CONSENT CALENDAR: All matters listed under the Consent Calendar are considered to be routine and will be enacted by one motion without discussion. Persons wishing to speak regarding Consent Calendar matters should file a "Request to Speak" form with the Planning Commission Secretary. 2. APPROVAL OF MEETING MINUTES — MARCH 28, 2023 RECOMMENDATION: That the Planning Commission approve the Minutes of the March 28, 2023 Planning Commission meeting, as provided. PUBLIC HEARING: 3. CODE AMENDMENT 2023-0003 (ORDINANCE NO. 1535) — (DENSITY BONUS,ACCESSORY DWELLING UNITS AND JUNIORACCESSORY DWELLING UNITS ORDINANCE UPDATES) Code Amendment (CA) 2023-0003 is a City-initiated request to amend Chapter 1 (Incentives for the Development of Affordable Housing) of Article 9 (Land Use) to bring the Tustin City Code (TCC) into conformance with current State Density Bonus Law (Government Code Section 65915-65918). CA 2023-0003 also amends TCC Sections 9279 and 9297 relating to Accessory Dwelling Units (ADUs) and Junior Accessory Dwelling Units (JADUs)to comply with newly amended State Law, such as Assembly Bills (AB) 2221 and 897 and Senate Bill (SB) 887, and to ensure they are in compliance with the City's 2021-2029 Housing Element, as directed by AB 671 (2019). RECOMMENDATION: That the Planning Commission adopt Resolution No. 4469, recommending that the City Council adopt Ordinance No. 1535, amending TCC Sections 9112 and 9121(a), adding TCC Section 9126 relating to incentives for the development of affordable housing, and amending TCC Sections 9279 and 9297 relating to ADUs and JADUs.
