HUSTON, CITY MANAGER FROM: PUBLIC WORKS DEPARTMENT/ENGINEERING DIVISION SUBJECT: ACCEPTANCE OF PUBLIC IMPROVEMENTS AND AUTHORIZATION TO FILE THE NOTICE OF COMPLETION FOR THE TUSTIN RANCH ROAD REHABILITATION BETWEEN 1-5 FREEWAY AND BRYAN AVENUE (CIP NO. 7179), AND THE TUSTIN RANCH ROAD REHABILITATION BETWEEN WALNUT AVENUE AND 1-5 FREEWAY (CIP NO. 7180) SUMMARY Construction of the Tustin Ranch Road Rehabilitation between 1-5 Freeway and Bryan Avenue (CIP No. 7179), and the Tustin Ranch Road Rehabilitation between Walnut Avenue and 1-5 Freeway (CIP No. 7180) have been completed to the satisfaction of the City Engineer and are now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 06-106 accepting the Tustin Ranch Road Rehabilitation between 1-5 Freeway and Bryan Avenue (CIP No. 7179), and the Tustin Ranch Road Rehabilitation between Walnut Avenue and 1-5 Freeway (CIP No. 7180), and authorizing the recordation of the Notice of Completion, and direct the City Clerk to: 1. Release the Labor and Materials Bond not sooner than thirty-five (35) days after the date of recordation of the Notice of Completion; and 2. Release the Faithful Performance Bond not sooner than one year after the date of recordation of the Notice of Completion. Assuming no claims or stop payment notices are filed, it is further recommended that thirty- five (35) days after the date of recordation of the Notice of Completion, the City Council authorize payment of the final 100/0 retention in the amount of $99,189.66 to All American Asphalt. The total final construction contract cost for the project is $991,896.63. Acceptance of Public Improvements and Authorization to File the Notice of Completion for the Tustin Ranch Road Rehabilitation between 1-5 Freeway and Bryan Avenue (CIP No. 7179), and the Tustin Ranch Road Rehabilitation between Walnut Avenue and 1-5 Freeway (CIP No. 7180) September 18, 2006 Page 2 FISCAL IMPACT The final construction contract cost for the Tustin Ranch Road Rehabilitation between 1-5 Freeway and Bryan Avenue (CIP No. 7179) is $517,596.12 and for the Tustin Ranch Road Rehabilitation between Walnut Avenue and 1-5 Freeway is $474,300.51 for a total final construction cost of $991,896.63. The projects were funded by a combination of Gas Tax funds and the City's Capital Improvement Program (CIP Nos. 7179 and 7180) budget. The City has also secured grant funding for these projects from the Orange County Transportation Authority's (OCTA) Combined Transportation Funding Program (CTFP) under the federal Arterial Highway Rehabilitation Program (AHRP). The AHRP matching fund reimbursement in the amount of $510,000 covers eligible construction expenses through the federal program. Project construction, along with design and construction management, has increased the City's infrastructure assets by $1,042,269. The increased infrastructure valuation will be added to the City's infrastructure inventory as required by Statement 34 of the Governmental Accounting Standards Board (GASB 34). Detailed cost information is shown on the attached GASB 34 Infrastructure Inventory Valuation Forms. BACKGROUND AND DISCUSSION The construction of the Tustin Ranch Road Rehabilitation between 1-5 Freeway and Bryan Avenue (CIP No. 7179), and Tustin Ranch Road Rehabilitation between Walnut Avenue and 1-5 Freeway (CIP No. 7180) were completed on July 7,2006. These projects are part of the City's ongoing Maintenance of Effort (MOE) requirement to maintain eligibility for Measure M funding. All of the work for this project has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. Tim D. Serlet Director of Public Works/City Engineer Dana R. Said public works and improvement is more particularly described as follows: Tustin Ranch Road Rehabilitation between 1-5 Freeway and Bryan Avenue (CIP No. 7179), and Tustin Ranch Road Rehabilitation between Walnut Avenue and 1-5 Freeway (CIP No. 7180) BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
