Item: 9. APPEAL OF THE PLANNING COMMISSION’S DECISION TO DENY REQUEST FOR
DISABILITY-RELATED MODIFICATION OF CITY POLICIES, PRACTICES, AND/OR
PROCEDURES Philip Teyssier of Atomic Investments, Inc. (“Appellant”) appeals from the
Planning Commission’s denial of a request for disability-related reasonable modification of City
policies, practices, and/or procedures to allow California Treatment Services, a subsidiary of
Acadia Healthcare Company, Inc. (“Acadia”) to operate an outpatient treatment and counselling
center (“Comprehensive Treatment Center” or “CTC”) at a commercial property owned by the
Appellant located at 535 E. First Street. AMERICANS WITH DISABILITIES ACT (“ADA”)
ADVISORY STATEMENT RELATED TO THE PROPOSED PROJECT: If approved, the
proposed CTC would exclusively serve persons receiving treatment for Opioid Use Disorder. To
be a patient at the CTC, an individual cannot be actively using illegal drugs. Persons receiving
such treatment are “qualified individual[s] with a disability” afforded full protection under the ADA
and the ADA prohibits the City from discriminating against qualified individuals in making land
use decisions. In considering this application and the appeal, the City Council may not treat the
proposed CTC differently than it would any other medical clinic. It may not base its decision on
the fact that patients at the CTC will be receiving treatment for Opioid Use Disorder. Nor may
unsubstantiated fears, prejudice, or stereotypes related to persons recovering from Opioid Use
Disorder form the basis of the City Council’s decision.
eComment: I am a local old-town resident who cannot have noticed the steady influx of
homeless into our neighborhoods from Santa Ana over the last few years. The PD is not
equipped to handle the current load of homeless people, and allowing the use of this building for
this use will indeed create problems for our city and police force. My casual observations in
strolling town have been eye-raising the last few weeks. During my evening stroll, I noticed a
homeless person pooping in the middle of the street where sixth dead ends near the Boys and
Girls Club Center. During the torrential rains, homeless people were sleeping in the entryways of
multiple old town businesses. I don't feel safe, I carry pepper spray and a taser at night, and
have recently considered purchasing a gun. I feel for the communities' homeless people, but
Tustin IS NOT A CAMPSITE. I have owned my home for 15 years and have been shocked by
the number of break-ins, trash and unwanted visitors our area has experienced. We have seen
used condoms and syringes on the street, especially near the Bel Air Lodge. The city needs to
stop this from happening and better address problem properties like the Bel Air and Key Inn. Our
city deserves better. Also, the PD needs to be more active in addressing the vagrants in the old
town. Reading reviews of local businesses, one can not be shocked that Tustin is trying to
eliminate this problem by visiting our city. S Thayer – (Google Review) Don't even get me
started... First off, the place is infested with drug dealers and prostitutes!!! People are dealing
drugs out in the open at all times of day and night and managment knows about it as well as who
they are, yet still rents to them!!! If you have a wife and kids, valuables of any kind or anything of
value... I would strongly suggest that you take them somewhere else. If you DO complain,
managment will act like they are concerned but STILL won't address or take care of the problem
without acting like it's a joke. THESE are the facts people. Great place if you want to get high,
laid, sling dope or prostitute... but I wouldn't recommend it to upstanding people or their families.
I mean seriously people, there is a "Drug Rehab/Methadone" clinic in front of the place for Christ
sake... what do you expect. Golfing HB If Roaming Homeless watching your every move and
taking inventory of your vehicles contents and what is going into your room is your thing then you
will be Doubly pleased because the management are to say the least annoying and equally
curious and intrusive and hard to understand as they speak in two word sentences i.e. How
Long? when Leaving? and no stay! oh yeah and my brother is black I'm white same mother
differant fathers my brother who was registered was told No Visitors! and when he tried to
explain he was related that wasn't believed as he was told "no dealers! " You Leave" and "Not
Brother" so insulting to say the least confusing at best unpleasant, We don't need these people
in our city and this business send them packing!
