SUBJECT: APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE
ADVERTISEMENT FOR BIDS FOR THE LEGACY ANNEX TENANT
IMPROVEMENT PROJECT CIP NO. 10087
SUMMARY
The plans and specifications for the Legacy Annex Tenant Improvement Project (CIP No. 10087)
have been substantially completed pending final approval by Building and Safety and the City
Engineer.
RECOMMENDATION
It is recommended that the City Council:
1.Appropriate $600,000 from the General Fund (Fund 100) and authorize transfer of the
funding to the Capital Improvement Fund (Fund 200);
2.Adopt Resolution No.23-04 approving the plans and specifications for the Legacy
Annex Tenant Improvement Project (CIP No. 10087); and
3.Authorize the City Clerk to advertise to receive bids; subject to the final approval
by Building and Safety and the City Engineer.
FI SCAL IMPACT
The FY 2022-23 Capital Improvement Program (CIP) budget includes adequate funding of $125,000
for project design, bid support, and construction administration services.
The FY 2022-23 CIP also includes a budget of $475,000 for the tenant improvement construction.
The engineer’s estimated construction cost is $911,000, without contingency. This is a $436,000
increase from a preliminary estimate provided in 2021. Based on current economic conditions, to
fully fund construction of the project and ensure an appropriate project contingency, staff is requesting
an additional appropriation of $600,000, which includes a recommended 10% construction
contingency and funds for minor geotechnical oversight and furnishings. The requested appropriation
brings the total project budget to $1,200,000 for the Legacy Annex Tenant Improvement Project (CIP
No. 10087).
The project is funded through the Capital Improvement Fund (Fund 200). An additional appropriation
of $600,000 is required to fully fund construction. Staff is requesting the City Council appropriate
$600,000 from the General Fund (Fund 100) and authorize transfer of the funds to the Capital
Improvement Fund (Fund 200).

RESOLUTION NO. 23-04
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE
LEGACY ANNEX IMPROVEMENT PROJECT CIP NO. 10087 AND
AUTHORIZING ADVERTISEMENT FOR BIDS
WHEREAS, it is the intention of the City Council of the City of Tustin, California to contract
for the construction of the Legacy Annex Improvements (No. 10087), FY 2022-2023; and
WHEREAS, the City Engineer has presented plans and specifications for the construction
of said work; and
WHEREAS, the CIP No. 10087 project is categorically exempt from the requirements of
the California Environmental Quality Act (CEQA); Class 1, Section 15301: Existing Facilities; and
NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by
the City Engineer are hereby approved as the plans and specifications for:
Legacy Annex Improvements Project
CIP No. 10087
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to
advertise as required by law for the receipt of sealed bids or proposals for the performance of the
work specified in the aforesaid plans and specifications;
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin
held on the 17th day of January, 2023.
