SUBJECT: AWARD CONTRACT FOR THE ALLEY GROVE PROMENADE PROJECT, CIP
NO. 20084
SUMMARY
Staff is requesting the City Council award a construction contract to the lowest
responsive/responsible bidder for the Alley Grove Promenade Project in Tustin Legacy, CIP No.
20084, Brightview Landscape Development, Inc. ("Brightview").
RECOMMENDATION
it is recommended that the City Council:
1.Deny the bid protest submitted by Marina Landscape, Inc. ("Marina") as to Brightview;
2.Waive inconsequential bid deviations in the bid of Brightview, award a construction contract
in the amount of $3,437,030.44, for the Alley Grove Promenade Project, CIP No. 20084 to
Brightview as the lowest responsive and responsible bidder, and authorize the Mayor and
the City Clerk to execute the contract documents on behalf of the City; and
3.Appropriate $884,700 from Land Sale Proceeds Fund (Fund 189) to fully fund the project.
FISCAL IMPACT
The FY 2022-23 Capital Improvement Program budget includes $3,000,000 for construction of the
Alley Grove Promenade. The project is funded with $2,180,000 from the MCAS Backbone
Infrastructure Fee Fund (Fund 187) and $820,000 from the Land Sale Proceeds Fund (Fund 189).
The construction bid is $3,437,030.44, which has increased from the engineer's estimate due to the
current bidding environment including inflationary escalations in material and labor costs. To fully
fund the project, including 10% project contingency, and engineering and geotechnical support, staff
is requesting an additional $884,700 appropriation from the Land Sale Proceeds Fund (Fund 189}
for the project for a total construction cost of $3,884,700.
CORRELATION TO THE STRATEGIC PLAN
The Alley Grove Promenade project contributes to the fulfillment of the City's Strategy Plan Goal A:
Economic and Neighborhood Development. Specifically, the project implementation of Strategy 1,
which among other items, is to develop critical phases of Tustin Legacy and Strategy 8, create
linkages between parts of the community through a variety of means, such as bike lanes and
greenbelts.
DISCUSSION
The Alley Grove Promenade project is an approximately 2.8-acre open space pedestrian
walkway/multimodal connection from Armstrong Avenue to Tustin Ranch Road through

Re: Response to Forwarded Bid Protest – Alley Grove Promenade (CIP 20084)
Dear Joann:
BrightView Landscape Development, Inc. submitted a bid for the referenced project and
was determined the apparent low Bidder. Subsequently, the City of Tustin received a
letter of protest from the third low Bidder contesting both the low bid and the second bid.
This letter makes representation in regard to the bid of BrightView Landscape
Development, Inc.
City of Tustin in Bid Instructions CIP 20084 called out a 2-part requirement regarding
the Bidder’s Bond. The first part was an electronic upload of the document, we
presume as proof that the Bidder provided Bid Security. BrightView uploaded that
instrument prior to it being prepared for delivery to City of Tustin. The second part –
physical delivery of the Bidder’s Security instrument is presumed because legal
jurisdictions do not recognize a scan, copy or facsimile of a Bidder’s Bond or Cashier’s
Check as valid. A Bidder’s Bond requires wet signature, raised Corporate Seal and
notary for it to be redeemable. Essentially, a copy of a Bond is of no value, whether
signed, sealed or not. CIP 20084 required of a hard copy delivered between 8 am and
the time of Bid opening on the date of the bid. BrightView Landscape Development,
Inc. delivered a physical Bidder’s Bond meeting all requirements to the City of Tustin
and confirmed receipt of same after the Bid opening. A scan of that document is
attached herewith.
BrightView Landscape Development, Inc., delivered a legal, physical Bidder’s Bond
meeting all requirements in terms of form, time and place as required by the City of
Tustin. The City is, therefore within its rights make award related to that low and
responsive Bid.
