CONSENT CALENDAR ITEMS - All matters listed under the Consent Calendar are
considered to be routine and will be enacted by one motion without discussion. Persons

Council Member Gomez requested to pull Item No. 15
It was moved by Council Member Gomez and seconded by Council Member Clark to pull
Item No. 15 and approve the balance as recommended by staff.

1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE
AGENDA
Motion: The City Council waived reading in full of all ordinances and resolutions on
the agenda and declared that said titles which appear on the public agenda shall be
determined to have been read by title and further reading waived.
2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL
HELD ON MAY 17, 2022.
Motion: The City Council approved the Action Minutes of the Regular Meeting of the
City Council held on May 17, 2022.

3. RATIFICATION OF PAYROLL AND DEMANDS
The City Council has approved the use of Government Code Section 37208 to
expedite the payment of City of Tustin obligations that are in accordance with the
approved budget or continued operations authorizations.
Motion: The City Council approved Payroll in the amount of $924,996.59 and
Demands in the amount of $3,305,221.08.
4. FINDINGS REQUIRED BY AB 361 FOR THE CONTINUED USE OF
TELECONFERENCING FOR MEETINGS
In order for the Council to continue to have the option to meet via teleconference
during the pandemic, AB 361 requires the Council to make specified findings at least
every thirty (30) days.
Motion: Made the following findings by majority vote of the Council:
A. A state of emergency has been proclaimed by California's Governor
due to the COVID-19 pandemic and continues in effect; and
B. The Council has reconsidered the circumstances of the state of
emergency; and
C. State and local officials continue to recommend measures to promote
social distancing to slow the spread of COVID-19.
5. SECOND READING AND ADOPTION OF ORDINANCE NO. 1521
Adoption of Ordinance No. 1521 approves the new City logo and amends the City
Code regarding the City Seal and City Logo.
Motion: The City Council adopted Ordinance No. 1521.

6. JOHN WAYNE AIRPORT NOISE ABATEMENT QUARTERLY REPORT
This agenda report transmits the John Wayne Airport (JWA) Noise Abatement
Quarterly Report for the fourth quarter of 2021. The average noise level measured at
Tustin's monitoring station (NMS 1 ON), located at Columbus Tustin Middle School on
Beneta Way (Figure 1), remained consistent with prior quarters. Average daily noise
levels during the third quarter continued to remain well below the City, County, and
State criteria of 65 decibels (dB) Community Noise Equivalent Level (CNEL) for
residential uses. Residential noise sensitive areas exposed to an average

Community Noise Equivalent Level (CNEL) of more than 65 dB define the "Noise
Impact Area."
Motion: The City Council received and filed this report.
7. PROPERTY TAX EXCHANGE BETWEEN THE CITY OF TUSTIN AND THE
COUNTY OF ORANGE — DETACHMENT OF PROPERTY LOCATED AT 2242
FOOTHILL BOULEVARD, TUSTIN
A request for detachment of a 0.18 -acre territory (the Territory) located adjacent to
2242 Foothill Boulevard, Tustin, CA 92705, from the City of Tustin to the County of
Orange. The majority of the property is located within unincorporated "North Tustin",
and the territory proposed for detachment is located within the City's jurisdiction
boundary. The purpose of the request is to place the entire property under a single
jurisdiction for future development of the property as a single-family residence.
Motion: The City Council adopted Resolution No. 22-28 approving the property tax
exchange for the detachment of 0.18 -acre property from the City of Tustin to the
County of Orange, located adjacent to 2242 Foothill Boulevard and owned by Leason
Pomeroy.

8. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT
FOR BIDS FOR THE BENETA WELL NO. 2 — PHASE II EQUIPPING PROJECT,
CIP NO. 60151
The plans and specifications for the Beneta Well No. 2 — Phase II Equipping Project,
CIP No. 60151, have been prepared and the project is now ready for bid.
Motion: The City Council:
1. Adopted Resolution No. 22-30 approving the plans and specifications for the
Beneta Well No. 2 — Phase II Equipping Project, CIP No. 60151; and
2. Authorized the City Clerk to advertise to receive bids.

9. ADOPT RESOLUTION NO. 22-31 APPROVING PROJECT LIST TO BE
SUBMITTED TO THE CALIFORNIA TRANSPORTATION COMMISSION FOR SB1
FUNDING FOR FISCAL YEAR 2022/23
In order to be eligible to receive new funding under Senate Bill 1 (SB1), the City is
required to submit a Project List to the California Transportation Commission (CTC)
no later than July 1, 2022.
Motion: The City Council:
1. Adopted Resolution No. 22-31 identifying projects to be submitted to the
California Transportation Commission for SB 1 funding; and
2. Directed staff to submit the Project List to the California Transportation
Commission on behalf of the City.

HEATING, VENTILATION, AND AIR CONDITIONING (HVAC) IMPROVEMENTS
PROJECT CIP No. 10032 AND AUTHORIZE THE CITY ENGINEER TO FILE A
NOTICE OF COMPLETION
Construction of the Heating, Ventilation, and Air Conditioning (HVAC) Improvements
Project, (CIP No. 10032), has been completed to the satisfaction of the City Engineer
and is now ready for City Council acceptance.
Motion: The City Council:
1. Adopted Resolution No. 22-27 accepting the construction of Heating,
Ventilation and Air Conditioning (HVAC) Improvements Project (CIP No.
10032), and

12. SECOND READING AND ADOPTION OF ORDINANCE NO. 1522
Adoption of Ordinance No. 1522 amends the Tustin City Code establishing
regulations prohibiting the unlawful possession of catalytic converters in the City.
Motion: The City Council adopted Ordinance No. 1522.

THE UNLAWFUL POSSESSION OF CATALYTIC CONVERTERS IN THE CITY.
13. APPROVE A NEGOTIATED CHANGE ORDER AND AUTHORIZE THE
REMAINING PROJECT BUDGETED APPROPRIATION AS ADDITIONAL
CONTINGENCY FOR THE NEWPORT AVENUE PAVEMENT REHABILITATION
PROJECT BETWEEN 1-5 AND HOLT AVENUE (CIP NO. 70244) AND SYCAMORE
AVENUE AND 1-5 (CIP NO. 70245)
Staff is requesting the City Council approve a negotiated contract change order in
the amount of $152,158 and authorize the remaining budgeted appropriation in
excess of ten percent (10%) of the contract amount as additional contingency for the
Newport Avenue Pavement Rehabilitation Project between 1-5 and Holt Avenue (CIP
No. 70244) and Sycamore Avenue and 1-5 (CIP No. 70245).
Motion: The City Council:
1. Approved a negotiated contract change order in the amount of $152,158 with
R.J Noble Company; and
2. Authorized the remaining project budgeted appropriation in excess of ten
percent (10%) above the contract amount as additional contingency.

The Parks and Recreation Department's Annual Report summarizes the
Department's activities throughout 2021 including special events, youth, teen, adult,

and senior programs, contract classes, parks/facilities, capital projects, and human
services.
Motion: The City Council received and filed the report.
15. RESOLUTION DECLARING LEVEL 2 WATER SUPPLY SHORTAGE
Water Services Manager Mike Grisso provided a PowerPoint presentation.
On March 28, 2022, Governor Gavin Newsom issued Executive Order N-7-22
proclaiming a state of emergency due to ongoing and expanding drought condition
and directed the State Water Resources Control Board (Water Board) to develop an
emergency regulation to require all urban water suppliers implement Level 2 of their
Water Shortage Contingency Plans (WSCP).
It was moved by Council Member Gomez and seconded by Mayor Lumbard to adopt
Resolution No. 22-29 declaring a Level 2 water supply shortage and enacted Level
2 of the City Water Shortage Contingency Plan.

16. Council Member Clark and Council Member Gomez recused themselves due to an
economic interest.
CONDUCT PUBLIC HEARING TO CONSIDER LEVYING OF ANNUAL
ASSESSMENTS FOR THE TUSTIN LANDSCAPE AND LIGHTING DISTRICT FOR
FISCAL YEAR 2022-2023
The Tustin Landscape and Lighting District Engineer's Report was completed and
approved by the City Council at their May 3, 2022 meeting. At that meeting, the City
Council declared its intention to levy annual assessments and set a public hearing
for June 7, 2022. In order to levy the annual assessments, the City Council is required
to conduct a public hearing and, provided there is no majority protest, adopt
Resolution No. 22-25 confirming the annual assessments for Fiscal Year 2022-2023.

REGULAR BUSINESS ITEM 17
17. FISCAL YEAR 2022/23 BUDGET WORKSHOP
Finance Director Jason AI -Imam provided a PowerPoint presentation.
This report provides the City Council with the Proposed Annual Operating Budget
and Capital Improvement Program for Fiscal Year 2022/23, which allocates
resources that reflect the City Council's priorities set forth in the City's five-year
strategic plan.

Council Member Gallagher requested a stand alone document to be prepared for the
high-level CIP projects.
Mayor Lumbard stated investing in the Tustin Hangers and the Tustin Police
Department sub -station at Tustin Legacy has been a topic which has been discussed
for a long time; also stated a grant was received, with the help of Senator Dave Min,
for the investment of the emergency generator; Mayor Lumbard stated was happy to
see projects occurring at the south side of Tustin at the community parks.
It was moved by Mayor Lumbard and seconded by Council Member Gomez for City
Council to conduct a Budget Workshop on the Proposed Annual Operating Budget
and Capital Improvement Program for Fiscal Year 2022/23, which will be brought
forward to the City Council for consideration of adoption on June 21, 2022.

OTHER BUSINESS/CITY MANAGER REPORT
City Manager Matthew S. West
Announced the new City logo and branding is something everyone can identify with;
appreciated the City Council for their support and trust with community partners and city
staff to develop the new City logo and branding; thanked the City Council, the City
Departments, and Communications Manager, Stephanie Najera for all the hard work and
effort on the new logo and branding.
COUNCILMEMBER COMMENTS AND REPORTS
Council Member Gomez
May 26
Attended the Orange County Library Advisory Board meeting; the following items were
discussed:
• Reported the policy of removing overdue fines resulted in over 10,300 books
returned; and
• Received updates on various programs, including: the author discussions, children's
programs, and summer reading; reached out to Matthew Jennings, Director of
Communications and Community Engagement for the Tustin Unified School District,
to share the Orange County Library's summer reading program at schools; and
• Announced, previously asked the County Librarian to produce a flyer for the senior
programs that they offer to engage the senior population; reported a draft flyer has
been prepared and will be available at all of the County's Senior Centers very soon;
• Reported the Board will be reviewing the bylaws; and
• Discussed the budget for the upcoming year; stated some the challenges for library,
include: difficulty in hiring, supply chain demands and changing demographics; and
• Reported the Board is evaluating additional programs to assist students due to the
Coronavirus pandemic related school issues; reported there was an over 50%
increase in items checked out and over 225,123 new items (books, DVD's, books on
tape, etc.) were added to the system; announced over 1,185,996 hours of internet
usage in the libraries.
May 28
Attended an empowerment summit in honor of Asian American and Pacific Islander
Heritage month; reported California State Senator, Dave Min, honored several people for
their good work in the county; reported the pastors from the Laguna Woods Taiwanese
Church were in attendance; stated this church was affected by the shooting in May.
May 30
Attended the Parks and Recreation Department's Memorial Day Remembrance event;
honored those who served in the military; reported the names of those who are honored

with paver stones were read including Tustin residents who were missing or killed in action;
thanked the service members and their families for their service.
June 2
Attended the commencement ceremony of the Samueli Academy, a charter school in Santa
Ana; reported the Academy recently completed a small dormitory to house foster children
who attend the high school.
June 3
Attended the Tustin Area Man and Woman of the Year event; was well attended;
congratulated Mark Eliot, former Chief Public Information Officer for the Tustin Unified
School District (TUSD), and Kim DeBenedetto, former TUSD teacher and longtime
community volunteer, for being named the 2021 Man and Woman of the Year.
June 5
Attended the Tustin Street Fair and Chili Cookoff event; was well attended; thanked the
Parks and Recreation Department staff and the many volunteers who helped make the
event a success; thanked the Tustin Police Department, who made sure the event was safe
for all attendees; reported many compliments were given about the event; thanked everyone
for making the event a big success.

Attended the Orange County Sanitation District (OCSD) Board meeting; reported OCSD is
undertaking an energy and gas master plan; mentioned this policy will allow staff to identify
ways to create an energy neutral waste source shipment plant; reported OCSD's General
Manager, Jim Herberg, laid out his work plan to include a run-off optimization study, which
will create a program to coordinate with local agencies for storm water run-off later this year;
reported Chad Wanke, City of Placentia, was elected Board Chairperson; announced a Vice
Chairperson will be voted on in June.

response on the matter.
Directed an email to City Manager, Matthew S. West regarding the California State
Resources Control Board's Proposed Statewide Construction Stormwater General Permit

Reissuance item; announced in July the Board is looking to adopt this item impacting the
numeric effluent limitations (NELs) for water treatment levels; reported this will have
significant impacts for the cost of construction for residential dwellings, impacting the city's
ability to make profit on the land it owns and the developer's ability to create affordable
housing for Tustin and California residents; mentioned city staff is looking into the matter
and the city will have an opportunity to comment before July 4, 2022.

Attended Operation Warm Wishes (OWW) 15th Anniversary Gala event; was honored to be
an honoree; mentioned Director of Parks and Recreation, Chad Clanton was an honoree
and in attendance; reported many community members were recognized; was a very nice
event; congratulated TyRon Jackson and OWW for making an impact for the last 15 -years.

Attended the State of the County Address event; was hosted by County of Orange
Supervisor, Second District, Katrina Foley at the Old Court House in Santa Ana.
May 26
Attended the Orange County Council of Governments Board of Directors meeting.
May 28
Attended an empowerment summit in honor of Asian American and Pacific Islander
Heritage month with Council Member Gomez.

Attended the Southern California Association of Governments meeting.

Attended the State of California Santa Ana Regional Water Quality Control Board meeting.

Attended the Orange County Equality Coalition Inclusive Book Fair event; reported Arvida
Book Company, located in Old Town Tustin, provided all the books; read Mommy is the
Mayor.

Attended the Tustin Street Fair and Chili Cookoff event; was a great event; thanked all the
city staff involved; mentioned this event keeps exceeding the previous year's event; was a
job well-done.
Reported the City's logo and brand launch at the Tustin Street Fair and Chili Cookoff event

Attended the Rotary Club of Tustin — Santa Ana 100th Year Celebration event.

Attended the Parks and Recreation Department's Memorial Day Remembrance event at
Veterans Sports Park; was amazed with the turn out to the event; mentioned many Korean
Conflict veterans, several Vietnam veterans, and younger veterans were in attendance; was
honored to observe and honor the United States Flag and veterans; thanked everyone
involved for putting on a wonderful event.
June 3
Attended the Tustin Area Man and Woman of the Year event; was well attended;
congratulated Mark Eliot, former Chief Public Information Officer for the Tustin Unified
School District (TUSD), and Kim DeBenedetto, former TUSD teacher and longtime
community volunteer, for being named the 2021 Man and Woman of the Year.

Attended the Tustin Street Fair and Chili Cookoff event; was an amazing and well attended
event; thanked all the city staff involved; was honored to attend.

Supported Council Member Gallagher's comment to communicate against the California
State Resources Control Board's Proposed Statewide Construction Stormwater General
Permit Reissuance item.
May 18
Toured Orange County Fire Authority's (OCFA), aviation unit fleet at the Fullerton Airport;
reported they have four helicopters and two are being retired; mentioned the helicopters are
military helicopters from the Vietnam Conflict loaned by CalFire for use; reported OCFA is
considering the purchase of new helicopters; stated more information to come on the
helicopter purchase; was a very interesting and fun tour.
May 19
Attended the Leadership Tomorrow panel at Newport Beach Council Chamber; reported
was on a Mayor's panel with City of Irvine Mayor, Farrah N. Khan, City of Newport Beach
Mayor, Kevin Muldoon; stated a panel for City Managers also was going on, with City
Manager, Matthew S. West in attendance; was interesting to engage with people interested
in what municipal government does; was an engaging panel.

Attended the "Stop Drowning Now" Water Safety Challenge at Blue Buoy Family Swim
School; thanked Johnny Johnson and the Blue Buoy Family Swim School for their continued
efforts for water safety; stated we unfortunately have drownings in Orange County every
year and it is important to educate and keep people safe.
May 25
Participated in the Tustin Community Foundation bi-monthly nonprofit and inner faith forum;
was nice to engage with community members and key partners on what is going on in the
city.
May 26
• Attended the Santa Ana River Flood Protection Agency (SARFPA), Committee
meeting; reported the Board started to elect a new Executive Director, however, was
postponed to a future meeting.
• Attended the Orange County Fire Authority (OCFA), Board of Directors meeting.
May 30
Attended the Parks and Recreation Department's Memorial Day Remembrance event;
thanked the City Council and city staff for supporting the use of the names of lost service
members for the newer developments in the Tustin Legacy area; mentioned John Johnson
Way is one example; stated it is important for the community to remember its ties to the
past and how much those who served from Tustin mean to us.
June 5
Attended the Tustin Street Fair and Chili Cookoff event; thanked Director of Parks and
Recreation, Chad Clanton and his staff for all the hard work; was a job well-done; mentioned
it is one of the safest events; thanked the Tustin Tillers Boys Basketball Team for setting up
the tables at 5:00 AM.
