CALL TO ORDER – #3031 at 7:02 p.m. ROLL CALL – City Clerk Present: Mayor Austin Lumbard, Mayor Pro Tem Barry W. West, City Manager PRESENTATION OF COLORS, INVOCATION AND PLEDGE OF ALLEGIANCE – American Legion PRESENTATIONS – Government Affairs Manager, Connor Medina, presented the Orange County Business Council’s 12th Annual Turning Red Tape Into Red Carpet Award – Incorporating Innovative Technology: Streamline Tustin Initiative. Recognition of Mayor Pro Tem Cooper for Years of Service to the Tustin Community: o On behalf of Senator Dave Min, Brian See recognized Mayor Pro Tem Cooper. o On behalf of Congresswoman Katie Porter, Cody Mendoza recognized Mayor Pro Tem Cooper. Recessed at 7:27 p.m. Reconvened at 7:42 p.m. PUBLIC INPUT – Tina Blenz CONSENT CALENDAR ITEMS 1-7 – Council Member Gomez requested to pull Item No. 7. Public Input – None It was moved by Councilmember Gallagher and seconded by Councilmember Clark to pull Item No. 7 and approve the balance as recommended by staff. Roll Call Vote – City Clerk Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES – THE SPECIAL CLOSED SESSION MEETING OF THE CITY COUNCIL HELD ON NOVEMBER 10, 2022 AND THE REGULAR MEETING OF THE CITY COUNCIL HELD ON NOVEMBER 15, 2022. Motion: The City Council approved the Action Minutes of the Special Closed Session Meeting of the City Council held on November 10, 2022 and the Regular Meeting of the City Council held on November 15, 2022. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. FINDINGS REQUIRED BY AB 361 FOR THE CONTINUED USE OF TELECONFERENCING FOR MEETINGS In order for the Council to continue to have the option to meet via teleconference during the pandemic, AB 361 requires the Council to make specified findings at least every thirty (30) days. Motion: Made the following findings by majority vote of the Council: A. A state of emergency has been proclaimed by California’s Governor due to the COVID-19 pandemic and continues in effect; and B. The Council has reconsidered the circumstances of the state of emergency; and C. Local health officials continue to recommend measures to promote social distancing. 5. HOUSING SUCCESSOR AGENCY ANNUAL REPORT FOR FISCAL YEAR 2021- 2022 In accordance with Senate Bill 341’s amendments to Health & Safety Code Section (“HSC”) 34176.1(f), the Tustin Housing Authority, serving as the Housing Successor Agency to the former Tustin Community Redevelopment Agency, has prepared an annual report for filing with the Tustin Housing Authority Commission and the Tustin City Council. Motion: The Tustin Housing Authority Commissioners took the following actions: 1. Received and filed the Housing Successor Agency Annual Report for Fiscal Year (“FY”) 2021-2022 and transmit such report to the Tustin City Council. The Tustin City Council took the following actions: 1. Received and file the Housing Successor’s Annual Report for FY 2021-2022. 2. Directed that a copy of the Housing Successor Agency Annual Report be posted on the City of Tustin’s website at www.tustinca.org 6. 2023 LOCAL APPOINTMENTS LIST Prior to December 31st of each year, the Maddy Act requires municipal agencies to prepare and post a listing of all Commission/Committee vacancies for the upcoming year. A PROCLAMATION SUPPORTING WOMEN’S EQUALITY AND T HE RIGHT FOR PEOPLE TO PEACEFULLY EXERCISE FREEDOM OF EXPRESSION, ASSEMBLY, AND ASSOCIATION A proclamation supporting women’s equality and the right for people to peacefully exercise freedom of expression, assembly and association has been prepared for the Council’s consideration. It was moved by Council Member Clark and seconded by Council Member Gomez to approve the proclamation supporting women’s equality and the right for people to peacefully exercise freedom of expression, assembly and association. Roll Call Vote – City Clerk Motion carried: 5-0 REGULAR BUSINESS ITEMS 8-9 8. DECLARING RESULTS OF THE NOVEMBER 8, 2022 GENERAL MUNICIPAL ELECTION On November 8, 2022, the City’s General Municipal Election was held to elect an at- large Mayor and one Council Member in District 3. Public Input - None It was moved by Mayor Pro Tem Cooper and seconded by Council Member Gallagher to adopt Resolution No. 22-63 declaring the results and other such matters as provided by law for the November 8, 2022 General Municipal Election. Roll Call Vote – City Clerk Motion carried: 5-0 RESOLUTION NO. 22-63 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, DECLARING THE RESULTS OF THE GENERAL MUNICIPAL ELECTION HELD ON NOVEMBER 8, 2022, AND OTHER SUCH MATTERS AS PROVIDED BY LAW Aubrey Lumbard administered the Oath of Office to Austin Lumbard. Ava Schnell administered the Oath of Office to Ray Schnell. 9. Public Input - None Mayor Lumbard opened nominations for Mayor Pro Tem. Council Member Gallagher nominated Council Member Clark. Council Member Gomez seconded the nomination. Roll Call Vote – City Clerk Motion carried: 5-0 COUNCILMEMBER COMMENTS AND REPORTS City Manager, Matthew S. West Thanked former Mayor Pro Tem Cooper for his years of service on the Tustin City Council; welcomed newly elected Council Member Schnell and congratulated Mayor Lumbard and Mayor Pro Tem Clark. Council Member Gomez November 17 • Attended the Tustin Community Foundation Mayor’s Thanksgiving Breakfast event with other colleagues. • Reported the Tustin Senior Center received a grant for congregate meals and transportation; reported the Tustin Family and Yout h Center received a grant for additional Saturday programming and cleanup projects. • Attended the Orange County Business Forum on Housing within the County of Orange; reported the discussion shared how public and private partnerships are working together to provide housing options in various communities. • Attended the Orange County Mosquito and Vector Control Board meeting; received regular reports on vector outreach, operations, activities, and approval of warrants and recommendations on the separation of the former District Manager and the appointment of the new District Manager. • Attended the Orange County Business Council, 12th Annual Turning Red Tape into Red Carpet Awards and Reception event; congratulated City staff on their award. November 30 • Attended the Tustin Senior Center Volunteer Brunch event; thanked all the volunteers that help make the Senior Center a welcoming place to serve the Tustin senior population. • Attended the Orange County Mosquito and Vector Control Policy and Personnel Committee meeting to discuss negotiations and personnel policies. December 1 • Attended the unveiling of the Mendez Tribute Monument Park event; tribute acknowledges the 1947 case Mendez v. Westminster School District of Orange County which stopped the segregation of schools in Orange County; Mrs. Sylvia Mendez, one of the children, as well as other family members were in attendance along with Ignacio Gomez, the sculptor of the two new statues at the park, and several dignitaries from Orange County; this case was the precursor to the 1954 landmark Supreme Court decision in Brown v. Board of Education that ended school segregation in the United States; the monument is located in the City of Westminster and has an interactive exhibit; by using a smart phone a participant can learn more about the Mendez case; the information is in English, Spanish, and Vietnamese. • Attended the Tustin State of the City event at the Tustin South Hangar; the event highlighted various projects within the City; reported the video was very well done; thanked Communications Manager, Stephanie Najera, for making the event successful. Gave remarks to Council colleagues as the new positions were assumed; wished the best of luck in their new positions. Mayor Pro Tem Clark Thanked former Mayor Pro Tem Cooper for his service; reported being a City Council Member is a hard job with a lot of sacrifices; paid homage to the council candidates that ran for a Tustin City Council seat in the recent elections; is a humbling experience to sit on the dais; is honored to be able to serve the City of Tustin along with fellow Council colleagues.
