NO. 4472 RESOLUTION NO. 4472 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF TUSTIN, CALIFORNIA, ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR DESIGN REVIEW 2022-0013 AND SUBDIVISION 2022- 0003/TENTATIVE PARCEL MAP 2022-153 AUTHORIZING THE MERGER OF TWO (2)ADJOINING LOTS INTO ONE (1) 7.18-ACRE PARCEL AND THE DEVELOPMENT OF A NEW 148,437 SQUARE-FOOT INDUSTRIAL WAREHOUSE FACILITY LOCATED AT 14321 AND 14351 MYFORD ROAD. The Planning Commission does hereby resolve as follows: I. The Planning Commission finds and determines as follows: A. That a proper application has been submitted by B8 Myford II Industrial Owner LLC, a Delaware limited liability company, requesting authorization to construct a new industrial warehouse facility located at 14321 and 14351 Myford Road to include the following: 1 . The demolition of two (2) existing buildings currently located on the project site; 2. A parcel map merging two (2) parcels into one (1) parcel; 3. Construction of one (1) new industrial warehouse facility totaling approximately 148,437 square feet, including 143,437 square feet of warehouse area, 5,000 square feet of office area and nineteen (19)truck docks; 4. Provision of 103 on-site parking stalls; and 5. Provision of landscaping totaling 37,004 square feet. B. That the Development Application requests the following approvals: • Design Review (DR) 2022-0013 for site layout and building design. • Subdivision Map (SUB 2022-0003 /Tentative Tract Map (TTM No. 2022- 153) — A request to merge two (2) adjoining lots into one (1) 7.18-acre parcel. C. That the subject property is located within the Planned Community Industrial (PC IND) zoning district and regulated by Ordinance No. 611 (Irvine Industrial Complex District Regulations) and has a Planned Community Commercial Business) General Plan land use designation; D. That the City of Tustin prepared an Initial Study to evaluate the potential environmental impacts associated with DR 2022-0013 and SUB 2022-0003/ Resolution No. 4472 Page 2 TPM 2022-153 that concluded potential impacts are at a level of insignificance and a Draft Mitigated Negative Declaration (MND) was prepared. The Draft MND was made available for public review; E. That a Notice of Intent to Adopt a MND was filed with the Clerk of the County of Orange for posting and provided to members of the public using a method permitted under CEQA Guidelines Section 15072(b). The Initial Study and Draft MND were made available for a twenty (20) day public review and comment period from April 20, 2023, to May 10, 2023, in compliance with Sections 15072 and 15105 of the State CEQA Guidelines; F. That public comments were received and a Final MND with responses to submitted comments was prepared and is attached hereto as Exhibit C; G. That whenever a lead agency approves a project requiring the implementation of measures to mitigate or avoid significant effects on the environment, CEQA also requires a lead agency to adopt a Mitigation Monitoring and Report Program (MMRP) to ensure compliance with the mitigation measures during project implementation; H. That the City is the lead agency on the project and the Planning Commission is the decision-making body for the proposed project; �. D That the Planning Commission conducted a duly noticed public hearing on May 23, 2023, to consider the Initial Study, proposed MND along with its MMRP, for DR 2022-0013 and SUB 2022-0003/TPM 2022-153 at which hearing members of the public were afforded an opportunity to comment upon the project; and J. That the Planning Commission has considered the Initial Study/MND, the MMRP, and response to comments received during the public review process, attached hereto as Exhibits A, B and C. II. The Planning Commission hereby adopts the Final MND attached hereto as Exhibit A C and its MMRP attached hereto as Exhibit B for DR 2022-0013, and SUB 2022-0003/TPM 2022-153 relating to a new industrial warehouse facility located at 14321 and 14351 Myford Road. III. That the facts and reasons for said recommendation of adoption of the Initial Study/MND and MMRP are hereby found and declared to be as follows: The Planning Commission, as a result of its consideration and evidence presented at the hearing on this matter, determined that, as required pursuant to CEQA and the State CEQA Guidelines, the MND and MMRP adequately addresses the expected environmental impacts of the project. On the basis of this review, the Planning Commission finds that there is no evidence from which it can be fairly argued that the project will have a significant adverse effect on the environment.
