SUBJECT: ADOPTION OF A RESOLUTION UPDATING THE COMPREHENSIVE FEE SCHEDULE
SUMMARY:
The City's Comprehensive User Fee Study, which was completed in May 2021
determined the cost of providing governmental services and ensured that user fees and
charges do not exceed the costs of providing these services at the time of the study.
Industry best practices recommend that annually, the user fees be reviewed and updated
to ensure that the user fees are consistent with the cost of living and/or to reflect any
operational changes. Staff has completed this annual review and compiled an updated user
fee schedule (attachment 1). Staff recommends that the City Council proceed with a public
hearing to consider the adoption of the updated fees if approved, which will take effect on
September 1, 2023.
RECOMMENDATION:
1. Conduct a public hearing on the proposed adoption of an update to the City's
Comprehensive Fee Schedule; and,
2. Adopt Resolution No. 23-30, Establishing and Adopting Updated Development
Processing Fees and Other City Rates, Charges, and User Fees for Various
Government Services.

The recommendation correlates to the City's strategic plan by implementing Goal C, strategy
#3a, conduct a comprehensive fee analysis and determine appropriate levels of cost
recovery.
DISCUSSION:
The City charges a range of fees for services provided to residents and businesses and
for access to public property. Examples of fees include building permits, encroachment

permits, plan check fees, recreation classes, facility rentals, etc. Industry best practices
recommend that a comprehensive review of the cost of services and fees be performed
every three to five years and a review based on the cost -of -living adjustment and/or
operation changes be performed annually. The City's last comprehensive user fee study
was conducted in May 2021 and the related user fee schedule was approved by the City
Council in July 2021. Subsequently, staff conducted one annual review of user fees and
it was approved by the City Council in June 2022. For the 2023 annual user fee review,
the City retained Willdan Financial Services to update the Comprehensive Fee Schedule
based on changes to the Consumer Price Index (CPI) reported for the month of February
for the corresponding year for the Los Angeles -Long Beach -Anaheim area for all Urban
Consumers. This annual CPI change from February 2022 to February 2023 was 5.1 %,
Staff is proposing an increase of 5% for applicable user fees, which is consistent with the
year -over -year increase in citywide salaries and benefits costs. Staff is projecting a
$90,000 increase in General Fund revenues associated with this CPI change to the
Schedule of Fees. The updated 2023 fully burdened hourly rate schedule (attachment 2)
is included with this report.
The scope of the May 2021 User Fee Study included a review and calculation of the cost of
providing services and the related fees charged by the following departments and divisions:
City Clerk, Economic Development, Finance/Water Billing, Parks & Recreation, Community
Development (Building and Planning), Public Works (Engineering), and Police Services.
The scope of the study did not include a review of taxes, development impact fees, or water
utility rates.
The User Fee Study primarily uses a cost of service analysis to calculate a reasonable
cost of each service provided by the City. The cost of service analysis compiles the full
cost of providing each service, considering direct and indirect costs. In some instances,
user fees and charges were based on market factors or other considerations. For
example, rental fees are based on some level of cost basis but are generally set based
on comparable market rates. Fines and penalties are discretionary and are set to either
enforce laws and internal policies or to encourage or discourage the behavior. The study
also includes fees that are set on a deposit basis. Deposits are set at reasonable levels
based on the complexity of the activity. City staff records time against the deposit along
with any other costs associated with the activity.
Certain fees within the Building Division are valuation -based, which utilize industry -known
and accepted valuation -based methodologies. Valuation -based methodologies are based
on the general understanding that the larger a project, the more staff time is involved, and
the more complex the building type, the more staff time is involved. The value of land is
not included in the valuation methodology. The valuation is based on an average square
foot cost of construction, which helps to mitigate variances caused by construction
materials used.
Fees that provide a community -wide benefit are recommended to remain at amounts less
than the full cost of service. Therefore, many of the fees associated with Parks and

Recreation have been recommended to be less than the full cost of the service. On the
other hand, services that directly benefit private development should not be subsidized
by City taxpayers. Therefore, full cost recovery is recommended for most fees related to
planning, building, and engineering -supported programs. The citywide Preferential Permit
Parking Program fees approved by the City Council on June 6, 2023, will be incorporated
into the Comprehensive Fee Schedule upon its adoption.
The proposed Comprehensive Fee Schedule includes several new fees that are outlined
below. Most of the new fees are deposit -based with a few fees that reflect actual costs.
Any new fees that are not deposit -based were derived using the same methodology that
was outlined in the User Fee Study, whereby the user fee was set considering the full
cost of providing each service, considering the direct and indirect costs.

These fees were removed because they were either not needed or were combined with an
existing fee.
The public hearing was noticed on June 8, 2023, and June 15, 2023. The City Clerk's
Office has already noticed interested parties. The recommended fees and charges have
been incorporated into the proposed Comprehensive Fee Schedule, which is attached
hereto as Exhibit "A" to Resolution 23-30, If approved, the updated Comprehensive Fee
Schedule will take effect on September 1, 2023.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN,
CALIFORNIA, ESTABLISHING AND ADOPTING UPDATED
DEVELOPMENT PROCESSING FEES AND OTHER CITY RATES,
CHARGES, AND USER FEES FOR VARIOUS GOVERNMENT SERVICES
The City Council of the City of Tustin, California, hereby finds, determines,
declares, and resolves as follows:
WHEREAS, pursuant to the provisions of the California Constitution and the laws
of the State of California, the City of Tustin is authorized to adopt and implement fees, rates, and
charges for municipal services; provided that such fees, rates, and charges do not exceed the
estimated reasonable cost of providing such services; and
WHEREAS, in 2020 the City retained Willdan Financial Services to review and
conduct an independent, detailed analysis of City Services, the cost reasonably borne by
providing those services, the beneficiaries of those services, and the revenues produced by those
paying fees for those services, and to prepare a study and report setting forth the specific amount
of user fees, rates, and charges; and
WHEREAS, Willdan Financial Services prepared the study and report, listing the
applicable direct and indirect costs for certain services provided by the City, describing the
reasonable relationship between fees, rates, and charges and the services provided by the City,
and setting forth the time and method for the payment of the fees, rates, and charges, which is
identified as the "Comprehensive User Fee Study Report", dated May 24, 2021, copies of which
are on file in the City Clerk's office; and
WHEREAS, on July 20, 2021, the City Council adopted Resolution No. 21-54, which
approved and adopted the processing fees and other user rates, charges, and fees identified in
the Comprehensive User Fee Study Report and set forth in the Comprehensive Fee Schedule; and
WHEREAS, in 2023 the City retained Willdan Financial Services to update the 2022
Comprehensive Fee Schedule based on changes to the Consumer Price Index (CPI) reported in
the month of February for the corresponding year for the Los Angeles -Long Beach -Anaheim area
for all Urban Consumers; and
WHEREAS, the City of Tustin desires to implement new deposit -based fees, online
credit card convenience fees, processing fees, and other user fees, rates, and charges for various
government services and to approve increases to existing processing fees, and other user fees,
rates, and charges for various governmental services in accordance with the CPI reported in the
month of February for the corresponding year for the Los Angeles -Long Beach -Anaheim area for
all Urban Consumers; and

WHEREAS, the annual change from February 2022 to February 223 in the
Consumer Price Index (CPI) for the LA -Long Beach -Anaheim area was 5.1%. However, the
updated fee schedule reflects an increase of only 5%, which is consistent with the year -over -year
increase in citywide salaries and benefits costs; and
WHEREAS, pursuant to Government Code Section 66014, 66017, and 66018, the
specific user fees to be charged for certain services must be adopted by Resolution, following
notice and Public Hearing; and
WHEREAS, a notice of Public Hearing has been given pursuant to Government
Code Section 6062a, oral and written presentations have been made and received, and the
required Public Hearing has been held; and
WHEREAS, all legal prerequisites to the adoption of this Resolution have occurred.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA,
DOES RESOLVE AS FOLLOWS:
SECTION 1. Adoption and Incorporation of Recitals. The recitals set forth above are true
and correct and are incorporated by reference herein.
SECTION 2. Adoption of User Fees. The City Council hereby approves and adopts the
deposit -based fees, online credit card convenience fees, processing fees, and other user rates,
charges, and fees set forth in the Comprehensive Fee Schedule, which is attached hereto as
Exhibit "A" and incorporated herein by reference; the City Council finds that the user fees and
charges established herein do not exceed the estimated reasonable cost of providing the service
for which the fee is levied.
SECTION 3. Wavier and Reduction of Fees. The City Council hereby authorizes the City
Manager, at his/her discretion, to waive or reduce the processing fees and other user rates,
charges, and fees set forth in the Comprehensive Fee Schedule on a case -by -case basis provided
the City Manager commits to writing the reason(s) why any such waiver or reduction provides a
public benefit including, but not limited to, the promotion of public health, safety, and welfare.
SECTION 4. Repeal of Conflicting Resolutions. Any and all provisions of prior Resolutions
of the City Council establishing, adopting, or modifying user fees and charges for the specific
services, programs, or products set forth in Exhibit "A" attached hereto, including, but not limited
to, Resolution No. 22-21, are hereby repealed and replaced as of the effective date of the user
fees and charges established herein; provided, however, that such repeal shall not excuse or
affect the failure of any person or entity to pay any fee heretofore imposed upon such person or
entity.
SECTION 5. Effective Date. The user fees and charges established pursuant to this
Resolution shall take effect and shall be implemented on September 1, 2023.

SECTION 6. Annual Update. The City Council hereby authorizes and directs the City's
Finance Director to annually review and, as appropriate, recommend to the City Council approval
of an increase of the fees set forth in the Comprehensive Fee Schedule in accordance with the
Consumer Price Index (CPI) reported in the month of February/March for the corresponding year
for the Los Angeles -Long Beach -Anaheim area for all Urban Consumers.
SECTION 7. Environmental Exemption. The adoption of this Resolution is exempt from the
California Environmental Quality Act ("CEQA") pursuant to Section 15273 of CEQA Guidelines and
Section 21080(b)(8) of the Public Resources Code; and in accordance with such determination,
City staff is hereby directed to file a Notice of Exemption upon adoption of this Resolution.
SECTION 8. Severability. If any user fee, rate, or charge adopted or increased by this
Resolution is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such fee, rate, or charge shall be deemed a separate, distinct, and
independent provision of this Resolution, and such holding shall not affect the validity of the
remaining user fees, rate, and charges adopted or revised herein. The City Council hereby
declares that it would have adopted the Resolution and each section, subsection, subdivision,
sentence, clause, phrase, or portion thereof, irrespective of the fact that any or more sections,
subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared invalid or
unconstitutional.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of Tustin held
on the 20t" day of June 2023.

modifications which constitute a change in 3 or more major design
elements on a building elevation or site which result in a complete
fagade upgrade. Definition of an element includes windows, doors,
colors, materials, parking lot changes, etc.
MINOR REMODEL: Modifications to existing structures which include an increase in
existing floor area of 50% or less (including expansions for outdoor
dining), and/or existing fagade or site modifications which
constitute a change in 3 or less major design elements which do not
result in a complete fagade upgrade, single family homes not part of
a subdivision, residential room additions, and new or modified
accessory structures associated with existing development.
VARIANCES
MAJOR VARIANCE: New development that deviates from a specific development
standard, all existing development which deviates from a standard
by more than 10%.
MINOR VARIANCE: Existing development that deviates from a specific development
standard by 10% or less, new single-family homes not part of a
subdivision, or projects where the site will contain less than 3 new
apartments or new condominiums.

FINANCE
BUSINESS LICENSE TAX FEES
(Ordinance No. 1270; 2003)
Every person who engages in business within the City of Tustin and/or has an established place
of business within the City limits shall pay a license tax based upon the gross receipts
of business done within the City, unless otherwise specified in the City Code (see enumerated
business below). Gross receipts shall be based on the prior years' receipts, or in the case of a
new business, calculated on current year's estimates.
Payment of business license fee and/or approval of business license does not waive or preclude
any other licenses or permits required by Tustin City Code. The license tax period is calendar year
January 1 through December 31. Pro -rated fees for new businesses are effective April 1, July 1
and October 1. For failure to pay the license tax when due, a penalty will be added of twenty-five
percent (25%) of such license tax on the last day of each month after the due date thereof,
provided that the amount of such penalty shall not exceed one hundred percent (100%) of the
amount of the license tax due.
STATE FEE (AB 2164)
Per California Government Code Section 4467, all business license applications or renewals are
subject to a state mandated $4.00 State of California Disability Access and Education Fee.
