SUBJECT: AUTHORIZE CITY MANAGER TO APPROVE CONTRACT AMENDMENTS TO
THE LANDSCAPE MAINTENANCE SERVICES CONTRACT WITH MARIPOSA
LANDSCAPES FOR THE GENERAL FUND CITY/WATER FACILITIES
SUMMARY
The City Council approved landscape maintenance services contracts with Mariposa Landscapes
on June 4, 2019. Since then, the City has completed a number of projects that require landscape
maintenance services. These areas have been added to the agreement using the contract pricing
approved by the City Council for General Fund City/Water Facilities, which is adjusted annually
by CPI and appropriated by the adopted budget. Staff desires to formally incorporate these and
future landscaped areas and associated water quality compliance best management practices to
the agreement through amendments as needed, contingent upon City Council approval of the
annual budget appropriation through the projected contract term, ending fiscal year 2024/2025.
RECOMMENDATION
It is recommended that the City Council authorize the City Manager or his designee to approve
amendments to the landscape maintenance contract for General Fund City/Water Facilities with
Mariposa Landscapes as needed to adjust for additional landscape maintenance services,
replanting, car accident refurbishment, irrigation repair and water quality compliance best
management practices not to exceed the City Council adopted annual budgetary appropriation.
FISCAL IMPACT
No fiscal impact. Contingent upon City Council approval of the annual budget appropriation and
satisfactory performance of services provided, staff requests sufficient funding for ongoing
maintenance services, refurbishments and repair for areas in the original contract as well as
anticipated newly constructed areas and water quality features to be maintained upon project
completion.
CORRELATION TO THE STRATEGIC PLAN
This action contributes to the fulfillment of the City's Strategic Plan Goal B: Public Safety and
Protection of Assets ensuring Tustin is an attractive, safe and well-maintained community in which
people feel pride. Specifically, Strategy 5, which among other items, is to ensure continuous
maintenance and improvement of public facilities and Strategy 6, demonstration of good
environmental stewardship.

BACKGROUND AND DISCUSSION
On June 4, 2019, the City Council awarded contracts for annual landscape maintenance services
for the General Fund City/Water Facilities and the Tustin Landscape and Lighting District to
Mariposa Landscapes, Inc. The awarded contracts covered and initial term, beginning July 1,
2019 through June 30, 2021 with an option for three additional one-year extensions. Each
subsequent year is contingent upon City Council approval of the annual budget appropriation and
satisfactory performance of services provided. At the conclusion of negotiations with Mariposa
during this time, their best and Final Offer resulted in a four percent (4%) overall discount for both
contracts, in the amount of $75,000. They have been an extremely effective and responsive
provider of services.
On September 21, 2021, the City Council approved an amended workplan and budget adjustment
and authorized the Director of Public Works/City Engineer to execute a contract amendment with
Mariposa to reduce maintenance services provided within the Tustin Landscape and Lighting
District. During the spring of 2021, property owners in the Tustin Landscape and Lighting District
were given the opportunity to submit a ballot in support of or opposition to increasing the annual
assessment on their properties in order to sustain the existing level of landscape maintenance
and lighting service throughout the Tustin Ranch area. Ballots were tabulated on June 15, 2021
and there was not sufficient support from the property owners to increase assessments. The final
results were provided to the City Council at their meeting on July 20, 2021. To maintain a
balanced budget, expenditures needed to be reduced from $1,240,100 to $812,218.
As the City continues to construct improvements in the public right-of-way and on public land,
additional landscaped services are needed to maintain and repair added projects on an ongoing
basis. Examples include the new medians on Red Hill Avenue at Bryan Avenue, Simon Ranch
Reservoir and Booster Station, Newport and Del Amo Medians, City slopes of Peters Canyon
channel, Valencia median and west side of Tustin Ranch Road parkway, and the soon to be
completed medians of neighborhood D South at Tustin Legacy. Future areas will include Alley
Grove Promenade, Legacy Park, Legacy Pedestrian Bridge Enhancements, and Dog Park. In
addition to maintenance services, water quality features such as bioswales and modular wetlands
are required for most City projects and require periodic plant replenishment to maintain
compliance with the approved project Water Quality Management Plan (WQMP).
Amendments to the contract shall use the City Council approved contract pricing, which is
adjusted annually by CPI, not to exceed the budgetary appropriation adopted by the City Council
through the annual budgetary process for these required landscape maintenance services for the
General Fund City/Water Facilities.
