2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
TUSTIN APPROVING VESTING TENTATIVE TRACT MAP NO.
3 14797 LOCATED AT THE NORTHWEST CORNER OF JAMBOREE
AND PIONEER ROADS.

The City Council of the City of Tustin does hereby resolve
5 as follows:
6 I. The City Council finds' and determines as follows:
7 A. That Vesting Tentative Tract Map No. 14797 was
submitted by Catellus Residential Group for
8 consideration;
9 B. That a public hearing was duly called, noticed
and held for said map on February 24, 1997 by the
10 Planning Commissmon and on March 17, 1997 by the
City Council;

C. That Environmental Impact Report 85-2, as
12 modified by supplements and addenda, for the East
Tustin Specific Plan, has been certified in
13 conformance with the requirements of the
California Environmental Quality Act for the
14 subject project;
15 D. That the proposed subdivision is in conformance
with the Tustin Area General Plan, adopted East
16 Tustin Specific Plan, Development Agreement and
Subdivisio'n Map Act~

E. The 1.2444 acres of parkland required for this
18 development was previously dedicated with
recordation of Tract 13627;

F. That the City has reviewed the status of the
20 School Facilities Agreement between the Irvine
Company and the Tustin Unified School District,
21 for the impact of Vesting Tentative Tract 14797
on School District facilities, and changes in
22 state law. The impacts associated with t'his
approval on School District Facilities are
23 adequately addressed;
24 G. That the site is physically suitable for the type
and density of development proposed;

H. That the site is physically suitable for the
26 proposed density of development;

I. That the design of the subdivision or the
2 proposed improvements are non likely to cause
substantial environmental damage or substantially
3 and avoidably injure fish or wildlife in their
habitat;

Jo That the design of the subdivision or the type of
5 improvements proposed will not conflict with
easements acquired by the public, for access
6 through or use of the property within the
proposed. subdivision;

K. That the design of the subdivision or the types
8 of improvements proposed are not likely to cause
serious public health problems;
9
L. The proposed project has been reviewed for
10 conformity with the provisions of the Orange
County Congestion Management Program, and it has
· 1 been determined that the additional traffic
generated by the proposed project onto the CMP
12 Highway System does not cause the system to
exceed established level of service standards;
13 and,
14 M. The project has been determined to be exempt from
the provisions of Measure "M" because
15 entitlements specified in the East Tustin
Development Agreement ennered into in 1985, and
16 the estimated project generated traffic does not
cause the roadway system to exceed established
17 levels of service standards.
18 II. The City Council hereby approves Vesting Tentative
Tract Map No. 14797 located at the northwest Corner of
· 19 Jamboree and Pioneer Roads, subject to the conditions
contained in Exhibit A of Planning Commission
20 Resolution No. 3516, incorporated herein by reference.

PASSED AND ADOPTED by the City Council of the City of
22 Tustin, at a regular meeting on the 17th day of March,
1997o

City Council of the City of Tustin, California, do hereby
5 certify that the whole number of the members of the City
Council of the City of Tustin is five; that the above and
6 foregoing Resolution No. 96-19 was duly passed and adopted
at a regular meeting of the Tustin City Council, held on
7 the 17th day of March, 1997, by the following vote:
