute a breach of this Contract.
J. Non-Discrimination: In the performance of this Contract, Contractor agrees that it will comply with
the requirements of Section 1735 of the California Labor Code and not engage nor permit any
subcontractors to engage in discrimination in employment of persons because of the race, religious creed,
color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, or
sex of such persons. Contractor acknowledges that a violation of this provision shall subject Contractor to
all the penalties imposed for a violation of Section 1720 et~. of the California Labor Code.
K. Termination: In addition to any other remedies or rights it may have by law, County has the right to
terminate this Contract without penalty immediately with cause or after 30 days' written notice without
cause, unless otherwise specified. Cause shall be defined as any breach of contract, any misrepresentation
or fraud on the part of the Contractor. Exercise by County of its right to terminate the Contract shall
relieve County of all further obligation.
L Consent to Breach Not Waiver: No term or provision ofthis Contract shall be deemed waived and
no breach excused, unless such waiver or consent shall be in writing and signed by the party claimed to
have waived or consented. Any consent by any party to, or waiver of, a breach by the other, whether
express or implied, shall not constitute consent to, waiver of, or excuse for any other different or
subsequent breach.
M. Remedies Not Exclusive: The remedies for breach set forth in ihis Contract are cumulative as to one
another and as to any other provided by law, rather than exclusive; and the expression of certain remedies
in this Contract does not preclude resort by either party to any other remedies provided by law.
N. Independent Contractor: Contractor shall be considered an independent contractor and neither
Contractor, its employees, nor anyone working under Contractor shall be considered an agent or an
employee of County. Neither Contractor, its employees nor anyone working under Contractor shall
qualify for workers' compensation or other fringe benefits of any kind through County.
O. Performance: Contractor shall perform all work under this Contract, taking necessary steps and
precautions to perform the work to County's satisfaction. Contractor shall be responsible for the
professional quality, technical assurance, timely completion and coordination of all documentation and
other goods/services furnished by the Contractor under this Contract. Contractor shall perform all work
diligently, carefully, and in a good and workman-like manner; shall furnish all labor, supervision,
machinery, equipment, materials, and supplies necessary therefore; shall at its sole expense obtain and
maintain all permits and licenses required by public authorities, including those of County required in its

governmental capacity, in connection with performance of the work; and, if permitted to subcontract,
shall be fully responsible for all work performed by subcontractors.
P. Indemnification and Insurance:
Indemnification Provisions: Contractor agrees to indemnifY, defend with counsel approved in writing by
County, and hold County, its elected and appointed officials, officers, employees, agents and those special
districts and agencies which County's Board of Supervisors acts as the governing Board ("County
Indemnitees") harmless from any claims, demands or liability of any kind or nature, including but not
limited to personal injury or property damage, arising from or related to the services, products or other
performance provided by Contractor pursuant to this Contract. If judgment is entered against Contractor
and County by a court of competent jurisdiction because of the concurrent active negligence of County or
County Indemnitees, Contractor and County agree that liability will be apportioned as determined by the
court. Neither party shall request a jury apportionment.
Insurance Provisions: Prior to the provisions of services under this Contract, the Contractor agrees to
purchase all required insurance at Contractor's expense and to deposit with the County Certificates of
Insurance, including all endorsements required herein, necessary to satisfy the County that the insurance
provisions of this Contract have been complied with and to keep such insurance coverage and the
certificates therefore on deposit with the County during the entire term of this Contract. In addition, all
subcontractors performing work on behalf of Contractor pursuant to this Contract shall obtain insurance
subject to the same terms and conditions as set forth herein for Contractor.
All insurance policies required by this Contract shall declare any deductible or self-insured retention
(SIR) in an amount in excess of $25,000 ($5,000 for automobile liability), which shall specifically be
approved by the County Executive Office (CEO)/Office of Risk Management. Contractor shall be
responsible for reimbursement of any deductible to the insurer. Any self-insured retentions (SIRs) or
deductibles shall be clearly stated on the Certificate ofInsurance.
If the Contractor fails to maintain insurance acceptable to the County for the full term of this contract, the
County may terminate this contract.
Qualified Insurer: The policy or policies of insurance must be issued by an insurer licensed to do
business in the state of California (California Admitted Carrier).
Minimum insurance company ratings as determined by the most current edition of the Best's Kev Ratin!!
Guide/ProDertv-Casualtv/United States or ambest.com shall be A-(Secure Best's Rating) and VIII
(Financial Size Category).
If the carrier is a non-admitted carrier in the state of California, CEO/Office of Risk Management retains
the right to approve or reject carrier after a review of the company's performance and financial ratings.
This policy or policies of insurance maintained by the Contractor shall provide the minimum limits and

All liability insurance, except Professional Liability, required by this contract shall be at least $1,000,000
combined single limit per occurrence. Professional Liability may also be provided on a "Claims Made"
basis. The minimum aggregate limit for the Commercial General Liability policy shall be $2,000,000.
The County of Orange shall be added as an additional insured on all insurance policies required by this
contract with respect to work done by the Contractor under the terms of this contract (except Worker's
Compensation/Employers' Liability and Professional Liability). An additional insured endorsement
evidencing that the County of Orange is an additional insured shall accompany the Certificate of
Insurance.
All insurance policies required by this contract shall be primary insurance, and any insurance maintained
by the County of Orange shall be excess and non-contributing with insurance provided by these policies.
An endorsement evidencing that the contractor's insurance is primary and non-contributing shall
specifically accompany the Certificate of Insurance for the Commercial General Liability and Sexual
Misconduct Liability.
AII insurance policies required by this contract shall give the County of Orange 30 days notice in the
event of cancellation. This shall be evidenced by an endorsement separate from the Certificate of
Insurance. In addition, the cancellation clause must include language as follows, which edits the pre-
printed ACORD certificate.

All insurance policies required by this Contract shall waive all rights to subrogation against the County of
Orange and members of the Board of Supervisors, its elected and appointed officials, officers, agents and
employees when acting in the scope of their appointment or employment.
If Contractor's Professional Liability policy is a "claims made" policy, Contractor shall agree to maintain
professional liability coverage for two years following completion of contract.
The Commercial General Liability policy shall contain a severability of interest clause.
The Contractor is aware of the provisions of Section 3700 of the California Labor Code which requires
every employer to be insured against liability for Workers' Compensation or be self-insured in
accordance with the provisions of that code. The Contractor will comply with such provisions and shall
furnish the County satisfactory evidence that the Contractor has secured, for the period of this Contract,
statutory Workers' Compensation insurance and Employers' Liability insurance with minimum limits of
$1,000,000 per occurrence.
Insurance certificates should be forwarded to the agency/department address listed on the solicitation.
If the Contractor fails to provide the insurance certificates and endorsements within seven days of
notification by CEOlPurchasing or the agency/department purchasing division, award my be made to the
next qualified vendor.
County expressly retains the right to require Contractor to increase or decrease insurance of any of the
above insurance types throughout the term of this Contract. Any increase or decrease in insurance will be
as deemed by County of Orange Risk Manager as appropriate to adequately protect County.

County shall notifY Contractor in writing of changes in the insurance requirements. If Contractor does not
deposit copies of acceptable certificates of insurance and endorsements with County incorporating such
changes within thirty days of receipt of such notice, this Contract may be in breach without further notice
to Contractor, and County shall be entitled to all legal remedies.
The procuring of such required policy or policies of insurance shall not be construed to limit Contractor's
liability hereunder nor to fulfill the indemnification provisions and requirements of this Contract.
The County of Orange Certificate of Insurance and the Special Endorsement for the County of Orange
can be utilized to verifY compliance with the above-mentioned insurance requirements in place of
commercial insurance certificates and endorsements.
Q. Bills and Liens: Contractor shall pay promptly all indebtedness for labor, materials and equipment
used in performance of the work. Contractor shall not permit any lien or charge to attach to the work or
the premises, but if any does so attach, Contractor shall promptly procure its release and, in accordance
with the requirements of paragraph "P" above, indemnifY, defend, and hold County harmless and be
responsible for payment of all costs, damages, penalties and expenses related to or arising from or related
thereto.
R. Changes: Contractor shall make no changes in the work or perform any additional work without the
County's specific written approval.
S. Change of Ownership: Contractor agrees that if there is a change or transfer in ownership of
Contractor's business prior to completion of this Contract, the new owners shall be required under terms
of sale or other transfer to assume Contractor's duties and obligations contained in this Contract and
complete them to the satisfaction of County.
T. Force Majeure: Contractor shall not be assessed with liquidated damages or unsatisfactory
performance penalties during any delay beyond the time named for the performance of this Contract
caused by any act of God, war, civil disorder, employment strike or other cause beyond its reasonable
control, provided Contractor gives written notice of the cause of the delay to County within 36 hours of
the start of the delay and Contractor avails himself of any available remedies.
U. Confidentiality: Contractor agrees to maintain the confidentiality of all County and County-related
records and information pursuant to all statutory laws relating to privacy and confidentiality that currently
exist or exist at any time during the term of this Contract. All such records and information shall be
considered confidential and kept confidential by Contractor and Contractor's staff, agents and employees.
V. Compliance with Laws: Contractor represents and warrants that services to be provided under this
Contract shall fully comply, at Contractor's expense, with all standards,laws, statutes, restrictions,
ordinances, requirements, and regulations (collectively "laws"), including, but not limited to those issued
by County in its governmental capacity and all other laws applicable to the services at the time services
are provided to and accepted by County. Contractor acknowledges that County is relying on Contractor to
ensure such compliance, and pursuant to the requirements of paragraph "P" above, Contractor agrees that
it shall defend, indemnifY and hold County and County Indemnitees harmless from all liability, damages,
costs and expenses arising from or related to a violation of such laws.
W. Freight (F.O.B. Destination): Contractor assumes full responsibility for all transportation
scheduling, packaging, handling, insurance, and other services associated with delivery of all products
deemed necessary under this Contract.
X. Pricing: The Contract bid price shall include full compensation for providing all required goods, in
accordance with required specifications or services, as specified herein or when applicable, in the scope

of services attached to this Contract, and no additional compensation will be allowed therefore, unless
otherwise provided for in this Contract.
Y. Waiver of JUry Trail: Each party acknowledges that it is aware of and has had the advice of counsel
of its choice with respect to its rights to trial by jury, and each party, for itself and its successors and
assigns, does hereby expressly and knowingly waive and release all such rights to trail by jury in any
action, proceeding or counterclaim brought by any party hereto against the other (and/or against its
officers, directors, employees, agents, or subsidiary or affiliated entities) on or with regard to any matters
whatsoever arising out of or in any way connected with this agreement and/or any claim of injury or
damage.
Z. Terms and Conditions: Contractor acknowledges that it has read and agrees to all terms and
conditions included in this Contract.
AA. Headings: The various headings and numbers herein, the grouping of provisions of this Contract
into separate clauses and paragraphs, and the organization hereof are for the purpose of convenience only
and shall not limit or otherwise affect the meaning hereof.
BE. Severability: If any term, covenant, condition or provision of this Contract is held by a court of
competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions hereof shall
remain in full force and effect and shall in no way be affected, impaired or invalidated thereby.
Cc. Calendar Days: Any reference to the word "day" or "days" herein mean calendar day or
calendar days, respectively, unless otherwise expressly provided.
DD. Attorney Fees: In any action or proceeding to enforce or interpret any provisions of this Contract,
or where any provisions hereof is validly asserted as a defense, each party shall bear its own attorney's
fees, costs and expenses.
EE. Interpretation: This Contract has been negotiated at arm's length and between persons
sophisticated and knowledgeable in the matters dealt with in this Contract. In addition, each party has
been represented by experienced and knowledgeable independent legal counsel of their own choosing or
has knowingly declined to seek such counsel despite being encouraged and given the opportunity to do
so. Each party further acknowledges that they have not been influenced to any extent whatsoever in
executing this Contract by any other party hereto or by any person representing them, or both.
Accordingly, any rule or law (including California Civil Code Section 1654) or legal decision that would
require interpretation of any ambiguities in this Contract against the party that has drafted it is not
applicable and is waived. The provisions ofthis Contract shall be interpreted in a reasonable manner to
effect the purpose of the parties and this Contract.
FF. Authority: The parties to this Contract represent and warrant that this Contract has been duly
authorized and executed and constitutes the legally binding obligation of their respective organization or
entity, enforceable in accordance with its terms.
II. ADDITIONAL TERMS AND CONDITIONS
1. Usage: No guarantee is given as to usage. Figures shown are approximate based upon last usage.
Contractor agrees to supply services andlor commodities requested, as needed by the County, at
prices listed in the purchase document regardless of quantity used.

2. CAL-OSHA Vehicle. Regulation: All vehicles must meet California Motor Vehicle and Cal-
OSHA regulations and all other applicable codes required for vehicle use on the roads or highways
in the state of California.
3. Responsibility of the Contractor: Contractor shall be responsible for the professional quality,
technical assurance, timely completion and coordination of all documentation and other
commodities/services furnished by the contractor under this contract. Contractor shall perform
such professional services as may be necessary to accomplish the work required to be performed
under and in accordance with this contract.
Contractor warrants that all persons employed have satisfactory past records indicating their ability
to accept the kind of responsibility anticipated in this type of work. All employees shall be required
to wear uniforms, badges or other means of identification which are to be furnished by the
Contractor and must be worn at all times while working on County Property.
4. Subcontracting: In the event the contractor is authorized to subcontract, this contract shall prevail.
In the manner in which the County expects to receive services, the County shall look to contractor
for performance and not deal directly with any sub-tier. All matters shall be funneled through the
contractor, and all work must meet the approval of the County of Orange.
5. Contractor Default: If contractor is in default of any of its obligations hereunder aud contractor
has not commenced cure within ten days and cured such default within 15 days after receipt of
written notice of default from County, County shall immediately be entitled, or otherwise under law
to either commence resolution in accordance with this paragraph or to terminate this contract by
giving notice to take effect immediately and begin negotiation with a third party vendor to provide
services.
If contractor should be adjudged bankrupt or should have a general assignment for the benefit of its
creditors, or if receiver should be appointed on account ofthe contractor's insolvency, the County
may also terminate this contract.
Contractor shall not be or deemed to be in default hereunder for non-negligent delay or failure to
perform under this contract or for any interruption in providing services resulting, directly or
indirectly, from any cause not within contractor's control.
The right of either party to terminate this contract hereunder shall not be affected in any way by its
waiver of or failure to make action with respect to any previous default.
6. Orderly Termination: After receipt ofa Notice of Default, the contractor shall submit to the
County a termination claim, if applicable. Such claim shall be submitted promptly but in no event
later than 14 days from the effective date oftermination, unless one or more extensions in writing
are granted by the County upon written request of the contractor. Upon termination, County agrees
to pay contractor for all services performed prior to termination which meet the requirements of the
contract, provided, however, that such compensation shall not exceed the total compensation set
forth in the contract. Upon termination or other expiration of this contract, each party shall
promptly return to the other all papers, materials, and other properties of the other held by each for
purposes of execution of the contract. In addition, each party will assist the other party in orderly
termination of this contract and the transfer of all aspects, tangible and intangible, as may be
necessary for the orderly, non-disruptive business continuation of each party.
7. California Sales Tax To Out-Of-State Contractors: Out-of-state Contractors shall indicate
California Board of Equalization permit number and sales permit number on invoices, if California
sales tax is added and collectable. If no permit numbers are shown, sales tax will be deducted from

payment. The Auditor-Controller will then pay use tax directly to the sate of California in lieu of
payment of sales tax to the Contractor.
8. Contingency of Funds: Contractor acknowledges that funding or portions of funding for this
Contract may also be contingent upon the receipt offunds from, and/or appropriation of funds by,
the State of California to County. If such funding and/or appropriations are not forthcoming, or are
otherwise limited, County may immediately terminate or modify this Contract without penalty.
9. All changes in specifications and/or Purchase OrderlPrice Agreement requirements will be issued
in writing. The County of Orange is not responsible for any oral instruction.
10. Audit: Contractor agrees to the Contractor's financial records, including payroll and accounts
receivable records, to be audited by Auditor from the County of Orange, or a private auditing firm
hired by the County of Orange. The County of Orange will provide reasonable notice of such audit.
I I. Contlict oCInterest (County Personnel): The Orange County Board of Supervisors policy
prohibits its public employees from engaging in activities involving conflict of interest. The
Contractor shall not during the period of this Purchase Order employ any County employee for any
purpose.
12. Invoice Submittal: Contractor will submit invoice(s) to the RDM/Accounts Pavable. PO BOX
4048. Santa Ana CA 92703-4048. Each invoice will have a number and will include the following
information:

13. Acceptance: Payments made by the County shall not preclude the right of the County to thereafter
dispute any services involved or billed under this agreement and shall not be construed as
acceptance of any part of the services.
14. Payment: Payment will be net thirty days after receipt of an invoice in a format acceptable to the
County. Responsibility for providing an acceptable invoice rests with the contractor. Invoices are

III. EDD INDEPENDENT CONTRACTOR REpORTING REQUIREMENTS
Effective January 1,2001, the County of Orange is required to file federal Form 1099-Misc for services received
from a "service provider" to whom the County pays $600 or more or with whom the County enters into a contract
for $600 or more within a single calendar year. The purpose of this reporting requirement is to increase child
support collection by helping to locate parents who are delinquent in their child support obligations.
The term "service provider" is defined in California Unemployment Insurance Code Section 1088.8, subparagraph
B.2 as "an individual who is not an employee of the service recipient for California purposes and who received
compensation or executes a contract for services performed for that service recipient within or without the state."
The term is further defmed by the California Employment Development Department to refer specifically to

Chief Jordan,
I have had the opportunity to drive the new Dodge Charger and Magnum both on a closed course and on
the street.
I was invited to drive both cars at the California Speedway in Ontario at a Chrysler sponsored "Ride and
Drive" Demonstration. The event was divided into four courses to demonstrate acceleration, braking, the
traction control system and the final course involved a mock pursuit.
The acceleration course was a simple y., mile stretch to demonstrate the superior acceleration of the
Charger vs. the Ford Crown Victoria. The Charger's acceleration far out performed the Crown Victoria.
The Electronic Traction Control system kept the drive wheels from spinning allowing the car to
accelerate in a straight line without any control input from the driver. This is an important safety feature
as it does not allow the loss of traction at the rear wheels under acceleration on slippery surfaces or
under hard acceleration while going around a comer.
The braking course demonstrated the ability of the Charger to repeatedly stop from elevated speeds
without loss or fading of the braking system due to heat build up. It also demonstrated the 4 wheel ABS
braking system, which keeps the wheels from locking up under hard braking or braking on slippery
surfaces. ABS allows the driver to brake with full force while still maintaining control over steering so
as to be able to brake and steer to avoid an object.
The traction control course demonstrated Dodge's Electronic Stability Program (ESP). ESP combines
ABS with several electronic sensors and the engine management system to keep the car on the driver's
intended course. When the system senses steering input from the driver that does not relate to what the
cars actual course is, it will apply individual brakes, and reduce throttle input to return the car to its
intended course.
The traction control course consisted of several switch back turns, a sweeping 180 turn and two abrupt
lane changes. In the middle ofthe sweeping turn there was a large patch of sand. Each driver went
through the course twice. Once with the ESP system on and once with it off. This is to demonstrate the
effectiveness ofthe ESP.

On the first pass with the system off, the Charger behaves much like a regular car, although it's superior
4 wheel independent suspension, large tires and brakes give it much better control than a Crown
Victoria. The car will over steer if pushed beyond the limits oftraction. Through the sweeping turn with
the sand, the car did as expected, and slid the rear end out, immediately needing steering input from the
driver to keep from spinning out and loosing control.
On the second pass with the ESP on, the car had no tendencies to over steer or break traction. Even
through the sweeping turn, in the sand with the accelerator peddle floored, the car had no tendency to
loose traction, slide out or go in any direction other than where the steering wheel pointed it.
The last course was a mock pursuit where we chased a professional driver through a city like course
with intersections and long straight-aways. This was to demonstrate how all of the systems worked
together and the overall handling characteristics of the car.
These are only some ofthe safety features incorporated in to the Charger and Magnum. Others include,
Emergency Brake Assist, Multi stage airbags, and constant force seatbelts with pretensioners.
Emergency Brake Assist senses when an emergency braking event occurs and applies full braking force.
This helps to avoid the natural tendency of a driver braking hard when danger is perceived then slightly
letting off of the brakes before the threat has been avoided, sometimes lengthening the overall stopping
distance.
Multi Stage airbags use multiple sensors to deploy airbags with the appropriate force depending on
several factors including speed and force of impact.
Other standard features that separate the Dodges from the Ford are;
. 100 amp power feed in the trunk for electronic equipment.
. 160 amp high output alternator.
. A built in wiring grommet in the firewall to ease wiring the car with police related equipment.
. Police interface module that ties pertinent electronic systems into installed police equipment.
. Built in "Wig-Wag" headlights.
. Heavy duty wiring for police equipment.
I have had the Charger Demo car here at TPD twice to give personnel a first hand experience with the
car. All feedback was positive except two comments that they would prefer better visibility to the right
rear, but that it was comparable to the Crown Victoria. Otherwise everyone praised the increased
headroom and legroom, overall appearance of the car and of course the way it drives.
I hope to have another fully equipped black and white demo car in the next few weeks to expose more
personnel and elicit more feedback.

2006 Dodge Charger Police Vehic1e Conversion Bids and Recommendation
I prepared, and sent out a request for bid to several local companies who do police
vehicle conversions. The companies whom the request went to included; 911 Vehicle,
Orange County Communications, CDCE Inc., Woodcrest Vehicles and Northstar
Electronics.
The bids returned were as follows, each quoted per vehicle;

Recommendation:
It is my recommendation that we award the bid to Woodcrest Vehicles. Although they are
not the lowest bidder, they are the only company who has performed a police vehicle
conversion with the new Dodge Charger and thus have experience in the new electrical
systems in the new cars. I visited the shop and was impressed with the organization,
cleanliness and examples of their work. The owner appeared very knowledgeable and
eager to highlight the quality of their work product.
In my communications with the remaining companies, none had yet worked on a Charger
nor done the research to familiarize themselves with the new wiring and possible changes
in the old way of doing an installation in the car.
Although Northstar Electronics was significantly less expensive than the next lowest bid,
their work product has declined in the last year. We have used Northstar for the last two
years to perform our conversions. During the last round of conversions I have
experienced missed deadlines for work completion and substandard work product. This is
possibly due to growing pains of the new company taking on more work than they have
the capacity to complete. They have done good work in the past with good results, but at
this time I do not feel they have the capacity to take on 9 new builds on cars they have
not familiarized themselves with or had prior experience with.

2006 MODEL YEAR VEHICLE
TEST
On October 12 & 13,2005, vehicle testing was performed at the Los Angeles County Sheriffs
Department's Emergency Vehicle Operation Center in Pomona, California. Daimler Chrysler,
General Motors, and Ford all submitted vehicles in the "Police Package" category. Police
Package vehicles have been identified by the manufacturers as pursuit vehicles. Ford also
submitted a vehicle in the "Special Service" category. Special Service vehicles are not rated as
. pursuit vehicles. All of the vehicles submitted, either as a police pursuit vehicle, or as a special
service vehicle, completed the test satisfactorily, without incident.
Additionally, the Pirelli "Winter 240 Sotto Zero" P235/55R17 snow tire was evaluated. The tire
was mounted on a 2006 Crown Victoria Police Interceptor with the 3.27 differential. This tire
completed the test satisfactorily, without incident.
The vehicles submitted for evaluation were all 2006 model years, and are identified below.

PRELIMINARY HANDLING AND TEST DRIVER'S
SUBJECTIVE EVALUATION
This test is conducted on a high speed driving course. It is designed to evaluate, identify and
eliminate the obvious unacceptable vehicles (i.e., those vehicles that are demonstrably unstable
or otherwise exhibit unsafe characteristics).
For this test, four drivers are utilized for each vehicle. Each driver completes eight laps around
our 1.57 mile test track at the Los Angeles County Fairplex in Pomona, for a total of 32 timed
laps. Lap timing is via a "HOT LAP," digital-infrared timing device, mounted in the vehicle.
The fastest and the slowest lap times are eliminated, the remaining 6 lap times are averaged. The
average time and speed are recorded next to the drivers name.
Four Emergency Vehicle Operations Center driver training instructors, two each from the Los
Angeles County Sheriffs Department and Los Angeles Police Department share the driving and
evaluation of these vehicles.
At the conclusion of the preliminary handling portion ofthe test, each driver completes a
"Drivers Subjective Evaluation" form. If the test vehicle is judged unacceptable in this
preliminary review, it is rejected and not subject to further testing and evaluation.
ACCELERATION PERFORMANCE TEST
This test is designed to measure vehicle performance in terms of acceleration, including speed
and time elapsed at the quarter mile. Although, the top speed is not recorded, a minimum of 100
MPH is generally obtained to satisfy the requirements for high speed law enforcement patrol.
All of the information gathered during the acceleration and subsequent brake test is gathered
using a "DATRON SPEED SENSOR." This electronic device measures distance, time and
speed. The Datron Speed Sensor is lap top computer driven and is the same type used by most
major automobile manufacturers in conducting their vehicle evaluations

BRAKE TEST
This test procedure measures the braking response and efficiency of the vehicle.
The test is conducted immediately following the preliminary handling test (32 laps). This
ensures that the brakes are tested after being driven at high speeds, thus simulating the actual
operating conditions experienced by the officer in the field.
The test is conducted by first accelerating the vehicle to 80 MPH, then decelerating to a stop,
maintaining an average deceleration rate of 22 feet per second. This procedure is repeated three
additional times. At this point, a five minute stationary cool down period occurs. The vehicle is
then accelerated to a speed of 60 MPH and decelerated at the maximum deceleration rate
attainable before the onset of ABS. After a two minute delay, the 60 MPH procedure is repeated
again. As soon as the vehicle has stopped, it is immediately accelerated to 60 MPH and then
stopped as quickly as possible, simulating a panic stop. That stopping distance is measured and
recorded. If a brake malfunction is experienced (i.e., severe fading or inability to stop in a
straight line,) an effort is made to detect the cause of the brake failure. If it is decided that the
failure is inherent in the engineering of the brake system of the vehicle, the test is discontinued
and the vehicle is disqualified from further testing. If the failure is associated with a correctable
situation, it is corrected and the test is rerun. The defect and any remedial action taken are noted
in the test results.
PURSUIT COURSE
This test is for those vehicles equipped with a factory installed "POLICE PACKAGE" and
identified by the manufacturer as pursuit vehicles. This test is conducted on a closed 2.45 mile
city street course which closely represents the environment most urban law enforcement
emergency response vehicles must contend with. The course has virtually no straight-a-ways and
consists of right and left hand turns and obstacles in the road way.
This is the final test during our "road" certification and the manufacturer's, if they so choose, are
allowed to rebuild the vehicle's brake system prior to this test.
For this test, two drivers are utilized for each vehicle. Each driver completes two laps around
the city or "pursuit" course. Lap timing is via a "HOT LAP," digital-infrared timing device,
mounted in the car. The combined times of the two laps are recorded next to the driver's name.
If the test vehicle is unable to complete the course in under 4 minutes and 45 seconds, it is judged
unacceptable for high speed law enforcement use.

HEAT TEST
Today's modem exhaust emission and computer monitored automobile is designed to operate at
much higher temperatures than vehicles from the 1970's and 1980's. Scientific breakthroughs in
metallurgy and lubrication compositions allow the modem engine to operate at temperatures
formerly thought to be detrimental. A vehicle from the 1970 era usually exceeded 180 degrees'
water temperature under normal driving conditions and generally overheated at 212 degrees.
Today, modem engines operate safely between 200 to 260 degrees. Our heat testing is a "P ASS-
FAIL" scenario and is based on manufacturers allowable operating temperatures.
Heat from each engine component is measured by means of a digital thermometer.
A bi-metallic probe from the thermometer is inserted into the component fluids at the conclusion
of the 32 high speed laps. This process is accomplished iIi'the following manner:
I. Transmission Fluid
The probe is inserted into the transmission via the dip stick
hole, or in the case of the Dodge Hemi engines, the
measurement is taken from the vehicle's sensors via the ALDL
connector.
The probe is inserted into the oil pan via the dip stick hole.
The probe is inserted into the pump reservoir fluid.
Due to newer vehicles having closed coolant systems, the coolant
temperatures are taken from the vehicle's sensors through the
ALDL connector.
Temperature is measured away from the vehicle and in direct
sunlight.

TIRE TEST
Each of our structured high speed test procedures are performed with factory equipped speed
rated tires. We recognize the need for an alternative tire for standard patrol duty and for special
conditions caused by terrain and weather. During our tire test phase we evaluate the
construction, design, road handling abilities, wear patterns and durability of tires submitted for
testing by the vehicle manufacturers.
For a tire to be certified for high speed law enforcement use it must successfully perform through
32 laps of high speed driving on our 1.57 mile road course, a non-recorded Brake Test and finally
2 laps through our high speed Pursuit Course.

FUEL EFFICIENCY TEST
While EP A mileage estimates may be helpful for comparative purposes, they are based on
simulated driving conditions. The fuel efficiency evaluation is an attempt to estimate MPG
(miles per gallon) based on actual driving conditions.
Each vehicle is driven through a 100 mile loop twice, each time by a different driver. The loop is
divided equally into urban, suburban, and freeway driving conditions. The vehicle' is operated
with the air conditioner and headlights "turned on" and with the transmission selector in the
"overdrive" position. No attempt is made to "baby" the vehicle through the loop, but hard
acceleration starts are avoided.
The test results are averaged between the two drivers and recorded.
ERGONOMICS EV ALVA TION
This subjective evaluation is a rating of human factors and space utilization done individually
and independently by several Deputy Sheriffs from this Department. The ratings are averaged to
minimize personal prejudices that individuals may have for, or against any given vehicle. This
evaluation rates each vehicle comparatively for its general suitability and efficiency for patrol
operations or other specific functions in a Department's operations.
MECHANICAL EV ALVA TION
The mechanical evaluation (performed by mechanics employed by the Sheriffs Department's
fleet maintenance contractor) evaluates the day to day serviceability and maintenance of the
vehicle.
Major consideration is given toward the accessibility and ease of repair of component parts for
the purpose of obtaining a predictive evaluation of the time, ease, and cost of major repairs. The
specific factors considered in evaluating each component are enumerated on the Mechanical
Evaluation form.

COMMUNICATIONS EVALUATION
The communications evaluation of each vehicle is conducted by technicians assigned to the Los
Angeles County Sheriffs Department's Communications and Fleet Management Bureau. This
evaluation concerns itself with the radio installation, the effect ofradio operation on vehicle
performance and the effect of the vehicle on radio performance.
The Electromagnetic Interference Susceptibility test is intended for use in the presence of
electromagnetic fields resulting from use of public safety two way radios.
Vehicle performance must not be affected in any way by transmissions from a radio and antenna
installed in the vehicle and operating in any of the frequency ranges of 30 to 50 MHz, 450 to 512
MHz, and 800 to 900 MHz, and having a radio frequency output no less than 100 watts. Vehicle
performance shall not be effected by the presence of another vehicle equipped with the above
described radio and operated next to the subject vehicle.
Radiated and conducted electromagnetic interference vehicle systems and accessories shall be
designed to reduce interference with the use of public safety radio receivers or electronic sirens
or sound amplifiers. The effective sensitivity of a receiver installed in the vehicle shall not be
reduced by more than the amount tabulated below for each frequency band:

Degradation is the difference in effective receiver sensitivity measured with the vehicle engine
and accessories turned off as compared to that measured with the engine and accessories turned
on.
Sensitivity is measured in terms of the 12 db Sinad signal as defined in EIA Standard RS-204.
To determine effective sensitivity, the receiver is connected to the antenna through an isolating
tee connector which allows introduction of the signal generator through the isolated port.
Comparative signal strength readings are then taken with and without the interference present.

32 LAP HIGH SPEED VEHICLE
EVALUATION RESULTS
POLICE PACKAGE VEHICLES
This test is conducted on a high speed driving course. It is designed to evaluate, identify and
eliminate the obvious unacceptable vehicles (i.e., those vehicles that are demonstrably unstable
or otherwise exhibit unsafe characteristics).
For this test, four drivers are utilized for each vehicle. Each driver completes eight laps around
our 1.57 mile test track at the Los Angeles County Fairplex in Pomona, for a total of 32 timed
laps. Lap timing is via a "HOT LAP," digital-infrared timing device, mounted in the vehicle.
The fastest and the slowest lap times are eliminated, the remaining 6 lap times are averaged. The
average time and speed are recorded next to the drivers name.
Four Emergency Vehicle Operations Center driver training instructors, two each from the Los
Angeles County Sheriff s Department and Los Angeles Police Department share the driving and
evaluation of these vehicles.
At the conclusion of the preliminary handling portion of the test, each driver completes a
"Drivers Subjective Evaluation" form. If the test vehicle is judged unacceptable in this
preliminary review, it is rejected and not subject to further testing and evaluation.

GOEDHART - LAPS 1 TO 4:
Handling: This vehicle displayed slight understeer characteristics through the 180'
turn. It was very predictable and very manageable.
Transmission: There was a lag corning out of all turns. Almost as if it needed to
downshift and get a lower gear. Shifting points at the top end were good.
Brakes: Very good rate of deceleration throughout all turns and throughout all
eight (8) laps.
HEMSWORTH - LAPS 9 TO 16:
Handling: Moderate understeer bias. Would not trail brake oversteer into turns. Less
understeer would decrease lap times.
Outstanding! Short stopping distances. No evidence of fade. Excellent
feel on both application and release makes them super easy to modulate.
Fine, minimal bounce.
On longest straightaway approaching decreasing radius turn, would
upshift, hit 4300-4400 rpm and just stay there with little perceptible
acceleration. Did not feel as noticeable on long front straight.

ROBINSON - LAPS 17 TO 24:
Handling: This vehicle displayed minimal to moderate understeer handling
characteristics. The body lean and bounce were minimal. The steering
feel was very good.
Outstanding. The rate of deceleration is great. There was no fade or pull.
The engine made good power throughout all eight laps.
The transmission had good smooth, consistent shifts.

PENRlTH - LAPS 25 TO 32:
Transmission: Consistent shifts at 6,000 rpm plus - would like firmer/faster shifts.
Tires: Excellent, predictable traction loss and recovery.
Handling: Would like to see slightly less understeer. Body roll minimal, even quick
transitions with lateral shifts did not cause oversteer.
Brakes: No brake fade, great feel both into and out of pedal. I could brake 3 to 4
car lengths later than both Ford and Chevy from the same or higher top
speed. These brakes set a new standard for police vehicles.

GOEDHART - LAPS 1 TO 8:
Handling: This vehicle displayed slight oversteer characteristics but was very
predictable and easy to manage. I experienced a slight drift through the
. S' turn with a little oversteer. Very good handling vehicle.
Transmission: Very good shifting points with very stable acceleration throughout all
turns.
Brakes: Very good rate of deceleration throughout all laps. On lap #3 on the South
turn, I experienced a step down senslltion and a premature "ABS" feel.
That lessened the rate of deceleration by about 30%, causing me to exit the
course. I adjusted my braldng point by two (2) car lengths and it never
happened again, and had good rate of deceleration.
HEMSWORTH - LAPS 9 TO 16:
Brakes: Excellent. Just a slight loss of initial "bite" as laps progressed but no
noticeable drop off in power. Minor wheel chatter over bumps entering
decreasing radius. No control problem, just observation.
Handling: Mild understeer easily translated to oversteer with throttle application.
Very neutral in high speed 180" turn.
Power: Excellent power throughout the range. Easily modulated throttle, maldng
transitions to throttle involved oversteer simple.
ROBINSON - LAPS 17 TO 24:
Handling: I experienced moderate understeer to power induced oversteer. Steering
feel and input were good. There was minimal bounce or body lean.
I noticed some brake fade on laps #20-22. On laps #23&24 I was able to
re-adjust back to my original braldng points. The rate of deceleration was
very good throughout.
The engine made very good power throughout all eight laps.
The transmission shifted smoothly. The shift points were good.

PURSUIT COURSE EVALUATION

POLICE PACKAGE VEHICLES
This test is for those vehicles equipped with a factory installed "POLICE PACKAGE" and
identified by the manufacturer as pursuit vehicles. This test is conducted on a closed 2.45 mile
city street course which closely represents the environment most urban law enforcement
emergency response vehicles must contend with. The course has virtually no straight-a-ways and
consists of right and left hand turns and obstacles in the road way.
This is the final test during our "road" certification and the manufacturer's, if they so choose, are
allowed to rebuild the vehicle's brake system priorto this test.
For this test, two drivers are utilized for each vehicle. Each driver completes two laps around
the city or "pursuit" course. Lap timing is via a "HOT LAP," digital-infrared timing device,
mounted in the car. The combined times of the two laps are recorded next to the driver's name.
If the test vehicle is unable to complete the course in under 4 minutes and 45 seconds, it is judged
unacceptable for high speed law enforcement use.

This vehicle displayed slight to moderate understeer characteristics but
was predictable and manageable. Very good handling vehicle.
There was a lag coming out of all turns. It needs a lower gear or a better
downshift. Upper gear is good.
Great rate of deceleration throughout all turns.
This car displayed moderate understeer characteristics. The quick steering
ratio and amount of understeer make it difficult to be precise with input.
Leave the steering ratio the same and take out some of the understeer.
The brakes were very good with very good deceleration. There was no
fade.
The engine made good power throughout both laps.
The transmission shifted well throughout both labs.

BRAKE TEST RESULTS
POLICE PACKAGE VEHICLES
This test procedure measures the braking response and efficiency of the vehicle.
The test is conducted immediately following the preliminary handling test (32 laps). This
ensures that the brakes are tested after being driven at high speeds, thus simulating the actual
operating conditions experienced by the officer in the field.
The test is conducted by first accelerating the vehicle to 80 MPH, then decelerating to a stop,
maintaining an average deceleration rate of 22 feet per second. This procedure is repeated three
additional times. At this point, a five minute stationary cool down period occurs. The vehicle is
then accelerated to a speed of 60 MPH and decelerated at the maximum deceleration rate
attainable before the onset of ABS. After a two minute delay, the 60 MPH procedure is repeated
again. As soon as the vehicle has stopped, it is immediately accelerated to 60 MPH and then
stopped as quickly as possible, simulating a panic stop. That stopping distance is measured and
recorded. Ifa brake malfunction is experienced (i.e., severe fading or inability to stop in a
straight line,) an effort is made to detect the cause of the brake failure. If it is decided that the
failure is inherent in the engineering of the brake system of the vehicle, the test is discontinued
and the vehicle is disqualified from further testing. If the failure is associated with a correctable
situation, it is corrected and the test is rerun. The defect and any remedial action taken are noted
in the test results.

POLICE PACKAGE VEHICLES
This test is designed to measure vehicle performance in terms of acceleration, including speed
and time elapsed at the quarter mile. Although the top speed is not recorded, a minimum of 100
MPH is generally obtained to satisty the requirements for high speed law enforcement patrol.
All of the information gathered during the acceleration and subsequent brake test is gathered
using a "DA TRON SPEED SENSOR." This electronic device measures distance, time and
speed. The Datron Speed Sensor is lap top computer driven and is the same type used by most
major automobile manufacturers in conducting their vehicle evaluations.

results of the test are compared against the manufacturers recommended maximum
temperatures for the pass/fail rating. Outside air temperature is measured away from the
vehicle and in direct sunlight. All temperatures are recorded in Fahrenheit This process is
accomplished in the following manner:

While EP A mileage estimates may be helpful for comparative purposes, they are based on
simulated driving conditions. The fuel efficiency evaluation is an attempt to estimate MPG
(miles per gallon) based on actual driving conditions.
Each vehicle is driven through a 100 mile loop twice, each time by a different driver. The loop is
divided equally into urban, suburban, and freeway driving conditions. The vehicle is operated
with the air conditioner and headlights "turned on" and with the transmission selector in the
"overdrive" position. No attempt is made to "baby" the vehicle through the loop, but hard
acceleration starts are avoided.
The test results are averaged between the two drivers and recorded.

RESULTS
POLICE PACKAGE VEHICLES
The communications evaluation of each vehicle is conducted by technicians assigned to the Los
Angeles County Sheriffs Department's Communications and Fleet Management Bureau. This
evaluation concerns itself with the radio installation, the effect of radio operation on vehicle
performance and the effect of the vehicle on radio performance.
The Electromagnetic Interference Susceptibility test is intended for use in the presence of
electromagnetic fields resulting from use of public safety two way radios.
Vehicle performance must not be affected in any way by transmissions from a radio and antenna
installed in the vehicle and operating in any of the frequency ranges of30 to 50 MHz, 450 to 512
MHz, and 800 to 900 MHz, and having a radio frequency output no less than 100 watts. Vehicle
performance shall not be effected by the presence of another vehicle equipped with the above
described radio and operated next to the subject vehicle.
Radiated and conducted electromagnetic interference vehicle systems and accessories shall be
designed to reduce interference with the use of public safety radio receivers or electronic sirens
or sound amplifiers. The effective sensitivity of a receiver installed in the vehicle shall not be
reduced by more than the amount tabulated below for each frequency band:

Degradation is the difference in effective receiver sensitivity measured with the vehicle engine
and accessories turned off as compared to that measured with the engine and accessories turned
on.
Sensitivity is measured in terms of the 12 db Sinad signal as defined in EIA Standard RS-204.
To determine effective sensitivity, the receiver is connected to the antenna through an isolating
tee connector which allows introduction of the signal generator through the isolated port.
Comparative signal strength readings are then taken with and without the interference present.
