It was moved by Mayor Pro Tem Clark and seconded by Council Member Gallagher to pull Item No. 5 and approve the balance as recommended by staff. Roll Call Vote – City Clerk Motion carried: 5-0 1. WAIVE READING IN FULL OF ALL ORDINANCES AND RESOLUTIONS ON THE AGENDA Motion: The City Council waived reading in full of all ordinances and resolutions on the agenda and declared that said titles which appear on the public agenda shall be determined to have been read by title and further reading waived. 2. APPROVAL OF MINUTES – THE REGULAR MEETING OF THE CITY COUNCIL HELD ON DECEMBER 6, 2022. Motion: The City Council approved the Action Minutes of the Regular Meeting of the City Council held on December 6, 2022. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $988,193.75 and Demands in the amount of $6,527,872.96. 4. FINDINGS REQUIRED BY AB 361 FOR THE CONTINUED USE OF TELECONFERENCING FOR MEETINGS In order for the Council to continue to have the option to meet via teleconference during the pandemic, AB 361 requires the Council to make specified findings at least every thirty (30) days. Motion: Made the following findings by majority vote of the Council: A. A state of emergency has been proclaimed by California’s Governor due to the COVID-19 pandemic and continues in effect; and B. The Council has reconsidered the circumstances of the state of emergency; and C. Local health officials continue to recommend measures to promote social distancing. ADOPT RESOLUTION NO. 22-64 APPROVING APPLICTION FOR GRANT FUNDS FOR THE CENTENNIAL PARK MODERNIZATION AND IMPROVEMENTS PROJECT Senator Min secured an appropriation of $4.8 million for park improvements in the FY 22/23 California state budget for the Centennial Park Modernization and Improvements Project. The California Department of Parks and Recreation is responsible for administering this appropriation. City Council adoption of the attached resolution approving the submittal of applications for this funding is required. Public Input – John Garay It was moved by Council Member Gomez and seconded by Mayor Pro Tem Clark to approve Resolution No. 22-64. Roll Call Vote – City Clerk Motion carried: 5-0 RESOLUTION NO. 22-64 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, APPROVING APPLICATION(S) FOR SPECIFIED GRANT FUNDS FROM BUDGET ACT 2022/23 SECTION 19.56 (b)(1)(AY) TO THE CITY OF TUSTIN FOR THE CENTENNIAL PARK MODERNIZATION AND IMPROVEMENTS 6. TUSTIN SPORTS PARK DUGOUT WALL MURAL PUBLIC ART PROJECT At their November 16, 2022, Regular Meeting, the Community Services Commission recommended forwarding the design for the Tustin Sports Park Dugout Wall Mural selected by the Public Art Committee to the City Council for final approval. Motion: The City Council adopted Resolution 22-65 approving the wall mural design, submitted by artist James Dinh, to be installed on the dugout wall at Tustin Sports Park Field #2 and authorized the Parks and Recreation Department to execute an agreement with the artist. RESOLUTION NO. 22-65 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN CALIFORNIA APPROVING THE ARTWORK AS RECOMMENDED BY THE PUBLIC ART COMMITTEE AND AUTHORIZING THE PARKS AND RECREATION DEPARTMENT TO EXECUTE AN AGREEMENT WITH THE ARTIST 7. POLICE DEPARTMENT VEHICLE PURCHASE On November 26, 2022, Patrol Unit 3408 was involved in a traffic collision. The vehicle was inspected by our insurance adjuster and deemed to be a total loss and needs to be replaced. The purchase of one (1) 2022 Dodge Durango, pursuit-rated vehicle from the National Auto Fleet Group in the City of Alhambra in the amount of $49,851.76, as a replacement for one (1) total loss Dodge Charger. 2. The purchase of a police equipment conversion package for one (1) 2022 Dodge Durango pursuit-rated vehicle in the amount of $14,696.49. 3. The purchase of graphic designs from Digital Magic Signs for one (1) 2022 Dodge Durango pursuit-rated vehicle in the amount of $736.81. 4. The purchase of a Lakeman Chassis battery box for one (1) 2022 Dodge Durango pursuit-rated vehicle in the amount of $187.61. 5. The Public Works Department to dispose of the total loss vehicle at the direction of the insurance company. If there are any proceeds as a result of the disposal, credit the net proceeds to the applicable City Revenue Fund. 6. An appropriation from the Vehicle Replacement Fund in the amount of $65,472.67 for the purchase and conversion of the 2022 Dodge Durango. The Vehicle Replacement Fund will be reimbursed for the purchase upon collection of the insurance claim.
