new construction regulations.

Background
•California H&S Code (Section 17958.7 and 18941.5)permits local
jurisdictions to adopt amendments to the California Building Standards
Code.
•Ordinance No.1529 is proposed to adopt and amend the 2022 California
Building Standards Code with certain Appendices and supplemental
regulations.

Ordinance 1529
If approved, Ordinance No. 1529 would repeal the previously adopted 2019
California Building Standards Code from the Tustin City Code Chapters and
replace it with the proposed 2022 California Building Standards Code.

Ordinance No. 1529
Ordinance No. 1529 will apply to all new construction within
the City of Tustin beginning January 1, 2023.
All construction projects or projects submitted for City plan check prior to
January 1,2023,may continue to proceed utilizing the provisions of the
previously adopted 2019 Building Standards Code as long as the project
faithfully continues to move forward toward completion.

Resolution No. 22-43
•A table has been included in Resolution No.22-43 that identifies the
findings supporting each proposed amendment.
•Many of the suggested amendments are intended to address:
•Regionally occurring earthquake,fire or other hazards;and,
•To clarify local administrative procedures or subjects that are not covered by
the Codes or that are reasonably necessary to safeguard life and property.

Recommendation
•That the Council:
1.Continue to November 1, 2022, consideration of Resolution No. 22-43
setting forth findings as to local climatic, geological or topographical
conditions within the City of Tustin which make it reasonably necessary to
make certain amendments to the 2022 Building Standards Code;
2.Introduce and have first reading of Ordinance No. 1529 and set for second
reading at the Council’s November 1, 2022 public hearing. This procedure is
in accordance with California Government Code Title 5, Division 1, Part 1, as
published by the Building Standards Bulletin 22-02.
