CALL TO ORDER at 6:00 p.m. ROLL CALL – City Clerk Present: Mayor Austin Lumbard, Mayor Pro Tem Letitia Clark and Council Members Ryan Gallagher, Rebecca Gomez and Ray Schnell Absent: None City Clerk: Erica N. Yasuda, City Clerk Others Present: David E. Kendig, City Attorney; Matthew S. West, City Manager INVOCATION - Deacon Bill Weeks, St. Cecilia Church PLEDGE OF ALLEGIANCE – Council Member Gallagher PRESENTATION – Mayor Lumbard presented a Proclamation to Director of Public Works Douglas S. Stack in recognition of Public Works Week: May 21-27, 2023. PUBLIC INPUT – 1. Roll Call – City Clerk Motion carried: 5-0 1. CONTRACT FOR PROSECUTION SERVICES / ORANGE COUNTY DISTRICT ATTORNEY The Orange County District Attorney's Office prosecutes Penal, Health and Safety, and Vehicle Code violations referred to it by the City of Tustin Police Department. The City may also refer violations of the Tustin City Code to the District Attorney under the parties' current contract for prosecution services. The current agreement, which has been in place since 2008, will expire on June 30, 2023. The District Attorney has prepared a new five-year agreement for prosecution services for approval by the City. If approved, the term of the new agreement would run from July 1, 2023 until June 30, 2028. Motion: Approved and authorized the Mayor to execute the attached Agreement for Prosecution Services with the Orange County District Attorney. LOCAL GOVERNMENT GOVERNANCE & STRATEGIC PLANNING PRESENTATION The City Council received a presentation from Jacob Green and Gregory C. Devereaux with Jacob Green & Associates, Inc (JGA) regarding governance best practice, strategic planning, and models for organizational excellence. Public Input – John Garay COUNCILMEMBER COMMENTS AND REPORTS Council Member Gomez Deferred comments for next meeting. Council Member Schnell Deferred comments for next meeting. Council Member Gallagher Remarked was a fantastic presentation by Jacob Green and Gregory C. Devereaux with Jacob Green & Associates; what was lined out in the presentation explains the mechanics behind the goals which are set that change and transform an organization; is very excited to see the strategic plan move forward. DocuSign Envelope ID: F766E646-20D0-4AB5-BCA4-ECE25F1C48C8 City Council May 16, 2023 Meeting Minutes Page 3 of 4 Shared the idea of an License Plate Recognition (LPR) system originated from a public speaker from Tustin Meadows during a City Council meeting in January; the LPR pilot system would be a good item to bring to the City Council Mayor Pro Tem Clark Thanked the presenters Jacob Green and Gregory C. Devereaux with Jacob Green & Associates for their presentation; thanked the presenters for bringing the context of how City Council operates in different paradigms; is hopeful the presentation will lead the City Council in a fruitful and productive session which can be reported back to the community. Mayor Lumbard Announced agrees with the License Plate Recognition (LPR) concept; will work with city staff and collaborate with City Council to get the policy adopted. MINUTES OF THE SPECIAL CLOSED SESSION MEETING OF THE CITY COUNCIL (Followed Open Session) CLOSED SESSION UPDATE – City Attorney David E. Kendig: The Council will convene to discuss Items 1 and 2 as they appear on the Closed Session Agenda. Recessed at 6:49 p.m. CLOSED SESSION ITEMS - The Brown Act permits legislative bodies to discuss certain matters without members of the public present. The City Council finds, based on advice from the City Attorney, that discussion in open session of the following matters will prejudice the position of the City in existing and anticipated litigation: 1. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION - Significant exposure to litigation pursuant to Government Code § 54956.9(d)(2): (2 cases) 2. PUBLIC EMPLOYEE ANNUAL PERFORMANCE EVALUATION - [Government Code § 54957(b)(1)] A. Title: City Manager Reconvened at 8:25 p.m. CLOSED SESSION REPORT – City Attorney David E. Kendig: The Council took no reportable action. ADJOURNED at 8:26 p.m. The next meeting is scheduled on Tuesday, May 23rd at 2:30 pm for the Budget Workshop.
