INVOCATION: Pastor Jorge Molina, Mariners Church Given. PLEDGE OF ALLEGIENCE: Commissioner Mason All present ROLL CALL: Chair Mello Chair Pro Tem Kozak Commissioners Chu, Higuchi, Mason PUBLIC INPUT: Ms. Tina Ms. Tina Blenz made various comments which generally included: she Blenz claimed her home internet is fraudulent; her home was originally built for Wheaton Wilcox; issues with AT&T disconnecting her land line and she claimed she was a victim of retaliation; Pasadena well mapping issue; claims she was illegally placed in a mental institution and she would like the City of Tustin and Wilcox Manor to reimburse her for medical, telephone line expenses, etc. Approved the CONSENT CALENDAR: Consent Calendar, as presented. 1. APPROVAL OF MINUTES — JANUARY 10, 2023 RECOMMENDATION: That the Planning Commission approve the Minutes of the January 107 2023 Planning Commission meeting, as provided. 2. FINDINGS REQUIRED BY AB 361 FOR THE CONTINUED USE OF TELECONFERENCE FOR MEETINGS In order for the Planning Commission to continue to have the option to meet via teleconference during the pandemic, AB 361 requires the Commission to make specific findings at least every thirty (30) days. Planning Commission Meeting Minutes of January 24, 2023 1 Page 1 of 5 RECOMMENDATION: Make the following findings by a majority vote of the Planning Commission: a. A state of emergency has been proclaimed by California's Governor due to the COVID-19 pandemic, and continues to be in effect; b. The Planning Commission has reconsidered the circumstances of the state of emergency; and c. Local health officials continue to recommend measures to promote social distancing. Motion: It was moved by Higuchi, seconded by Kozak, to approve the Consent Calendar, as presented. Motion carried: 5-0. PUBLIC HEARING: Item 3. CONDITIONAL USE PERMIT (CUP) 2022-0019 — ITEM TO BE continued to CONTINUED TO A DATE UNCERTAIN. a date uncertain. SUMMARY- CUP UMMARY:CUP 2022-0019 is a request to establish a hospital use providing recuperative care and short-term post-hospitalization housing needs for individuals experiencing homelessness and low and extremely-low income individuals with an ancillary Program of All- Inclusive Care for the Elderly (PACE) and support services for the elderly within the existing buildings located at 14851 Yorba Street and 165 N. Myrtle Avenue. RECOMMENDATION: That the Planning Commission continue the item to a date uncertain to provide the applicant an opportunity to provide additional information regarding the proposed day-to-day operations. 7:07 p.m. Mello opened the Public Input portion for Item No. 3. Ms. Jenny Ms. Jenny Shumar, resident, voiced her concern on the following items, Shumar in general: she did not receive notification of the public hearing item (lives one block from project site); since the item is a CUP, she asked if the proposed use would be for an unlimited amount of time; how is the project being funded (i.e. grant, federal or by the local taxpayers); recuperative care is 90 days and post hospitalization housing is six (6) months which in total is nine (9) months; concern this project might turn into housing for those experiencing homelessness; would this use be Planning Commission Meeting Minutes of January 24, 2023 1 Page 2 of 5 Ms. Jenny geared for the elderly or families and if there would be a curfew; she Shuman asked if Families Together would be involved with the medical care and if pets would be allowed; and if the proposed project would be a no alcohol/no drug facility and how would it be enforced. Higuchi Higuchi asked Willkom to forward all of Ms. Shuman's questions to the applicant in order to allow the applicant time to provide responses when the item is brought to the Commission. Willkom In response to Higuchi's previous question, Willkom stated that since the item is being continued, staff is in the process of analyzing the application. Staff also has questions for the applicant and will share with the applicant once the item is ready to be presented to the Commission. Willkom added that staff will also notify Ms. Shumar once a meeting date is scheduled for the item. 7:12 p.m. Mello closed the Public Input portion for Item No. 3. Motion: It was moved by Mason, seconded by Kozak, to continue the item to a date uncertain to provide the applicant an opportunity to provide additional information regarding the proposed day-to-day operations. Motion carried 5-0. REGULAR BUSINESS: Approved the 4. COMMENDATION AND TUSTIN HISTORIC REGISTER nomination NOMINATION FOR THE PROPERTY AT 530 W. SECOND for the STREET property at 530 W. RECOMMENDATION: Second St. That the Planning Commission approve the nomination of 530 W. Second Street to the City of Tustin Commendation Program and Historic Register Plaque Program and select the name "Satterwhite-Brown House" and the date "1917" as the most appropriate historical name and date of construction for the property. Hurtado Hurtado confirmed no public comments received. Chu Chu asked if the original garage was one-story or two-story. Salman Salman stated the original garage was a one story two-car garage and the current owners renovated the existing garage and added an ADU above the garage. Planning Commission Meeting Minutes of January 24, 2023 1 Page 3 of 5 Higuchi Higuchi asked about the historic process, which generally included: the property being subject to the Mills Act Program and was approved by the City Council in November 2022; if the Planning Commission recommended approval to have the property included in the Historic Register for the City; if any properties located within the same area are designated as historical and which owners could apply for the Mills Act Program; if Tustin Meadows was included in the City's Historic Survey and if they could be included in the Mills Act Program, subject to City Council approval; and Higuchi asked if the Planning Commission acts as the historic committee. Salman Salman confirmed that the City Council approved the subject property be part of the Mills Act Program in November 2022.Any property owner can request (i.e. apply) to be a part of the Mills Act Program and eligibility is determined after staff inspects the property to determine if the property is a Contributor. Based on that information, and staff's findings, staff recommends the property to the City Council. Huitron Huitron further explained when the subject property was presented to the Planning Commission as part of the Mills Act Program, it was already listed in the City's Historic Survey, which was presented to the Planning Commission in 2021/2022 and since the subject property was already on the historic register with the City, the property was eligible to participate in the Mills Act Program. The subject property is now being recommended into the City's Historic Register Plaque Program along with the Commendation Program. The City's Historic Survey identified Tustin Meadows as a new potential historic district and recommended at that time that if the City wanted to explore that further, the City could in the future, as an option. That has not yet moved forward but the City's Historic Survey still identifies Tustin Meadows as a potential historic district. The Planning Commission is identified as the Historic and Cultural Resources Advisor to the City Council. Mason Mason asked if the subject property would be featured on any of the City's website. Huitron Currently, as part of the finalization of the Historic and Cultural Resources Advisory Work Program, staff is completing the GIS mapping of all of Tustin's properties that have received recognition through the City's Historic Survey, staff is also incorporating into the GIS system, a map of all of the properties that have been entered into the City's Mills Act Program which includes photographs of the properties and that project is currently in the final stages. Motion: It was moved by Chu, seconded by Kozak, to approve the nomination of 530 W. Motion carried 5-0. STAFF CONCERNS: Willkom Willkom informed the Planning Commission of the upcoming Mayor's Celebration on February 2, 2023, at 5:30 p.m. She also stated that the property owners for the proposed outpatient treatment and counseling center for opioid use disorder at 535 E. First St. filed an appeal for the denial of both the reasonable accommodation request and the Conditional Use Permit. A meeting date has not yet been set for the appeal. COMMISSION CONCERNS: Chu Chu asked everyone to stay safe and healthy. She recognized the tragedy and loss at the active shooter incident in Monterey Park. Mason No concerns. Higuchi No concerns. Kozak On January 5, 2023, Kozak attended a staff briefing regarding 535 E. First St. Mello Mello thanked staff and the public for attending the Planning Commission meeting. 7:32 p.m. Adjourned.
