HUIZAR, CHIEF DEPUTY CITY CLERK SUBJECT: INTERVIEW AND APPOINTMENT TO THE PLANNING COMMISSION SUMMARY: The City Council will conduct interviews and appoint one (1) member to the Planning Commission to fill the unexpired term of Nathan Menard that will expire on March 1, 2007. RECOMMENDATION: Conduct interviews and appoint a member to the Planning Commission. FISCAL IMPACT: There is no fiscal impact. BACKGROUND: On July 17, 2006, the City Council set the date of August 7 to conduct interviews to fill a seat on the Planning Commission. The following applications are attached for consideration of said vacancy. In addition, I have associated with a third law firm to assist in their personal injury practice. 11/1987 -12/2005 Deputy Attorney III/IV State of California Department of Transportation, Legal Division Los Angeles/CA I primarily defended governmental tort liability cases. This involved taking a case from its inception, within the office, until the file was closed, or taking over a case in midstream. The life cycle of the typical case began with a timely claim being filed with the State, prior to the filing of a law suit. If this were not done, my initial action would be to oppose the petition for relief to allow filing of the claim and subsequent lawsuit. Next followed answering or demurring to the complaint, motion for summary judgment, discovery, trial preparation, settlement negotiations, arbitration or mediation, trial, post trial motions, and appeals. Our office had a "cradle to the grave" philosophy concerning an attorney's involvement in a case. Cases were disposed of at various points in the cycle. I handled well over 100 tort cases, with about 20 going through jury trial, and three through appeal. I was first seat in 18 of these trials and trained less experienced attorneys, by taking them to trial, as second chair. As my experience increased, so did the level of my case and project assignments. The last ten, or so, years I handled primarily cases involving serious injuries and/or multiple deaths. For 10 years, in addition to my own caseload, I acted as a Team leader and oversaw the work of four to six other attorneys, assigning them cases, monitoring the status of their cases, and offering them help and advice, as required. My last two years, when environmental and construction contract matters had been assigned to the Los Angeles office, I handled administrative hearings and arbitrations, in those areas. I did eminent domain cases, which involved preparation of the complaints, lis pendens and orders for possession, settlement negotiations, discovery, pre- trial and post-trial motions, trial preparation, court and/or jury trials, and appeals. I tried four eminent domain cases. I defended the state in employment discrimination and termination cases. I, also, acted as legal counsel to Caltrans District 8 (San Bernardino and Riverside Counties) and attended Deputy Director and staff meetings. Regardless of the type of matter, I prepared parties, witnesses and expert witnesses for deposition and/or trial or hearing. This required, among other things, evaluating the deponent or witness, getting them to understand what the extent and content of their testimony was required and not to voluntarily exceed that, and to be as comfortable during testimony, as possible. In dealing with expert witnesses, I determined the best available expert, made sure that we understood each other, as to what his testimony, and basis of the testimony would be, and what I expected from him. 9/1984 - 11/1987 Relations Board Sacramento/CA Deputy Counsel I/II State of California Agricultural Labor As a Deputy Counsel, I was assigned to the EI Centro, CA, office. My duties included the of reviewing complaints filed by unions, employees, and employers of violations of the Agricultural Labor Relations Act. Investigating the charges contained in the complaints; when appropriate, preparing and filing formal complaints against the alleged violator; negotiating settlements; preparing for administrative trials, presentation of the ALRB's case; post trial motions; appeals; and enforcement of judgments. As a Deputy Counsel II, I was transferred to The Salinas office where I was the Regional Attorney. Among my duties were the overseeing of five to eight attorneys, assignment and monitoring of their work; my own case load, and, together with the Regional Director and the Regional Investigator, determining which complaints became formal complaints and were to be prosecuted. 3/1984 - 9/1984 Attorney at Law Law Offices of Mark Olson West Covina/CA The Olson firm handled only Driving Under the Influence cases. Mr. Olson had no experience in handling trials and when various judges demanded that some of the cases, of which he was attorney of record, go forward to trial, he hired me to handle some of these trials. In the five months that I was there, I represented seven clients, in jury trials. Four of these clients were found not guilty. In addition, to the trials, I would make appearances, in the local courts, in Los Angeles, Orange, Riverside, and San Bernardino counties. This involved scheduling additional appearance dates, negotiations with the prosecutors for a bargained plea, requests for continuances, argue motions, etc. This required arranging appearances, so that I could cover multi-cases in a single court, at the same time.
