SUBJECT: SURPLUS FIREARMS INVENTORY REDUCTION
SUMMARY
The Police Department has completed the replacement of the 1990/1991 era Beretta
semi-auto handguns. The retention of these older weapons is not warranted based
upon needs of the agency and facility storage capabilities. The current inventory
includes 97 of the 1990/1991 era Beretta handguns. Of these, eight are being retained
for department use and training. The other 89 are considered surplus and can be sold
to reduce inventory and recover funds for the City at the current market value. Qualified
sworn personnel have expressed a desire to purchase some of the current surplus
weapons, and the vendor from whom we purchased the new handguns this year has
stated it will purchase the remaining surplus guns.
RECOMMENDATION
Authorize the sale and transfer of ownership of 26 surplus handguns previously issued
as duty weapons to qualified sworn personnel per Department of Justice guidelines with
proceeds deposited into the General Fund. Authorize the sale of 63 surplus Beretta
handguns to Proforce Distributors of Brea with proceeds deposited into the General
Fund.
FISCAL IMPACT
Estimated revenue from sale of firearms - $17,800.00
BACKGROUND
The Police Department replaced the duty issued 9mm Beretta semi-auto handguns
earlier this year with a combination of Glock and Beretta 9mm, .40 cal, and .45 cal semi-
automatic handguns. The older Beretta's were originally issued in 1990 and 1991 as
the duty handgun for sworn personnel of the department and have exceeded their
intended duty life. With their replacement, the older weapons are now considered

surplus, and storage space and needs of the agency do not accommodate, or justify,
the retention of the older firearms.
The Police Department intends to retain eight of the best condition Berettas for training
use and dispose of the remaining 89 guns. The current market value, based on
condition and age, quoted from two sources (our range facility personnel and Proforce
Distributors), is $200 per gun.
To date, 26 sworn personnel have expressed an interest in purchasing one of the
surplus guns for their own retention and use; and Proforce Distributors, the firearms
vendor, has committed to purchasing the remaining surplus guns.
Following the 1990 - 1991 transition from revolvers to semi-automatic handguns, and
again in 2004 during a firearms inventory reduction, the City Council authorized the sale
of surplus handguns to qualified sworn personnel. The transfer of ownership and
registration is conducted through a licensed firearms dealer, per Department of Justice
guidelines, with transfer fees paid by the officers. In addition to the DOJ transfer
paperwork, a bill of sale between the City of Tustin and the officers include a stipulation
that the sale or transfer of ownership to a third party cannot occur. Should the officer no
longer desire ownership of the weapon, it shall be turned in to a local law enforcement
agency for destruction. The weapons have been checked by a departmental armorer,
but are sold as is. (A sample bill of sale is attached.)
The reduction of inventory of surplus firearms of the Police Department will free up
storage space in our Property and Evidence Section, as well as the Armory area. It will
also result in a partial return on our investment with funds (approximately $17,800)
resulting from the sale of the surplus firearms being returned to the General Fund.
