SUMMARY:
The following report provides a summary of projects and activities from the Community
Development and Public Works Departments to the Tustin City Council. The report
focuses on the status of projects that the Planning Commission, City Council, Zoning
Administrator, or staff approved; historic preservation projects; Code Enforcement
activities; major construction and improvement projects; and, other items of interest.
RECOMMENDATION:
That the City Council receive and file this item.

CORRELATION TO THE STRATEGIC PLAN:
This summary of projects report contributes to Goal E of the Strategic Plan in
Organizational Excellence and Customer Service. It is staff’s desire to keep the
community informed on the status of recent projects, which are progressing throughout
the City. Sharing this report to the Planning Commission, City Council, and through the
City’s website, contributes toward both organizational excellence and customer service.

The following are updates from the Community Development and Public Works
Departments, related to planning and building projects throughout Tustin; historic
preservation activities; Code Enforcement, and public improvement project updates.

Planning Division Updates:
Planning Commission & City Council Reviews
• Aldi at 1091 Old Irvine Blvd: On June 22, 2021, the Planning Commission approved
a request to establish joint-use parking and remodel a vacant commercial building into
a multi-tenant commercial building, including an Aldi grocery store. On April 12, 2022,
the Planning Commission approved the Master Sign Program for the shopping center.
Construction is in process and a grand opening is scheduled on November 17, 2022.
• Orange County Sherriff-Coroners Technology Office at 1382 Bell Avenue: The
Orange County Sheriff-Coroner’s Technology Division and Emergency Call Center is
to occupy the existing office building for general warehouse, office, and supportive
purposes. Permits have been issued for building and site improvements and
construction is ongoing.
• Housing Element Update: The City of Tustin has recently updated its 2021-2029
Housing Element of the General Plan after extensive community outreach and inter-
agency collaboration. The Housing Element is a document which identifies the City’s
housing needs and conditions, and establishes goals, objectives and policies that form
the basis of the City’s vision and strategy for enhancing and preserving the
community’s character, and expanding housing opportunities for all Tustin community
members. The Housing Element also contains in-depth analysis and evaluation of the
City’s population, economics, household size, housing stock, housing programs, and
regulations. The 2021-2029 Housing Element was adopted by the City Council on
October 4, 2022, and certified by HCD on October 10, 2022. For more information, or

• Alta-Dena Dairy Remodel: On November 9, 2021, the Planning Commission
approved a request to remodel the former Alta-Dena Dairy at 1062 Irvine Boulevard
into a retail coffee shop with a drive-thru lane. Grading and building plans for this
project are under review and the Final Parcel Map, which will formally subdivide the
property from an adjacent parcel, is pending recordation with the County of Orange
prior to beginning construction. Construction is anticipated to begin in early 2023.

• Brass Monkey/Oculto: On March 8, 2022, the Planning Commission approved a
request to authorize the on-site sales and consumption of beer, wine, and distilled
spirits (Type 47 ABC license) and live entertainment for a new restaurant in an existing
tenant space at 14401 Newport Avenue. Plans for interior improvements have been
submitted to and approved by staff, and construction is anticipated to begin in the near
future.
• Medical Office Building: On May 24, 2022, the Planning Commission approved a
new development plan for the property at 17631 Seventeenth Street to construct a
new 11,323 square-foot, two-story medical office building. The project includes the
demolition of the existing restaurant building (Tang’s Asian Buffet). Permits have been
issued for the demolition of the existing building. Construction plans for grading and
new construction are under review by staff.
• Outdoor Dining and Seating Zoning Code Amendment: On September 20, 2022,
the City Council adopted Ordinance No. 1526 to expand opportunities for food
establishments throughout the City to provide outdoor dining and seating areas. This
ordinance is the culmination of outreach efforts to understand resident, business
owner, and patron desires and experiences as they relate to outdoor dining in light of
the COVID-19 pandemic. The new regulations are in effect as of October 21, 2022.
Outreach efforts are ongoing to inform residents and the business community of the
expanded opportunities provided by this amendment. Staff will host a public
informational session to go over the updates on Thursday, November 10 at 10:30 a.m.
via Zoom. Interested parties are encouraged to attend using the instructions on our

• Senate Bill 9 (SB 9): On August 16, 2022, the City Council adopted Ordinance No.
1523 addressing SB 9, a State housing bill effective January 1, 2022 that potentially
increases housing development opportunities within single-family zones. The SB9
code updates became effective September 15, 2022. More information and answers
to frequently asked questions can be found on our website at
http://www.tustinca.org/SB9.
• Code Streamlining and Improvement Program (Zoning Code Amendment): On
August 16, 2022, the City Council adopted Ordinance No. 1524, a comprehensive
update to the Zoning Code that improves its consistency and ease of use by staff,
residents, and development professionals. This amendment is part of the Streamline
Tustin initiative to retrofit internal processes and regulatory tools to improve the
efficacy and efficiency in conducting development business in Tustin. The code
updates became effective September 15, 2022.
• Amendment to Downtown Commercial Core Specific Plan: On September 20,
2022, the City Council adopted Ordinance No. 1525, an amendment to the Downtown
Commercial Core Specific Plan (DCCSP) (SP-12) to allow live/work residential units
as an allowable residential use via the Residential Allocation Reservation (RAR)
process in the Development Area 6C (DA-6C) of the DCCSP. The update became
effective October 21, 2022.
• Density Bonus Update: On September 20, 2022, the City Council held a first reading,
by title only, of Ordinance No. 1528 to bring the Tustin City Code into conformance
with current State Density Bonus Law. The second reading took place on October 4,
2022. The Ordinance will be in effect on November 4, 2022.
• New Wireless Telecommunication Antenna: An application was resubmitted for the
demolition of an existing wireless telecommunication antenna and the construction of
a new wireless telecommunication antenna at 14451 Myford Road. The project is
scheduled to be presented to the Planning Commission on November 8, 2022.
Zoning Administrator Reviews
• Adult Day Healthcare Facility: On January 20, 2022, the Zoning Administrator
approved a request to establish an adult day healthcare facility in an existing tenant
space located at 14511 Franklin Avenue, Suite 100. The new adult day healthcare
facility would serve up to 150 patrons. Construction plans for interior improvements
are under review by City staff.
• Escape Room: On March 3, 2022, the Zoning Administrator approved a request to
authorize an escape room recreational business to locate within an existing tenant
space at 1622 Edinger Avenue, Suite C. Tenant improvements are ongoing and the
business is expected to open before the end of the year.

2022, the Zoning Administrator approved a request to authorize a Type 41 (beer and
wine) ABC License in conjunction with a restaurant.
• Type 41 ABC License for Terra Mia at 1641 Edinger Avenue, Suite 101: On
October 13, 2022, the Zoning Administrator approved a request to authorize a Type
41 (beer and wine) ABC License in conjunction with a restaurant.
Historic Preservation Projects
• Historical Walking Tour: On October 11, 2022, the Planning Commission attended
a Historic Walking Tour hosted by the Tustin Area Historical Society, which was
thematically focused on commercial buildings in Old Town Tustin.
• Historic Register Plaque Program: Owners of historic homes or commercial
buildings in Tustin are eligible to participate in the City’s plaque designation program.
The purpose of the voluntary program is to recognize Tustin’s historic properties,
educate the public, increase public interest in historic properties, and promote
community pride. Applications for this recognition have been submitted and are under
review for the properties at 450 W. Third Street and 225 S. A Street. Staff expects to
present research findings and recommendations to the Planning Commission on
November 8, 2022.
• Mills Act Contracts: Adopted by the California Legislature in 1976, the Mills Act gives
local governments the authority to grant property tax relief to owners of qualified
historic properties, including owner-occupied single-family residences and income
producing properties. In exchange for this relief, the property owners must agree, by
contract, to maintain the properties in accordance with specific historic preservation
standards and conditions. Applications for this recognition have been submitted and
are under review for the properties at 158 N. B Street, 510 W . 2nd Street, and 530 W.
2nd Street. Staff expects to present research findings and recommendations to the City
Council on November 15, 2022.

Projects Under Review
• Streamline Tustin Initiative: The Streamline Tustin Initiative is a comprehensive
effort leveraging innovative technology to improve government processes for Tustin
businesses and residents. With the onset of COVID-19 during 2020, the City of Tustin
pivoted to quickly refine routine City services that were previously completed in-person
or on paper, such as building plan reviews and entitlement processing. Throughout
2021 to the present, the City of Tustin has continued to innovate and refine its
procedures to not only adapt to the realities of the pandemic, but to further streamline
navigating City processes for staff, businesses, and residents alike. The Streamline
Tustin Initiative is comprised of efforts which include: accelerated building plan
reviews; plan check by appointment services; online plan submittals, reviews, and
inspections; the Planning Services Concierge Program; launching the "Engage Tustin"
mobile app; enhanced transparency and community engagement processes; and,
City code updates to further streamline development application review and approval

• Rally’s Burgers: An application has been submitted to construct a new Rally’s
Burgers restaurant with a drive-thru at the site of the former Complete Auto Care
located at 14982 Prospect Avenue. The project applicant is still working on addressing
City comments.
• Yorba Street Residential Development: An application was received to construct a
residential development at 14192 Yorba Street consisting of three (3) detached units
and two (2), four (4)-car detached garages. The property contains an existing historic
resource, which is proposed to be retained on-site.
• Taco Mesita: Plans are currently in the building plan check process to remodel the
existing drive-thru restaurant located at 765 El Camino Real by enhancing the outdoor
seating area with new landscaping, lighting and a decorative perimeter wall. Permits
have been issued for interior renovations and the restaurant is anticipated to open in
the coming weeks.

• New Residential Community (Intracorp): The applicant, Intracorp, filed a Zone
Change and General Plan Amendment to allow 40 residential single-family detached
and paired units on an approximate two (2) acre site. The plans include the proposed
demolition of the two (2) existing office buildings currently on the site. The project is
currently under review by City Staff. This project will require various entitlements,
including public hearings before the Planning Commission and City Council. It is
anticipated that a public hearing will be held before the Planning Commission on
December 13, 2022.
• City Ventures Live/Work Residential Project: The applicant is proposing 42
residential units, with eight (8) of the units designed to include a ground floor space
that could accommodate a commercial use, on an approximate 1.9-acre site, located
at the southwest corner of Newport Avenue and El Camino Real (within the DCCSP
area). The application was deemed incomplete on September 29, 2022. In order to
receive final approval, this project will require various entitlements, including public
hearings before the Planning Commission and City Council.

•Myford Industrial Redevelopment: A request has been received to redevelop two
(2)existing industrial properties located at 14321 and 14351 Myford Road with a
148,437 square foot industrial building on approximately 7.18 acres. The request
includes a Tentative Parcel Map (TPM) to combine the two (2) adjacent lots.
•Acadia Healthcare: An application was submitted to establish an outpatient addiction
treatment and care center within an existing office building located at 535 E. First
Street, Unit 200. A public hearing for this project was continued to a date uncertain
while staff responds to new information provided by the applicant.
•Saddleback at ATEP: An application was submitted by the South Orange County
Community College District (SOCCCD) for the limited site plan review of a new one-
story, 20,940 square foot building for culinary arts education and a new one-story,
36,700 square foot building for automotive technology education. The limited site plan
review was approved and grading plans have been submitted for review.
•Exclusive Negotiating Agreement (ENA) for Multifamily Mixed-Use Project at
Tustin Legacy: The City Council approved an ENA between the City and AvalonBay
Communities Inc. and Abode Communities to develop a 19.4-acre mixed-use
multifamily project featuring more than 1,200 apartments at Tustin Legacy. Twenty-
five (25) percent of the units will be reserved for families and individuals earning
between thirty (30) percent and eighty (80) percent of the Area Median Income in
Orange County. The Economic Development Department is currently in negotiations
with the developer.
•Final Parcel Map for 15041-15121 Newport Avenue: On August 24, 2021, the
Planning Commission approved a Tentative Parcel Map for the property at
15041-15121 Newport Avenue. Staff is working with the applicant to obtain
pending information in order to approve the Final Parcel Map. The plans will
ultimately be reviewed and decided upon by the Community Development Director.
•Goddard at ATEP: An application was submitted by the South Orange County
Community College District (SOCCCD) for the limited site plan review of a new one-
story, 14,400 square foot building for a preschool and day care center. The limited site
plan review is currently underway.
•Veterinarian at 2937 and 2945 Edinger Avenue: The applicant, the Veterinary
Surgical Specialists of Orange County, are requesting to establish a veterinary
specialty clinic within Jamboree Plaza. The project is scheduled to be presented to
the Planning Commission on November 8, 2022.
•Dentist Office at 1034 Irvine Boulevard: A Design Review application was submitted
to expand and remodel an existing commercial building for a dental office tenant. The
applicant was provided comments on September 16, 2022 and staff is awaiting a
resubmittal.

• Lot Line Adjustment for Costco Gas at 2700 Park Avenue: An application was
received requesting to alter the property lines between the Costco Gas location at The
District and the adjacent commercial property. The submittal is still under review by
staff.
• CalOptima Recuperative Care Facility at 165 N. Myrtle Avenue and 14851 Yorba
Street: A CUP application was received requesting to establish a recuperative care
facility and PACE center within the buildings previously occupied by Encompass
Health. The PACE program provides an alternative to nursing home care for older
adults and coordinates and provides preventive, primary, acute, and long-term care
services, so older individuals can continue living in the community. The application is
under review by staff.
• Tentative Parcel Map for 1481 Edinger Avenue: A Tentative Parcel Map application
was received to subdivide the Citrus Café property located at the intersection of Red
Hill and Edinger Avenues. The plans are currently under review.
Building Division Updates
Major and Ongoing Development Projects
• The Landing – A residential community by Brookfield Residential (Tustin Ranch
Road/Warner Avenue): Model homes are open to the public for tours and the
community will ultimately include 400 residential units, including open space, park
areas, and community amenities. The neighborhoods will be comprised of 117
detached homes, 129 triplex townhomes, and 154 stacked flats and townhomes. At
the time of writing this report, at least seventeen (17) units have received final
inspections and are move-in ready!

• The Hill - Tustin at 13751 and 13841 Red Hill Avenue: On August 17, 2021, the City
Council approved a request to construct a mixed-use project with 137 residential rental
units and 7,000 square feet of retail space, as well as on-site amenities such as open
air courtyards, a pool/spa, fitness center, co-working area, bike storage room, and
tenant storage areas on a 3.8-acre site within the Red Hill Avenue Specific Plan
(RHASP) Area. Demolition of the existing building at 13751 Red Hill Avenue and
grading preparations for the overall site are underway. Staff expects construction
drawings to be submitted for the construction of the mixed-use buildings in the near
future.
• Fast5Express Carwash (2762 El Camino Real): The construction of the new
carwash including vacuum apparatuses and landscaping is complete! The carwash is
now open for business.
• Key Inn Remodel (1611 El Camino Real): Plans for a full renovation and remodel of
the existing Key Inn Motel, along with rebranding the motel to “EuroInn,” are in the
building plan check process.

• Industrial Redevelopment (14451 Myford Road): In December 2020, the Planning
Commission approved a request for demolition of an existing industrial building and
construction of a new 220,331 square foot industrial building, new parking spaces,
relocated drive approaches and new landscaping. Permits for the construction of the
building shell have been finalized, and now plans are under review for interior tenant
improvements.
• Jack-in-the-Box (14002 Newport Avenue): On April 27, 2021, the Planning
Commission approved a request to demolish and remodel the existing Jack-in-the-
Box on the corner of Newport Avenue and El Camino Real. Improvements to the street
corner of Newport Avenue and El Camino Real will be made in addition to the
restaurant remodel. Construction permits have been issued and the building is steadily
taking shape.

• House of Ruth (1941 El Camino Real): An application was approved by the Planning
Commission for a new seven (7) unit multi-family residential facility to house families
who are, or at risk of, experiencing homelessness. The project includes a two-story,
8,098 square foot building with a resource room, office, common areas, and amenities.
Building and grading permits have been issued and construction is progressing
steadily.
• 99 Ranch Market (550 E. First Street): The former Vons tenant space in Larwin
Square will soon be occupied by the 99 Ranch Market in early 2023. Interior demolition
permits have been approved and interior demolition work is currently underway. Plans
for tenant improvements are under review. 99 Ranch Market will offer grocery
products, in-house fish and shellfish cleaning in addition to a Taiwanese bakery, and
a café called Eat Up.
• Valencia Industrial Redevelopment: Construction drawings are under review to
redevelop an existing industrial property at 1100 Valencia with two (2) new buildings
totaling approximately 133,940 square feet (Building 1) and 177,830 square feet
(Building 2).
Code Enforcement
Graffiti: The chart on the following page displays the number of graffiti incidents
compared to the prior three (3) calendar years, through the year-to-date. So far, this
year’s incident numbers are higher than those in previous years. It should be noted that,
while graffiti incident numbers have been trending higher throughout the COVID-19
pandemic, this year’s uptick in graffiti numbers may be due to the public’s increased
ability to report incidents through the Engage Tustin mobile application, which launched
in November 2021.

Public Works Department Updates
Public Improvements
• Newport Avenue Pavement Rehabilitation Project: The Newport Avenue
Pavement Rehabilitation Project between Sycamore Avenue and Holt Avenue includes
construction of a new asphalt rubber hot mix (ARHM) overlay, replacement of damaged
curb & gutter and sidewalks, and reconstruction of curb ramps, to be in compliance
with current Federal Americans with Disabilities Act (ADA) requirements. The project
is funded with State of California Senate Bill 1 (SB1) Local Streets and Roads Program
funds. Construction is substantially complete.
• Tustin Legacy Neighborhood-D South Infrastructure Improvements Project: In
preparation for the Brookfield Home residential development, public infrastructure work
has started in the area bounded by Armstrong Avenue, Warner Avenue, Legacy Road,
and Barranca Parkway. This work includes the extensions of public roads including
Flight Way and Compass Avenue with a new signalized intersection with Tustin Ranch
Road. The project construction is anticipated to be complete end of 2022.
• FY 2022-2023 Roadway Rehabilitation and Sidewalk Repair Project: The roadway
rehabilitation and sidewalk repair project is located in Zone 4 of the City’s Pavement
Management Program this year. Zone 4 is generally bounded by Interstate Freeway
5 to the north, Tustin Ranch Road to the east, Railroad to the south and Newport
Avenue to the West. The work includes street rehabilitation and annual sidewalk
maintenance repair work which focuses on removal and replacement of damaged
sidewalk at various locations. The project will begin construction Summer 2023.

• East Orange Water District Sewer Reliability Capacity Rehabilitation and
Augmentation project: The East Orange County Water District is upgrading and
enhancing the reliability of sewer systems serving Tustin residents and in other areas
being served. The sewer lines were originally installed in 1962 and the existing sewer
lines will be repaired and upsized for continued reliability with population growth.
Phase II of the project is on 6th Street between El Camino Real and C
Street. Construction began in August 2022 and is expected to be complete by
November 2022, including remaining roadway restoration.
• Alley Grove Promenade at Tustin Legacy: The Alley Grove Promenade is a 2-acre
pedestrian connection from Armstrong to Tustin Ranch Road through Neighborhood D
South at Tustin Legacy. It will link the Flight office campus to the District shopping
center. The project includes a sports area with pickle ball, basketball and bocce ball
at the corner of Armstrong Avenue and Flight Way. From there, the remaining
promenade will include a pedestrian pathway, landscaping and irrigation and
lighting. The project is in design review and construction is expected to begin Spring
2023.
