SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION
TO FILE THE NOTICE OF COMPLETION FOR THE ANNUAL MAJOR
PAVEMENT MAINTENANCE PROJECT, FY 2005-2006 (CIP NO. 7001),
THE ANNUAL SIDEWALK REPAIR PROJECT, FY 2005-2006 (PROJECT
NO. 402-6235), AND THE WILLIAMS STREET IMPROVEMENT
PROJECT (CIP NO. 7187)
SUMMARY
Construction of the Annual Major Pavement Maintenance Project, FY 2005-2006 (CIP No.
7001), the Annual Sidewalk Repair Project, FY 2005-2006 (Project No. 402-6235), and the
Williams Street Improvement Project (CIP No. 7187) have been completed to the
satisfaction of the City Engineer and are now ready for City Council acceptance.
RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 06-99 accepting the Annual
Major Pavement Maintenance Project, FY 2005-2006 (CIP No. 7001), the Annual Sidewalk
Repair Project, FY 2005-2006 (Project No. 402-6235), and the Williams Street
Improvement Project (CIP No. 7187), and authorizing the recordation of the Notice of
Completion, and direct the City Clerk to:
1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the
date of recordation of the Notice of Completion; and
2. Release the Faithful Performance Bond not sooner than one year after the date of
recordation of the Notice of Completion; and
Assuming no claims or stop payment notices are filed, it is further recommended that thirty-
five (35) days after the date of recordation of the Notice of Completion, the City Council
authorize payment of the final 10% retention in the amount of $62,687.26 to All American
Asphalt. The total final construction contract cost for the project is $626,872.62.
FISCAL IMPACT
The final construction contract cost for the combined Annual Major Pavement Maintenance
Project, the Annual Sidewalk Repair Project, and the Williams Street Improvement Project
is $626,872.62.
Acceptance of Public Improvements and Authorization to File the Notice of Completion for
the Annual Major Pavement Maintenance Project, FY 2005-2006 (CIP No. 7001), the
Annual Sidewalk Repair Project, FY 2005-2006 (Project No. 402-6235), and the Williams
Street Improvement Project (CIP No. 7187)

The individual project finance components are as follows: The final construction contract
cost for the Annual Major Pavement Maintenance Project (CIP No. 7001) is $486,035.12,
which was funded by the City's Capital Improvement Program. The final construction
contract cost for the Annual Sidewalk Repair Project (Project No. 402-6235) is
$106,833.50, which was funded by the Engineering Division's Annual Sidewalk Repair
Operating Budget. The final construction contract cost for the Williams Street Improvement
Project (CIP No. 7187) is $34,004.00, which was funded with Community Development
Block Grant (CDBG) funds.
Project construction, along with design and construction management, has increased the City's
infrastructure assets by $733,272. The increased infrastructure valuation will be added to the
City's infrastructure inventory as required by Statement 34 of the Governmental Accounting
Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34
Infrastructure Inventory Valuation Forms.
BACKGROUND AND DISCUSSION
The construction of the Annual Major Pavement Maintenance Project, the Annual Sidewalk
Repair Project, and the Williams Street Improvement Project was completed on July 7, 2006.
The Annual Major Pavement Maintenance Project and the Annual Sidewalk Repair Project are
part of the City's ongoing Maintenance of Effort (MOE) requirement to maintain eligibility for
Measure M funding.
All of the work for these projects has been completed to the satisfaction of the City Engineer
and is now ready for City Council acceptance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ACCEPTING THE WORKS OF IMPROVEMENT AND
AUTHORIZING THE RECORDATION OF THE NOTICE OF
COMPLETION FOR THE CONSTRUCTION OF THE ANNUAL MAJOR
PAVEMENT MAINTENANCE PROJECT, FY 2005-2006 (CIP NO. 7001),
THE ANNUAL SIDEWALK REPAIR PROJECT, FY 2005-2006 (PROJECT
NO. 402-6235), AND THE WILLIAMS STREET IMPROVEMENT
PROJECT (CIP NO. 7187)
WHEREAS, All American Asphalt, having a contract with the City of Tustin to
construct the hereinafter described public works and improvement; and
WHEREAS, the City Engineer has duly certified to the construction and
completion of said public improvement hereinafter mentioned in a manner satisfactory
to the City Council of the City of Tustin; and
WHEREAS, the City Council finds that said contractor has completed said public
improvement hereinafter more particularly described in accordance with the provisions
of the contract documents and the Notice of Completion, and acceptance of said public
works and improvement should be filed and payment of the balance due said contract
authorized in accordance with the contract documents;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin
that said public works and improvement is found to be complete, and the same is
hereby accepted. Said public works and improvement is more particularly described as
follows:
Annual Major Pavement Maintenance Project, FY 2005-2006 (CIP No. 7001),
Annual Sidewalk Repair Project, FY 2005-2006 (Project No. 402-6235),
and Williams Street Improvement Project (CIP No. 7187)
BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is
hereby authorized to execute and file a Notice of Completion for the acceptance of said
public works and improvement described herein as required by law.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Tustin held on the ih day of August 2006.
