CONSENT CALENDAR: None PUBLIC HEARING: 1. CONDITIONAL USE PERMIT (CUP) 2022-0010 APPLICANT: Ed Lee New Legacy Two, LLC dba "Toast Kitchen + Bakery" 12 Baristo Irvine, CA 92612 PROPERTY OWNER: 1 C Tustin Legacy, LLC 420 Stevens Avenue, Suite 320 Solana Beach, CA 92075 LOCATION: 15080 Kensington Park Dr., Suite 330, Tustin ENVIRONMENTAL STATUS: This project is Categorically Exempt pursuant to the California Environmental Quality Act (CEQA) Section 15301 (Class 1). REQUEST: A request to authorize the on-site sales of beer and wine (Type 41 ABC license) and beer, wine, and distilled spirits (Type 47 ABC license), for on-site consumption, in conjunction with a restaurant located at 15080 Kensington Park Drive, Suite 330. RECOMMENDATION: That the Zoning Administrator adopt Zoning Administrator Action (ZAA) 22-007 approving CUP 2022-0010 to allow on-site sales of beer and wine (Type 41 ABC license) and beer, wine, and distilled spirits (Type 47 ABC license), for on-site consumption, in conjunction with restaurant establishment (Toast Kitchen + Bakery) located at 15080 Kensington Park Dr., Suite 300, Tustin. Zoning Administrator Action Minutes August 11, 2022 Page 2 The ZA opened the public hearing portion of the meeting at 10:00 a.m. Mr. Michael Cho, representative for the applicant, called in via Zoom to thank staff for the assistance received regarding the application process. He also stated he and the applicant were in agreement with the Conditions of Approval. The ZA asked Mr. Cho about the Type 41 license and if he plans on applying for a Type 47 license. She added that when he does receive the Type 47 license, if he will need to abandon the Type 41 license. In response to the ZA's previous question, Mr. Cho stated that they would apply to the ABC and a form would be submitted that would state, upon issuance of the Type 47 license, that the Type 41 license is cancelled. The ZA closed the public hearing section at 10:09 a.m. The ZA adopted ZAA 22-007. REGULAR BUSINESS: None. ADJOURNMENT: 10:10 The date of the next meeting of the Zoning Administrator will be scheduled when items are set for hearing.
