CONSENT CALENDAR: All matters listed under the Consent Calendar are considered to be routine and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the Planning Commission. 1. APPROVAL OF MINUTES — September 27, 2022 RECOMMENDATION: That the Planning Commission approve the Minutes of the September 27, 2022 Planning Commission meeting, as provided. 2. APPROVAL OF ACTION MINUTES — SPECIAL MEETING — WALKING TOUR — OCTOBER 11, 2022 RECOMMENDATION: That the Planning Commission approve the Action Minutes of the Special Meeting held on October 11, 2022. 3. FINDINGS REQUIRED BY AB 361 FOR THE CONTINUED USE OF TELECONFERENCE FOR MEETINGS In order for the Planning Commission to continue to have the option to meet via teleconference during the pandemic, AB 361 requires the Commission to make specific findings at least every thirty (30) days. Agenda—Planning Commission October 25, 2022—Page 3 of 5 RECOMMENDATION: Make the following findings by a majority vote of the Planning Commission: a. A state of emergency has been proclaimed by California's Governor due to the COVID-19 pandemic, and continues to be in effect; b. The Planning Commission has reconsidered the circumstances of the state of emergency; and c. Local health officials continue to recommend measures to promote social distancing. PUBLIC HEARING: 4. CUP 2022-0013 & DR 2022-0022 CUP 2022-0013 and DR 2022-0022 is a request to remove an existing 53-foot high major wireless facility and construct a new 72-foot high, mono-eucalyptus wireless facility along with its ancillary ground-mounted equipment at 14451 Myford Road. The project site is located in the Planned Community - Industrial (PC-IND) zoning district which requires approval of a CUP for new majorwireless communication facilities and Design Review as required by Tustin City Code Section 9272. On October 13, 2022, the applicant submitted a request to continue the public hearing to address technical elements related to the project. RECOMMENDATION: That the Planning Commission continue the public hearing on CUP 2022-013 and DR 2022-0022 to the November 8, 2022 Planning Commission meeting. REGULAR BUSINESS: 5. STREAMLINE TUSTIN INITIATIVE & NATIONAL COMMUNITY PLANNING MONTH An overview of the City of Tustin's Streamline Tustin Initiative, which encompasses a multi-faceted effort in streamlining City procedures led by the Community Development Department. The month of October also commemorates National Community Planning Month. The Planning Commission is asked to recognize National Community Planning Month. RECOMMENDATION: That the Planning Commission receive and file this report, and adopt Resolution No. 4458 recognizing National Community Planning Month. LEGISLATIVE UPDATE — OCTOBER 2022 Staff will be providing a brief update to the Planning Commission on newly enacted legislation, including AB 2097, AB 2011, and SB 6.
