The existing vacant restaurant (former Oggi's Restaurant) would be replaced with a new commercial building for a Farmers and Merchants Bank, and the site and building design and Layout for the new bank building are subject to Community Development Director Design Review (DR) 2022-0031. In part to this effort, obtaining approval for CUP 2023-0009 is a condition of approval for the DR application The Large format graphic will be composed of fifteen (15) custom Laser-cut aluminum mesh panels measuring six (6) feet by twelve (12) feet for a total of 1,080 square feet as shown in blue in Figure 2 below. Elg Proposed ... Graphic_ — Location — -----. -- _ m - - Figure 2 — Northwest Elevation Each panel would be etched with circles of varying diameters that collectively would display an image representing neoclassical architecture as depicted in the rendering shown on Figure 3 (Attachment A). These perforated metal screens would add contrast and visual interest to an otherwise unarticulated building fagade, subtly displaying the appearance of a painted Like image, and would convey a neoclassical themed art inspired image on a prominent building elevation visible from Newport Avenue. The neoclassical architectural image will pay homage to the architectural style used for Farmers and Merchants Banks between the years 1900-1920. APPROVAL AUTHORITY: Murals or graphics which do not promote a product or business, but which depict a scene or image, are subject to a Conditional Use Permit (CUP) and Zoning Administrator review and approval pursuant to Section 9299b(3)(k) of the Tustin City Code (TCC). ENVIRONMENTAL REVIEW: This project is Categorically Exempt pursuant to Section 15311 (Class 11) of the California Code of Regulations (Guidelines for the California Environmental Quality Act). This exemption addresses construction of accessory structures including on-premises signs. RECOMMENDATION: Analysis of CUP 2023-0009 has determined that the enhancement of the exterior fagade with etched graphics will not be detrimental to the health, safety, morals, comfort, or general welfare of the persons residing or working in the neighborhood, nor be injurious or detrimental to the property and improvements in the neighborhood of the subject property, or to the general welfare. Based on the findings and Conditions of Approval contained in ZAA 23-004, staff recommends that the Zoning Administrator adopt ZAA 23-004, approving CUP 2023-0009, a request to incorporate a large-format graphic on the northwest elevation of a new building proposed at 13612 Newport Avenue.
