RECOMMENDATION:
That the Planning Commission approve the Minutes of the September 27,
2022 Planning Commission meeting, as provided.
2. APPROVAL OF ACTION MINUTES — SPECIAL MEETING — WALKING
TOUR—OCTOBER 11, 2022
RECOMMENDATION:
That the Planning Commission approve the Action Minutes of the Special
Meeting held on October 11, 2022.
3. APPROVAL OF MINUTES —SPECIAL MEETING — OCTOBER 27, 2022
RECOMMENDATION:
That the Planning Commission approve the Minutes of the Special Meeting
held on October 27, 2022, as provided.

4. FINDINGS REQUIRED BY AB 361 FOR THE CONTINUED USE OF
TELECONFERENCE FOR MEETINGS
In order for the Planning Commission to continue to have the option to meet
via teleconference during the pandemic, AB 361 requires the Commission
to make specific findings at least every thirty (30) days.
RECOMMENDATION:
Make the following findings by a majority vote of the Planning Commission:
a. A state of emergency has been proclaimed by California's Governor
due to the COVID-19 pandemic, and continues to be in effect;
b. The Planning Commission has reconsidered the circumstances of the
state of emergency; and
c. Local health officials continue to recommend measures to promote
social distancing.
5. SUMMARY OF PROJECTS
The Summary of Projects report provides a summary of projects and
activities from the Community Development and Public Works
Departments to the Tustin City Council. The report focuses on the status
of projects that the Planning Commission, City Council, Zoning
Administrator, or staff approved; historic preservation projects; Code
Enforcement activities; major construction and improvement projects; and,
other items of interest.
RECOMMENDATION:
That the Planning Commission receive and file this item.
Mello Mello pulled Item #3 from the Consent Calendar due to Commissioner absences.
Hurtado Hurtado confirmed there were no public comments received regarding the
Consent Calendar.
Motion: It was moved by Mason, seconded by Kozak, to approve Items#1, 27 4 and 5 from
the Consent Calendar. Motion carried 5-0.
Motion: It was moved by Chu, seconded by Mason, to approve Item #3 from the Consent
Calendar. Motion carried 3-0-2. Chair Mello and Commissioner Higuchi
abstained from the vote due to absences.

ENVIRONMENTAL STATUS:
This project is Categorically Exempt pursuant to the California Environmental
Quality Act (CEQA) Section 15301, Class 1.
REQUEST:
A request for a CUP to establish a veterinary specialty clinic use within an existing
vacant tenant space (approximately 10,400 square feet) located at 2937 and
2945 Edinger Avenue.
RECOMMENDATION:
That the Planning Commission adopt Resolution No. 4459 approving CUP 2022-
0012, to establish a veterinary specialty clinic use within a vacant tenant space
(approximately 10,400 square feet) located at 2937 and 2945 Edinger Avenue.

Opening Collectively, the Commission inquired on the following: hours of operation;
comments/ staff/operational overview; date of tenant improvements; opening date; the
questions. applicant's other property at 2965 Edinger Avenue; additional veterinary services
provided elsewhere in the City of Tustin, the type of rooftop equipment being
installed; noise study; requested confirmation that noise impacts were studied
pursuant to the City's General Plan and EIR.
Ms. Andrea In response to the Commission's questions/comments, Ms. Andrea Maloney,
Maloney Sapetto Real Estate, working with VSSOC, provided the following clarification:
hours of operation; emergency care service hours (between 6:00 p.m. and 7:00
a.m.) with three (3) staff on-site (veterinarian, kennel attendant and a veterinary
technician) 24 hours; open to the public from 7:00 a.m. to 6:00 p.m.; pets having
surgery typically stay overnight and are picked up the next day;following approval

Ms. Andrea of the CUP, after appeal period, the applicant will work on building plans in order
Maloney to open as quickly as possible; the applicant currently leases a space at 2965
EdingerAvenue and will remain in that location; and the applicant's plans to move
the orthopedic surgery patients and urgent care services to the new project site
at 2937 and 2945 Edinger Avenue.
Khalil Khalil informed the Commission of the type of rooftop equipment being installed.
He stated that an HVAC unit will be installed and will not be visible from the public
right-of-way.
Huitron Huitron added the following: the rooftop equipment will be reviewed by staff during
the tenant improvements portion of the project; the mechanical equipment is not
a part of the CUP; however, the City does have noise standards for mechanical
equipment and generally equipment has specifications that are already provided
as part of the plan check/building permit review process that need to be met; and
the City does not require noise studies for replacement or new rooftop equipment.
Willkom Willkom also added that the noise ordinance is in place for all uses to comply with.
Should there be a noise issue in the future, the City has the ability to enforce it.
Staff does not anticipate the proposed use will create any noise issue which is why
a noise study was not required.

Closing Higuchi disclosed the applicant's representative reached out to him to discuss the
comments project. He also made favorable comments to the applicant and his project.
Kozak thanked the applicant for the specialty care being provided in Tustin.
Mason also provided favorable comments towards Khalil and the applicant. Chu
and Mello echoed their fellow Commissioners comments.
Motion: It was moved by Mello, seconded by Mason, to adopt Resolution No. 4459, as
presented. Motion carried 5-0.

REQUEST:
A request to construct and operate a stealth major wireless communication facility
consisting of a new 72-foot high, mono-eucalyptus with ancillary ground-mounted
equipment at 14451 Myford Road.
RECOMMENDATION:
That the Planning Commission adopt Resolution No. 4460 approving CUP 2022-
0013 and DR 2022-0022, requesting to construct and operate a stealth major
wireless facility consisting of a 72-foot high, mono-eucalyptus with ancillary
ground-mounted equipment at 14451 Myford Road.

Khalil Per Khalil, as proposed, the cellular tower is designed to carry two (2) carriers: T-
Mobile and Dish Wireless. Any additional carriers would have to be analyzed by
the applicant.

Closing Higuchi would like to see the TCC be amended in order to allow the City Zoning
comments. Administrator approval rather than having to obtain a CUP.
Motion: It was moved by Kozak, seconded by Higuchi, to adopt Resolution No. 4460, as

RECOMMENDATION:
That the Planning Commission approve the nomination of 450 West Third Street
to the City's Historic Register Plaque Program and select "Wilson House - 1924"
as the most appropriate historical name and 1924 as the date of construction of
the property.

Commission The Commission collectively asked about the following, in general: the ability to
comments/ create changes to the garage (i.e. create a carriage unit) in the future; theories
questions on when the home was constructed; and that the nomination is a good addition
to the Historic Cultural Resources Program.
City Staff Willkom stated that if the garage is a historic resource and the integrity of the
structure must be protected. If the construction date was unknown, the date
would be based on the research Salman received from the County. Per Huitron,
the designation indicates that the structure was constructed in 1924. The period
itself is the period of significance.
Motion: It was moved by Chu, seconded by Kozak, to approve the nomination. Motion
carried 5-0.

Commission Higuchi asked the following: if the Commission is reliant on the 2021 Historic
comments/ Resources Survey to determine whether or not the building is architecturally
questions. significant as a historic resource; if the 2021 survey went into detail on important
historical figures associated with the building as well or is the research done after
the applicant files for a historic designation; and the Commission commended
Salman for the hard work involved with both presentations.
Huitron Huitron confirmed that the point of reference staff used is the most recent
updated survey. Important historical figures would be identified through the
individual Department of Parks and Recreation (DPR) form which would include
the architectural feature and any significant people or businesses and the DPR
form comprises the survey.
Motion: It was moved by Mason, seconded by Higuchi, to approve the nomination, as
presented. Motion carried 5-0.

Staff will be providing a brief update to the Planning Commission on newly
enacted legislation, including AB 2097, AB 2011, and SB 6.

Adopted 11.STREAMLINE TUSTIN INITIATIVE & NATIONAL COMMUNITY PLANNING

This agenda report provides an overview of the City of Tustin's Streamline Tustin
Initiative, which encompasses a multi-faceted effort in streamlining City
procedures led by the Community Development Department. The Streamline
Tustin Initiative is a comprehensive undertaking, which leverages innovative
technology to improve government processes for Tustin businesses and
residents. With the onset of COVID-19 during 2020, the City of Tustin pivoted to
quickly refine routine City services that were previously completed in-person or on
paper, such as building plan reviews and entitlement processing. Throughout
2021 to the present, the City has continued to innovate and refine its procedures

to not only adapt to the realities of the pandemic, but to further streamline
navigating City processes for staff, businesses, and residents alike.
RECOMMENDATION:
That the Planning Commission receive and file this report, and adopt Resolution
No. 4458 recognizing October as National Community Planning Month.

carried: 5-0.
STAFF CONCERNS:
Willkom Willkom shared upcoming training/events: mandatory Sexual Harassment
Prevention training — email sent out to each Commissioner by the City Clerk's
office (deadline is 12/2/22); Mayor Thanksgiving — November 17, 2022; State of
the City — December 1, 2022; City of Tustin was voted "Best Place to Live" in
Fortune Magazine.
COMMISSION CONCERNS:
Higuchi Higuchi thanked staff for all of their hard work.
Chu Chu thanked staff for all of the presentations. She also wished staff good luck for
the upcoming Red Carpet event on November 17, 2022.
Mason Mason attended the Tustin Art Walk (October 15, 2022) and Tustin Tiller Days
(October 1, 2022). She also recognized staff and the Historic Plaque Program.
Kozak Kozak commended staff on all of the presentations given. He looks forward to the
RHASP and the DCCSP updates.
Mello Mello also thanked staff for all of their hard work. He concurs with Kozak on the
DCCSP and RHASP updates. Mello also attended the Tustin Art Walk.
