A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
TUSTIN, DENYING CONDITIONAL USE PERMIT 06-008, A REQUEST
TO AMEND THE TUSTIN AUTO CENTER MASTER SIGN PROGRAM
TO ALLOW TWO (2) FIFTEEN FOOT HIGH, SIX (6) AND A HALF FOOT
WIDE, ENTRY MONUMENT SIGNS WITH 32 SQUARE FOOT LIGHT
EMITTING DIODE (LED) SCREENS LOCATED AT THE SOUTHEAST
CORNER OF TUSTIN RANCH ROAD AND AUTO CENTER DRIVE AND
THE SOUTHEAST CORNER OF EL CAMINO REAL AND AUTO
CENTER DRIVE
The Planning Commission does hereby resolve as follows:
I. The Planning Commission finds and determines as follows:
A. A proper application, Conditional Use Permit 06-008, was filed by
Linda Smith, on behalf of The Tustin Auto Center Merchants'
Association, to amend the Tustin Auto Center master sign program
to allow two (2) fifteen foot high, six (6) and a half foot wide, entry
monument signs with 32 square foot light emitting diode (LED)
screens located at the southeast corner of Tustin Ranch Road and
Auto Center Drive and the southeast corner of EI Camino Real and
Auto Center Drive.
B. Section 9403g and Section 9404b6 of the Tustin City Code provides
for the adoption of master sign programs and allows for deviations
from standards contained in the Tustin Sign Code provided that the
project is located within a center with at least thirty thousand
(30,000) square feet of building area. The Tustin Auto Center meets
the criteria in that it contains approximately 680,450 square feet for
commercial uses and is located within a center.
C. The proposed entry monument signs deviate from the Tustin Sign
Code by exceeding height, size, illumination, blinking, copy change,
and number of signs restrictions.
D. The proposed signs are only permitted with Planning Commission
approval under the City of Tustin's police power authority.
E. That a public hearing was duly called, noticed, and held for said
application on August 28, 2006, by the Planning Commission.
F. That it is appropriate to deny the installation of the LED monument
signs in that:

a) The signs would not have freeway orientation and, therefore,
do not have any special circumstance meriting the approval;
b) The signs would be visible from residences and no evidence
has been presented or project mitigation provided to ensure
that adjacent residents would not be disturbed by glare from
the signs;
c) The signs would be animated which has not been permitted
for any other commercial center or business in the City that
does not face the freeway; and,
d) The signs would establish a precedent that departs from the
quality architectural standards of the community and could
promote random LED sign placement throughout Tustin.
e) The proposed 15 foot sign height would not be in scale with
surroundings and would distract from the open space
landscaped corridor of Tustin Ranch Road and EI Camino
Real.
f) The project proponent has not indicated any hardship to
justify allowance of the signs.
g) No evidence has been presented to the City to negate
concerns that the signs may be distractive to passing
motorists.
h) The existing master sign plan currently provides for relief from
the provisions of the Tustin Sign Code and should be
sufficient for Tustin Auto Center identification.
G. This project is Statutorily Exempt pursuant to Section 15270 of Title
14, Chapter 14, Chapter 3 of the California Code of Regulations
(Guidelines for the California Environmental Quality Act).
II. The Planning Commission hereby denies Conditional Use Permit 06-008, a
request to amend the Tustin Auto Center master sign program to allow two
(2) fifteen foot high, six (6) and a half foot wide, entry monument signs with
32 square foot light emitting diode (LED) screens located at the southeast
corner of Tustin Ranch Road and Auto Center Drive and the southeast
corner of EI Camino Real and Auto Center Drive.
