HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/FIELD SERVICES DIVISION SUBJECT: APPROVAL OF PLANS AND SPECIFICATIONS AND AUTHORIZATION TO ADVERTISE FOR BIDS FOR ANNUAL LANDSCAPE MAINTENANCE SERVICES FOR THE GENERAL FUND AREAS (DECEMBER 1, 2006 - JUNE 30, 2007) SUMMARY This contract will provide for the annual landscape maintenance needs in the General Fund areas for the remaining portion of the 2006-2007 fiscal year with the option of providing three (3) additional one-year extensions. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 06-107 approving the plans and specifications and authorizing solicitation of bids for the annual landscape maintenance services for the General Fund areas. FISCAL IMPACT The cost of this contract will be funded from the approved operating budgets for the 2006/2007 fiscal year. The General Fund will pay for landscape maintenance services performed at the Civic Center, Senior Center, Maintenance Yard, the Tustin Family Youth Center, and various parkways and medians. The Water Fund will pay for services at the various water facilities and well sites. This contract is for maintenance services and is not subject to "lowest responsible bidder" requirements of the Public Contract Code. The recommended award will consider qualifications and cost. BACKGROUND The General Fund Landscape Contract covers all CitylWater facilities and all City maintained medians and all parkways not in the Landscape and Lighting District areas. The City's current contract for annual landscape maintenance services for General Fund areas is one of two landscape contracts that are due to expire on June 30, 2007. The other contract, which will be bid concurrently with this contract, covers the annual landscape maintenance services for the East Tustin Landscape and Lighting District. On April 3, 2006, the City Council approved the second amendment to the contract with TruGreen LandCare to extend the contract to June 30, 2007. At that time TruGreen did not request any increase in the contract price and had changed their service manager and other crew members specifically to improve the quality and consistency of their level of service and to correct the service deficiencies in the contract. Unfortunately, the quality of their performance has started to fluctuate again after the initial Approval of Plans and Specifications and Authorization to Advertise for Bids for Annual Landscape Maintenance Services for the General Fund Areas (December 1, 2006 - June 30, 2007) September 5, 2006 Page 2 improvement. Therefore, staff is recommending soliciting new landscape maintenance services proposals for both landscape areas. The current contracts with TruGreen can be terminated through a 30-day notice. The intent of the City is to hire a separate contractor to provide the required landscape maintenance services to each area. TruGreen LandCare currently is servicing both areas. Separate contractors for each area will provide additional resources and flexibility in case of unsatisfactory performance in one area, or when there is a need to add new areas. It will also enable the City to compare the level of performance within the two areas. DISCUSSION The proposed specifications call for complete landscape maintenance services including, but not limited to, mowing, edging, weeding, fertilizing, pruning, and irrigating. The proposed landscape maintenance services contracts will be for the remaining period of this fiscal year from December 1, 2006 to June 30, 2007 with three (3) one-year extensions. Award of any future extensions will be at the discretion of the City, with the City Manager's approval, based on the contractor's performance. Attachment RESOLUTION NO. 06-107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE ANNUAL LANDSCAPE MAINTENANCE SERVICES FOR THE GENERAL FUND AREAS FROM DECEMBER 1, 2006 - JUNE 30, 2007, AND AUTHORIZING ADVERTISEMENT FOR BIDS WHEREAS, it is the intention of the City Council of the City of Tustin, California to contract for the Annual Landscape Maintenance Services for General Fund Areas; and WHEREAS, the City Engineer has presented plans and specifications for the performance of said work; and WHEREAS, this project is exempt from the requirements of the California Environmental Quality Act; NOW, THEREFORE, BE IT RESOLVED that the plans and specifications presented by the City Engineer are hereby approved as the plans and specifications for: Annual Landscape Maintenance Services for General Fund Areas from December 1, 2006 - June 30, 2007 AND BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and directed to advertise as required by law for the receipt of sealed bids or proposals for the performance of the work specified in the aforesaid plans and specifications; PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held on the 5th day of September 2006.
