HomeMy WebLinkAboutCC RES 97-28 1 RESOLUTION NO. 97-28 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15428 5 The City Council of the City of Tustin does hereby resolve as follows: 6 I. The City Council finds and determines as follows: 7 A. That Final Tract Map 15428 has been submitted by 8 Catellus Residential Group ("the Subdivider"); 9 B. That a public hearing was held by the Planning Commission on February 24, 1997. At this hearing, 10 the Planning Commission recommended than the City Council approve Tentative Tract Map 14797. 11 Subsequently, the City Council approved Tentative Tract Map 14797 on March 17, 1997; 12 C. That, pursuant to Section 66456.1 of the 13 Subdivision Map Act, the Subdivider intends to file multiple final maps in relation to approved 14 Tentative Tract Map 14797. Final Tract Map 15428 is the first such final map; 15 D. Pursuant to Section 15268(b) (Ministerial Projects) 16 of the California Environmental Quality Act (CEQA), the Final Map is considered statutorily exempt from 17 the requirements of CEQA. 18 E. That the proposed subdivision is in substantial conformance with the Tustin General Plan, the 19 Tustin-Zoning Code and Subdivision Map Act; 20 F. The 1.2444 acres of parkland required for this development was previously dedicated with 21 recordation of Tract 13627; 22 G. That the City has reviewed the status of the School Facilities Agreements between the Irvine Company 23 and the Tustin Unified School District for the impact of Tentative Tract 14797 on School District 24 facilities, and changes in state law. Impacts associated with this approval on School District 25 facilities are adequately addressed; 26 H. That the site is physically suitable for the type of development proposed; °27 I. That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife in their habitat; K. That the design of the subdivision or the type of improvements proposed will not conflict with easements acquired by the public-at-large, for access through or use of the property within the proposed subdivision; L. That the design of the subdivision or the types of improvements proposed are not likely to cause serious public health problems; and, M. That the Final Map is in substantial conformance with the Vesting Tentative Tract Map. II. The City Council hereby approves Final Tract Map 15428, subject to the posting of all required bonds and agreements pursuant to Exhibit A of Planning Commission Resolution No. 3516 and final approval by the City Engineer and City Attorney.
