RECOMMENDATION: 1. Confirm the attached appointments as recommended by the Mayor; and 2. Adopt FPPC Form 806: Agency Report of Public Official Appointments and direct staff to post on the City’s website. FISCAL IMPACT: None. BACKGROUND: Mayor Lumbard has requested that this item be placed on the agenda to confirm appointments to the City and Regional committees on which members of the City Council will serve. Attached is the list of committees and agencies requiring appointments and the representative assigned by Mayor Lumbard. The Fair Political Practices Commission requires that Form 806 be posted on the City’s website to report additional compensation that officials receive when appointing themselves to positions on other committees, boards or commissions of a nother public agency or position of the agency of which the public official is a member. Collectively, The Toll Roads consist of 51 miles of state highway. The roads were designed, financed, constructed and opened to traffic in the early 1990’s at a cost of over $2 billion. The present value of The Toll Roads – including the cost of right-of-way and capital construction – is $12 billion. To plan, design, finance, construct and operate major thoroughfares and bridges in Orange County, two Joint Powers Authorities were organized under the provisions of state law and a Joint Exercise of Powers Agreements (JPA) among the County of Orange and certain cities within the County was established. In 1987, Senate Bill 1413 passed, giving TCA the authority to construct the new roads as toll facilities and issue bonds backed by future toll revenues and development impact fees. Newport Bay Watershed Executive Committee https://www.ocwatersheds.com/programs/ourws/wmaareas/wmacentraloc/nbexeccomm The Newport Bay Watershed Executive Committee (Executive Committee is the successor to the Upper Newport Bay Sediment Control Executive Committee established through a cooperative agreement in the early 1980s. The Cities of Newport Beach, Tustin, and Irvine, the County of Orange, the State Department of Fish and Wildlife (formerly Fish and Game), and The Irvine Company entered into an agreement to develop and implement a comprehensive program to manage sediment in San Diego Creek and Upper Newport Bay. The Executive Committee was formed by amendment of the cooperative agreement in 1999, and now includes in its interests the impairments of Newport Bay caused by nutrients, toxics, and pathogens in addition to sediment , as well as related environmental enhancements. As part of the amendment of the cooperative agreement, the Executive Committee expanded its membership by adding the Orange County Flood Control District, City of Lake Forest, the Irvine Ranch Water District, and the Santa Ana Regional Water Quality Control Board. These agencies were added because of their interest in the water quality of Newport Bay and available resources to support the enhancement initiatives. Orange County Fire Authority (OCFA) www.ocfa.org The Orange County Fire Authority is the regional fire service Joint Powers Authority that serves Tustin and 22 other cities in Orange County and all County unincorporated areas. The OCFA protects over 2 million residents from its 78 fire stations located throughout Orange County. The OCFA was founded in 1995 and has been providing fire protection and medical emergency services to its communities continuously since 1991. The OCFA Board is made up of 25 Board members: one councilmember appointed by the councils for each its 2 3 cities, and two (2) Supervisors appointed by the County Board of Supervisors. Orange County Library Board (LAB) https://www.ocpl.org/services/library-advisory-board Created by County Board Resolution 96-903 on Dec 12, 1996, the Library Advisory Board has 26 members, comprised of 24 city council members appointed by the member cities and 2 County Supervisor members appointed by the Board of Supervisors; members serve two-year terms and receive no compensation. The LAB meets three times a year and acts in an advisory capacity, reviewing the OC Public Libraries’ budget, operations and policy decisions and making recommendations to the Board of Supervisors. Meetings are open to the public in accordance with the Brown Act. The mission of the Orange County Mosquito and Vector Control District is to educate and protect Orange County from “vectors” and prevent vector-borne diseases in an environmentally responsible manner. (“Vectors”, as defined by the California Department of Public Health, are “any insect or other arthropod, rodent or ot her animal of public health significance capable of harboring or transmitting the causative agents of human disease, or capable of causing human discomfort and injury." Under this definition of a vector, the Orange County Mosquito and Vector Control District (District) provides surveillance and control measures for rats, mosquitoes, flies, and Red Imported Fire Ants. Vector Control’s Board of Trustees is made up of one representative of each city in Orange County and one representative appointed by the County Board of Supervisors. Orange County Sanitation District (OCSD) https://www.ocsd.com (OCSD requires that a Director participate in two sub-committees along with being a Board Director.) The Orange County Sanitation District (OC San) is a public agency that provides wastewater collection, treatment, and disposal services for approximately 2.6 million people in central and northwest Orange County. OC San is a special district that is governed by a Board of Directors consisting of 25 board members appointed from 20 cities, two sanitary districts, two water districts and one representative from the Orange County Board of Supervisors. OC San has two operating facilities that treat wastewater from residential, commercial and industrial sources. Currently, OC San has a 25-member governing board comprised of one County Supervisor, 20 City Council members, two Sanitary Districts and two Water District representatives within OC San’s 471 square mile service area. Santa Ana / Tustin Joint Powers Agency – Transportation System Improvement Authority (TSIA) Transportation System Improvement Authority is a joint powers authority (JPA) created by agreement between the cities of Santa Ana and Tustin in 1989. The JPA boundary includes eastern portions of Santa Ana and western portions of Tustin and was created to develop and maintain a program to help mitigate area -wide traffic generated by land development. The JPA originally identified two program benefit areas, both of which straddle Santa Ana and Tustin. The JPA determines appropriate developer transportation impact fees and controls expenditures of fee revenues for transportation improvements which benefit the respective area. The governing board is comprised of four members, consisting of two Council members from each City . The City of Tustin has stipulated that the current Mayor and Mayor Pro Tem represents the City should the need occur. Santa Ana River Flood Protection Agency (SARFPA) https://www.ocflood.com/sarp/sarfpa Cities are required to appoint an elected City Council member as the primary and an alternate who may be another City Council Member or someone other than a council member who is allowed to vote for the Primary appointee in their absence. Full Agency Meetings are open to all SARFPA members – usually April and November. The SARFPA Executive Committee meets once a month, but if any SARFPA member chooses to attend, they are welcome to do so per Herb Nakasone, Executive Director. The Santa Ana River Mainstem Project is designed to provide flood protection to the growing urban communities in Orange, Riverside and San Bernardino Counties . The proposed improvements to the system cover 75 miles, from the headwater of Santa Ana River east of the city of San Bernar dino to the mouth of the river at the Pacific Ocean between the cities of Newport Beach and Huntington Beach. SARFPA is a JPA formed in 1974 to support authorization and appropriations for the Santa Ana River Mainstream Project and related projects such as the Westminster Watershed Study. The agency provides its members with information on the progress of the Santa Ana River and related projects and supports regional flood control improvements constructed by the OC Flood Control District to remove current floodplains within its members’ boundaries. Water Advisory Committee of Orange County (WACO) https://www.mwdoc.com/waco/ The Water Advisory Committee of Orange County (WACO) was formed in 1983 to facilitate the introduction, discussion, and debate of current and emerging water issues among Orange County policymakers and water professionals. It has also advocated the Orange County water community’s position on issues affecting the provision and management of our water supplies, with lawmakers, regulatory agencies, regional and state water organizations, and others. The committee’s membership has evolved during the past quarter century to include not only the elected officials and management staff from many Orange County water districts and cities, but also engineers, attorneys, consultants, and other professionals who work with the Orange County water community, as well as residents and community group members who share a common interest in water issues. This form is required pursuant to FPPC Regulation 18702.5. Each agency must post on its website a single Form 806 which lists all the paid appointed positions to which an official will vote to appoint themselves. When there is a change in compensation or a new appointment, the Form 806 is updated to reflect the change. The form must be updated promptly as changes occur. Instructions This form must be posted prior to a vote (or consent item) to appoint a governing board member if the appointee will participate in the decision and the appointment results in additional compensation to the appointee. FPPC Regulation 18702.5 provides that as long as the public is informed prior to a vote, an official may vote to hold another position even when the vote results in additional compensation. Part 1. Agency Identification Identify the agency name and information on who should be contacted for information. Part 2. Appointments Identify the name of the other agency, board or commission. List the name of the official, and an alternate, if any. List the appointment date and the length of term the agency official will serve. Disclose the stipend provided per meeting and the estimated annual payment. The annual salary is an estimate as it will likely vary depending upon the number of meetings. It is not necessary to revise the estimate at the end of the calendar year. Part 3. Verification The agency head or his/her designee must sign the verification. Frequently Asked Questions (FAQs) 1. When does an agency need to complete the Form 806? A Form 806 is required when an agency’s board members vote to appoint a board member to serve on another governmental agency or position of the agency of which the official is a member and will receive additional compensation.  2. The city council votes to serve as the city’s housing authority, a separate entity. Will the Form 806 be required? If the council members receive additional compensation for serving on the housing authority, the Form 806 is required. 3. Are appointments made by a governing board to appoint one of its members to serve as an officer of that board for additional pay (e.g., mayor) required to be disclosed on Form 806? No. FPPC Regulation 18702.5(b)(6) exempts from this requirement decisions to fill a position on the body of which the official is a member (such as a councilmember being appointed as mayor) despite an increase in compensation. 4. In determining the income, must the agency include mileage reimbursements, travel payments, health benefits, and other compensation? No. FPPC Regulation 18702.5 requires only the amount of the stipend or salary to be reported.  5. Which agency must post the Form 806? The agency that is voting to appoint a public official must post the Form 806 on its website. The agency that the official will serve as a member is not required to post the Form 806. The form is not sent to the FPPC.  6. When must the Form 806 be updated? The Form 806 should be amended promptly upon any of the following circumstances: (1) the number of scheduled meetings is changed, (2) there is a change in the compensation paid to the members, (3) there is a change in membership on the board or commission, or (4) there is a new appointment to a new agency.  7. If officials choose to recuse themselves from the decision and leave the room when a vote is taken to make an appointment, must the Form 806 be completed? No. The Form 806 is only required to identify those officials that will vote on an appointment in which the official will also receive additional compensation.
