CODE UPDATE
SOLID WASTE
NOVEMBER 1, 2022
BACKGROUND
•Tustin City Code updated in 2021 to ensure City compliance with SB 1383
regulations regarding the recycling of organic materials.
•SB 1383 became effective January 1, 2022.
•City is considered an enforcement agency and is required to have an
enforceable ordinance.
•City must ensure all generators are compliant with State law by December
31, 2023.

DATE OF ENFORCEMENT
•Outreach and education is and will continue to be the primary tool for
compliance.
•City enforcement scheduled to begin on January 1, 2024, which is the
same day CalRecycle can issue fines against the City for each
noncompliant generator.
•CalRecycle has suggested the City move this date forward.
•Staff proposing enforcement begin on January 1, 2023.

WAIVER PROTOCOL
•State allows local jurisdictions to waive requirements in some cases.
•Business and multifamily properties only.
•Low generation and space constraints.

WAIVER PROTOCOL
•Changes proposed
•Eliminate the need to apply for a waiver.
•Clarify that businesses and multifamily properties that are subject to AB 341 (4 CY of
trash service or more per week) are not eligible for a recycling waiver.
•Add a pathway to waive requirement to have a recycling container for low generation.
