WORKS DEPARTMENTS
The following report provides a summary of projects and activities from the Community
Development and Public Works Departments to the Tustin City Council. The report
focuses on the status of projects that the Planning Commission, City Council, Zoning
Administrator, or staff approved; historic preservation projects; Code Enforcement
activities; major construction and improvement projects; and, other items of interest.

CORRELATION TO THE STRATEGIC PLAN:
This summary of projects report contributes to Goal E of the Strategic Plan in
Organizational Excellence and Customer Service. It is staff's desire to keep the
community informed on the status of recent projects, which are progressing throughout
the City. Sharing this report to the Planning Commission, City Council, and through the
City's website, contributes toward both organizational excellence and customer service.
DISCUSSION:
The following are updates from the Community Development and Public Works
Departments, related to planning and building projects throughout Tustin; historic
preservation activities; Code Enforcement, and public improvement project updates.

Planning Division Updates:
Planning Commission & City Council Reviews
• Aldi at 1091 Old Irvine Blvd: On June 22, 2021, the Planning Commission approved
a request to establish joint -use parking and remodel a vacant commercial building into
a multi -tenant commercial building, including an Aldi grocery store. On April 12, 2022,
the Planning Commission approved the Master Sign Program for the shopping center.
Construction is in process and the store anticipates to open before the end of 2022.

• Zone Change for 1382 Bell Avenue: On August 3, 2021, the City Council adopted
Ordinance No. 1514, approving a change in the zoning designation of 1382 Bell
Avenue from Planned Community Industrial (PC -IND) to Planned Community
Industrial/Business (PC-IND/BUS). This follows the determination made by the
Planning Commission on April 13, 2021 that the lease of this site, for the Orange
County Sheriff -Coroner's Technology Division and Emergency Call Center, be
deemed in conformance with the General Plan. Permits have been issued for building
and site improvements and construction is ongoing.
• Housing Element Update: On September 14, 2021, the Planning Commission
recommended approval to the City Council of the 2021-2029 update to the City's
Housing Element. The City Council unanimously approved the Final Draft 2021-2029
Housing Element on October 5, 2021. Staff is currently working with the State
Department of Housing and Community Development (HCD) for certification of the
2021-2029 Housing Element.
• Alta -Dena Dairy Remodel: On November 9, 2021, the Planning Commission
approved a request to remodel the former Alta -Dena Dairy at 1062 Irvine Boulevard
into a retail coffee shop with a drive-thru lane. City staff has completed the first review
of the grading and building plans for this project, and has also completed the first
review of the Final Parcel Map, which will formally subdivide the property from an

adjacent parcel. The Final Parcel Map must be recorded with the County of Orange
prior to beginning construction. Construction is anticipated to begin in early 2023.
• Brass Monkey/Oculto: On March 8, 2022, the Planning Commission approved a
request to authorize the on-site sales and consumption of beer, wine, and distilled
spirits (Type 47 ABC license) and live entertainment for a new restaurant in an existing
tenant space at 14401 Newport Avenue.
• Medical Office Building: On May 24, 2022, the Planning Commission approved a
new development plan for the Planned Community — Commercial property at 17631
Seventeenth Street to construct a new 11,323 square -foot, two-story medical office
building. The project includes the demolition of the existing restaurant building (Tang's
Asian Buffet). Plans are anticipated to be submitted for building plan check in the
coming months.

Zoning Administrator Reviews
• ABC License for 7 -Eleven: On November 4, 2021, the Zoning Administrator
approved a request to upgrade an ABC License to Type 21 (Off -sale General — beer,
wine and distilled spirits) for an existing convenience store at 610 W. First Street.
• Kairos University: On November 18, 2021, the Zoning Administrator approved a
request to establish a religious/educational use in an existing tenant space at 2681
Walnut Avenue. The applicant, Kairos University, is now operating.
• Chiropractor's Office: On November 18, 2021, the Zoning Administrator approved a
request for a new chiropractic office with accessory massage services to move into a
space within the existing S.A.G.E. Holistic Center at 14081 Yorba Street.

• Minor Adjustment for Residential Addition: On November 18, 2021, the Zoning
Administrator approved a request to decrease the number of required off-street
parking spaces by one (1) garage space in conjunction with the construction of an
addition to an existing single-family dwelling at 178 N. C Street.
• Adult Day Healthcare Facility: On January 20, 2022, the Zoning Administrator
approved a request to establish an adult day healthcare facility in an existing tenant
space located at 14511 Franklin Avenue, Suite 100. The new adult day healthcare
facility would serve up to 150 patrons. Construction plans for interior improvements
are under review by City staff.
• MRI Facility: On January 20, 2022, the Zoning Administrator approved a request to
permanently relocate and establish an MRI facility at the existing Foothill Regional
Medical Center located at 14662 Newport Avenue. Plans are under review by the
State Department of Health Care Access and Information (HCAI, formerly known as
OSHPD). Plans will be submitted to the City for final review and permit issuance once
HCAI has approved.
• Escape Room: On March 3, 2022, the Zoning Administrator approved a request to
authorize an escape room recreational business to locate within an existing tenant
space at 1622 Edinger Avenue, Suite C. Plans for interior tenant improvements are
under review by City staff.
• Beauty Academy: On May 12, 2022, the Zoning Administrator approved a request to
establish a new vocational beauty school/academy in an existing tenant space located
within the Jamestown Village shopping center at 540 EI Camino Real.
• ABC License for Eat Fantastic: On May 26, 2022, the Zoning Administrator
approved a request to authorize the on-site sales and consumption of beer and wine
(Type 41 ABC license) in conjunction with a restaurant establishment with a drive-thru
lane and outdoor dining area located at 171 E. First Street.
• ABC License for Rakkan Ramen: On May 26, 2022, the Zoning Administrator
approved a request to authorize the on-site sales and consumption of beer and wine
(Type 41 ABC license) in conjunction with a restaurant establishment located at 2427
Park Avenue, Suite S003H.
Historic Preservation Projects
• Historical Resources Survey Update: The City's Historic Resources Survey was
updated since its last update occurred in 2003. Staff and consultants have prepared
Department of Parks and Recreation (DPR) forms, which are primary records of each
identified historic resource and can be used by property owners to nominate their
properties to the California or National Register of Historic Places. Staff will use the
DPR forms to inform and guide the review of potential alterations of historic buildings.
On August 10, 2021, the Planning Commission adopted the 2021 Historic Resources

Survey Update Report with authorization for the Community Development Director to
make minor modifications to the final survey report. Staff presented the survey results
to the City Council on October 19, 2021 and the updated survey was posted on the
Community Development Department's website under Historic Preservation. Staff is
currently working with our GIS staff to create an interactive map that highlights photos
of the historic properties and is available for use by the public.
Historic Register Plaque Program: Owners of historic homes or commercial
buildings in Tustin are eligible to participate in the City's plaque designation program.
The purpose of the voluntary program is to recognize Tustin's historic properties,
educate the public, increase public interest in historic properties, and promote
community pride. Applications for this recognition have been submitted and are under
review for the properties at 450 W. Third Street and 225 S. A Street. Staff expects to
present research findings and recommendations to the Planning Commission in the
coming months.
Certificates of Appropriateness: A Certificate of Appropriateness is a no -fee permit
that applies to structures within the Cultural Resources District (CRD), or a designated
cultural resource outside of the District. A Certificate of Appropriateness is necessary
prior to, or concurrent with, a building permit for all permitted structures in the Cultural
Resources District. A Certificate of Appropriateness is required prior to: Alteration of
the exterior features of a building or site within a designated CRD, or alteration of a
Designated Cultural Resource, or construction of improvements within a designated
CRD requiring a City building permit; and demolition or removal of any Designated
Cultural Resource or of any improvements in a CRD. A Certificate of Appropriateness
is issued by the Community Development Director in conjunction with Design Review
or plan check. All four (4) of the certificates issued since the last summary report are
for residential properties and include work such as additions, remodels, and
equipment changeouts.

Projects Under Review
• Streamline Tustin Initiative: Community Development Department staff
continue to innovate and refine internal procedures to create a more efficient and
effective customer service experience. This includes digitizing plan submittal and
review processes, maintaining the Community Development Department website
with current information, launching the Engage Tustin mobile application to
increase communication between Tustin residents and city staff, and more.
• Outdoor Dining and Seating Zoning Code Amendment: Staff is preparing a
Zoning Code amendment to allow expanded opportunities for restaurants to
provide outdoor dining and seating areas throughout the City. This amendment is
the culmination of outreach efforts to understand resident, business owner, and
patron desires and experiences as they relate to outdoor dining in light of the on-
going COVID-19 pandemic. Staff expects to present this amendment to the
Planning Commission on July 12, 2022 and subsequently to the City Council.
• Senate Bill 9 (SB 9): Staff is preparing a Zoning Code amendment addressing
SB 9, a State housing bill effective January 1, 2022 that potentially increases
housing development opportunities within single-family zones. On May 24, 2022,
the Planning Commission provided a recommendation to adopt an SB Ordinance
consistent with State Law. Staff expects to present Planning Commission's
recommendation and details of this amendment to the City Council on July 19,
2022.
• Comprehensive Zoning Code Amendment: Staff is preparing a comprehensive
update to the Zoning Code that will improve its consistency and ease of use by
staff, residents, and development professionals. On May 24, 2022, the Planning
Commission provided a recommendation to the proposed amendments. Staff
expects to present Planning Commission's recommendation and details of the
proposed amendment to the City Council on July 19, 2022.
• Amendment to Downtown Commercial Core Specific Plan: Staff is initiating
an amendment to the Downtown Commercial Core Specific Plan (DCCSP) (SP -
12) to allow live/work residential units as an allowable residential use via the
Residential Allocation Reservation (RAR) process in the Development Area 6C
(DA -6C) of the DCCSP. Staff expects to present this amendment to the Planning
Commission on July 12, 2022 and to the City Council on August 2, 2022.
• Momentous Sports Joint -Use Parking: Applications were received to establish
a joint -use parking agreement using properties within the City of Tustin for the
benefit of the Momentous Sports Center located within the City of Irvine at 14522

Myford Road. The application submitted was incomplete and the applicant will be
resubmitting upon having all the requested information.
• Rally's Burgers: An application has been submitted, and is currently under
review, to construct a new Rally's Burgers restaurant with a drive-thru at the site
of the former Complete Auto Care located at 14982 Prospect Avenue. The project
resubmittal is contingent upon the applicant obtaining verification of a Phase I
environmental clearance.
• Toast Kitchen + Bakery

• Yorba Street Residential Development: An application was received to
construct a residential development at 14192 Yorba Street consisting of three (3)
detached units and two (2), four (4) -car detached garages. The property contains
an existing historic resource, which is proposed to be retained on-site. Staff
provided Design Review comments in January 2022 and the City is awaiting
resubmittal from the applicant.
• Taco Mesita: Plans are currently in the building plan check process to remodel
the existing drive-thru restaurant located at 765 EI Camino Real by enhancing the
outdoor seating area with new landscaping, lighting and a decorative perimeter
wall. The remodel is anticipated to commence within the coming months.

• New Residential Community (Intracorp): The applicant, Intracorp, filed a Zone
Change and General Plan Amendment to allow 40 residential single-family
detached and paired units on an approximate two (2) acre site. The plans include
the proposed demolition of the two (2) existing office buildings currently on the
site. The project is currently under review by City Staff. This project will require
various entitlements, including public hearings before the Planning Commission
and City Council.
City Ventures: City Ventures has filed a Residential Allocation Reservation
(RAR) request. The applicant is proposing 42 residential units, with eight (8) of
the units designed to include a ground floor space that could accommodate a
commercial use, on an approximate 1.9 -acre site, located at the southwest corner
of Newport Avenue and EI Camino Real (within the Downtown Commercial Core
Specific Plan (DCCSP) area). The application is currently under review by Staff.
In order to receive final approval, this project will require various entitlements,
including public hearings before the Planning Commission and City Council.

• Valencia Industrial Redevelopment: A request has been received, and is
currently under review by City Staff, to redevelop an existing industrial property at
1100 Valencia with two (2) new buildings totaling approximately 133,940 square
feet (Building 1) and 177,830 square feet (Building 2). The project is expected to
be submitted into Plan Check in the coming weeks.
• Myford Industrial Redevelopment: A request has been received to redevelop
two (2) existing industrial properties located at 14321 and 14351 Myford Road
with a 148,437 square foot industrial building on approximately 7.18 acres. The
request includes a Tentative Parcel Map (TPM) to combine the two (2) adjacent
lots. This project is currently under review by City staff.
• Acadia Healthcare: An application was submitted to establish an outpatient
addiction treatment and care center within an existing office building located at
535 E. First Street, Unit 200. The application is currently under review by City
staff.
• Saddleback at ATEP: An application was submitted by the South Orange County
Community College District (SOCCCD) for the limited site plan review of a new
one-story, 20,940 square foot building for culinary arts education and a new one-
story, 36,700 square foot building for automotive technology education. Plans are
currently being reviewed by staff.
• Pomeroy De -annexation: A request was received for the detachment of a 0.18 -
acre territory located adjacent to 2242 Foothill Boulevard from the City of Tustin
to the County of Orange. The majority of the property is located within
unincorporated "North Tustin," and the territory proposed for detachment is
located within the City's jurisdiction. The purpose of the request is to place the
entire property under a single jurisdiction for future development of the property
as a single-family residence. The request was approved by the City Council on
June 7, 2022.
• Exclusive Negotiating Agreement (ENA) for Legacy Village: The City Council
has authorized the City to enter into an Exclusive Negotiating Agreement with
AvalonBay Communities Inc. and Abode Communities to develop Legacy Village,
a 19.4 -acre mixed-use project featuring more than 1,200 apartments at Tustin
Legacy. Twenty-five percent (25%) of the apartments will be reserved for families
and individuals earning between 30% and 80% of the Area Median Income in
Orange County. The Economic Development Department is currently working
with the developers to secure this agreement.

• The Landing —A residential community by Brookfield Residential (Tustin Ranch
Road/Warner Avenue): Construction of the model homes is ongoing, and a portion

of the models (detached homes and townhomes) are now open to the public for tours.
The community is proposed to include 400 residential units, including open space,
park areas, and community amenities. The neighborhoods will be comprised of 117
detached homes, 129 triplex townhomes, and 154 stacked flats and townhomes.

Encompass Health Rehabilitation Hospital of Tustin (15120 Kensington Park
Drive): Construction of a new acute care facility within The Village at Tustin Legacy
Shopping Center is now complete and the hospital is open. The new medical facility
includes a 65,000 square foot hospital, with 65 private patient rooms, a therapy gym,
on-site pharmacy services, and various rehabilitation rooms.
The Hill - Tustin at 13751 and 13841 Red Hill Avenue: On August 17, 2021, the City
Council approved a request to construct a mixed-use project with 137 residential rental
units and 7,000 square feet of retail space, as well as on-site amenities such as open
air courtyards, a pool/spa, fitness center, co -working area, bike storage room, and
tenant storage areas on a 3.8 -acre site within the Red Hill Avenue Specific Plan
(RHASP) Area. Plans have been submitted to demolish the existing building at 13751
Red Hill Avenue and to prepare the overall site for future grading.

• Fast5Express Carwash (2762 EI Camino Real): The construction of the new
carwash including vacuum apparatuses and landscaping is currently underway and is
anticipated to be complete this Summer.
• Key Inn Remodel (1611 EI Camino Real): Plans for a full renovation and remodel of
the existing Key Inn Motel, along with rebranding the motel to "Eurolnn," are in the
building plan check process. The applicant has requested a time extension for the
Design Review approval in order to allow them time to progress through the plan check
process.
• Costco Gas at Tustin Ranch (2655 EI Camino Real): Construction of the new
Costco Gas Station is underway, and construction of the new facility is anticipated to
be complete in Summer 2022.
• Jack-in-the-Box (14002 Newport Avenue): On April 27, 2021, the Planning
Commission approved a request to demolish and remodel the existing Jack-in-the-
Box on the corner of Newport Avenue and EI Camino Real. Improvements to the street
corner of Newport Avenue and EI Camino Real will be made in addition to the

restaurant remodel. Most recently, permits demolition of the existing building have
been issued and progress is underway.

• Industrial Redevelopment (14451 Myford Road): In December 2020, the Planning
Commission approved a request for demolition of an existing industrial building and
construction of a new 220,331 square foot industrial building, new parking spaces,
relocated drive approaches and new landscaping. Permits have been issued for the
redevelopment, the site has been graded, and construction is in progress.
• House of Ruth (1941 EI Camino Real): An application was approved by the Planning
Commission for a new seven (7) unit multi -family residential facility to house families
who are, or at risk of, experiencing homelessness. The project includes a two-story,
8,098 square foot building with a resource room, office, common areas, and amenities.
The House of Ruth will be constructed by HomeAid of Orange County and operated
by Family Promise of Orange County. Construction plans are ready for issuance.
• At Home Furnishings (2505 EI Camino Real): Interior improvements and a fagade
remodel to the former Ansar Gallery tenant space have been completed, and At Home
Furnishings is now open for business in its newest location. Installation of additional
landscaping surrounding the business, and throughout the shopping center, is also in
progress.
• 99 Ranch Market (500 E. 1 st Street): The former Vons tenant space in Larwin Square
will soon be occupied by the 99 Ranch Market in early 2023. Interior demolition permits
have been approved and interior demolition work is currently underway. 99 Ranch
Market will offer grocery products, in-house fish and shellfish cleaning in addition to
a Taiwanese bakery, and a cafe called Eat Up.

Code Enforcement
Graffiti: The chart on the following page displays the number of graffiti incidents
compared to the prior three (3) calendar years, through the year-to-date. So far, this
year's incident numbers are higher than those in previous years. It should be noted that,
while graffiti incident numbers have been trending higher throughout the COVID-19
pandemic, the recent uptick in graffiti numbers may be due to the public's increased
ability to report incidents through the Engage Tustin mobile application, which launched
in November 2021.

Simon Ranch Reservoir, Booster Pump Station and Pipeline Replacement
Project: The Simon Ranch Reservoir is located in North Tustin at the intersection of
Valhalla Drive and Outlook Lane within the unincorporated territory of Orange County.
The project consists of the replacement of the existing buried, gunite lined, earthen
reservoir with a new pre -stressed concrete tank, including a new booster pump station
to be integrated within the site, and a pipeline to feed the new pump station and
reservoir. Zone 3 pipeline replacements with new hydrants were also included to
enhance fire protection. The project is primarily funded with 2013 Water Bond Funds.
Construction began in March 2020 and is expected to be complete by the end of Spring
2022.

• Newport Avenue Pavement Rehabilitation Project: The Newport Avenue
Pavement Rehabilitation Project between Sycamore Avenue and Holt Avenue includes
construction of a new asphalt rubber hot mix (ARHM) overlay, replacement of damaged
curb & gutter and sidewalks, and reconstruction of curb ramps, to be in compliance
with current Federal Americans with Disabilities Act (ADA) requirements. The project
is funded with State of California Senate Bill 1 (SB1) Local Streets and Roads Program
funds. Construction is anticipated to begin in Summer 2022 and be completed in Fall
2022.
• Red Hill Avenue Median Improvements Project: The Red Hill Avenue Median
Improvements Project will remove dead median turf along Red Hill Avenue between
Lance Drive and First Street and replace it with drought tolerant plant material and
water efficient irrigation systems. Also included in the project are lengthening of the
left turn pockets at Bryan Avenue, removal of existing substandard height median curbs
and replacement with full height curbs, and installation of median pavers and
decorative hardscape. Construction is substantially complete.
• Tustin Legacy Neighborhood -D South Infrastructure Improvements Project: In
preparation for the Brookfield Home residential development, public infrastructure work
has started in the area bounded by Armstrong Avenue, Warner Avenue, Legacy Road,
and Barranca Parkway. This work includes the extensions of public roads including
Flight Way and Compass Avenue with a new signalized intersection with Tustin Ranch
Road. The project construction is anticipated to be complete Summer 2022.
• FY 2021-2022 Roadway Rehabilitation and Sidewalk Repair Project: The roadway
rehabilitation and sidewalk repair project is located in Zone 3 of the City's Pavement
Management Program this year. Zone 3 is generally bounded by Irvine Boulevard to
the north, Browning Avenue to the east, Interstate Freeway 5 to the south and Newport
Avenue to the west. The work includes street rehabilitation and annual sidewalk
maintenance repair work which focuses on removal and replacement of damaged
sidewalk at numerous locations. The project will begin construction Summer 2022.

• Roadway Rehabilitation on Bryan Avenue between Red Hill Avenue and
Browning Avenue, and on Red Hill Avenue between Irvine Boulevard and Melvin
Way: The scope of work included grinding the existing roadway, new asphalt overlay,
traffic striping replacement, and utility adjustments per the City's Pavement
Management Program. Construction for street rehabilitation on Bryan and on Red Hill
Avenues was completed in March 2022.

EOWD Sewer Augmentation

• East Orange Water District Sewer Reliability Capacity Rehabilitation and
Augmentation project: The East Orange County Water District is upgrading and
enhancing the reliability of sewer systems serving Tustin residents and in other areas
being served. The sewer lines were originally installed in 1962 and the existing sewer
lines will be repaired and upsized for continued reliability with population growth.
Phase I of the project is on Browning from Bent Twig to 1-5 Freeway. Construction
began in Dec 2021 and expected to be complete by June 2022, including remaining
roadway restoration.
