SUBJECT: TEMPORARY COMMUNITY GARDEN AT 450 EL CAMINO REAL
SUMMARY:
Consideration of a request from One Seed to operate a temporary community garden on
City property located at 450 El Camino Real. One Seed is proposing to temporarily use
the empty lot on the west side of the existing wooden fence of the El Camino Real Respite
Parkette into a community garden that would grow fruits and vegetables. Their objective
is to create a space that would serve as an outdoor classroom, providing community
members with a variety of adult and youth educational workshops and gardening
programs. All designed with the intent and ability to be relocated to a permanent location
in the future.
RECOMMENDATION:
Authorize the City Manager or his designee to finalize and execute a short-term revocable
license agreement in a form approved by the City Attorney.
FISCAL IMPACT:
There are no direct costs to the City to be paid to One Seed for their operation and
programming of the temporary proposed community garden.
However, ongoing expenses for the short-term period related to water usage by the
community garden, estimated to be approximately $3,000 annually, are expected to be
offset by reduced maintenance expenses to the City (approximately $3,000 year) for the
Respite Parkette given One Seed’s request to temporarily take over those responsibilities.
In addition, the City has funds available to cover initial site preparation and related
Americans with Disabilities (ADA) accessibility expenses (drainage/erosion control and
installation of decomposed granite) for which costs are estimated not to exceed $8,500.

BACKGROUND
As directed by the City Council during their September 20, 2022 meeting, staff has met
with One Seed regarding their request to operate a temporary community garden on City
property located at 450 El Camino Real. One Seed is proposing to temporarily use the
empty lot on the west side of the existing wooden fence of the El Camino Real Respite
Parkette into a community garden that would grow fruits and vegetables. Their objective
is to create a space that would serve as an outdoor classroom, providing community
members with a variety of adult and youth educational workshops and gardening
programs. On the east side of the fence, in the existing Respite Parkette, One Seed
proposes to cultivate Southern California native pollinator friendly plants.
Additionally, One Seed proposes to use vines, fruit trees and other screening to provide
privacy for the adjacent neighbors.
DISCUSSION:
Deal points of the short-term revocable license agreement would include the City’s
standard terms for termination, insurance, liability and indemnification. The basic terms
specific to the temporary garden would include items such as the following:
• One Seed to operate and program the temporary garden at no cost to the City
• 24-months initial term and 3, 12-month renewals – not to exceed 5-years total
• Security Deposit - $1,500
• One Seed to take over maintenance of Respite Park (results in approximately
$3,000/year in maintenance cost saving to City)
• City to provide water – at no charge (results in approximately $3,000/year in water
charges/fees to be incurred by City)
• All designed with the intent and ability to be relocated to a permanent location in
the future
If directed by the City Council, staff and the City Attorney’s Office would finalize the short-
term revocable license agreement with One Seed and target completion of the site
preparation efforts by December 31, 2022. This would enable One Seed to begin their
temporary operations and programing activities in January of 2023.
