INVOCATION: Pastor Michael Truong, Mariners Church Given. PLEDGE OF ALLEGIANCE: Commissioner Douthit Present. ROLL CALL: Chair Kozak Chair Pro Tern Higuchi Commissioners Mello, Douthit, and Mason Wi[[kom Willkom stated, on behalf of former Commissioner Chu, her appreciation for the Certificate of Appreciation. Due to her work schedule, Chu was unable to attend the meeting. PUBLIC INPUT: Hurtado Hurtado confirmed no public input received. Approved the May 9, CONSENT CALENDAR: 2023 meeting minutes 1. APPROVAL OF MEETING MINUTES — MAY 9, 2023 RECOMMENDATION: That the Planning Commission approve the Minutes of the May 9, 2023 Planning Commission meeting, as provided. Hurtado Hurtado confirmed no public input received. Motion: It was moved by Mello, seconded by Higuchi, to approve the Minutes of the May 9, 2023 Planning Commission meeting. Motion carried 5-0. Minutes— May 23, 2023 - Page 1 of 8 PUBLIC HEARING: AdoptedPeso. No. 2. DESIGN REVIEW (DR) 2022-0013, SUBDIVISION (SUB) 2022- 4472&4473, as 0003, TENTATIVE PARCEL MAP (TPM) 2022-153 amended. APPLICANT: B8 MYFORD II INDUSTRIAL OWNER, LLC PANATTONI DEVELOPMENT COMPANY, INC. ATTN: MICHAEL SIZEMORE 2442 DUPONT DRIVE IRVINE, CA 92612 PROPERTY B8 MYFORD II INDUSTRIAL OWNER, LLC OWNER: ATTN: JACOB R. LEBLANC 2442 DUPONT DRIVE IRVINE, CA 92612 LOCATION: 14321 AND 14351 MYFORD ROAD ENVIRONMENTAL: A Mitigated Negative Declaration (MND) has been prepared in accordance with the provisions of the California Environmental Quality Act (CEQA) Article 6 of California Code of Regulations, Title 14, Chapter 3. REQUEST: A request to demolish two (2) existing buildings, combine two (2) existing parcels into one (1) parcel, and construct a new 143,437 square foot industrial warehouse facility. RECOMMENDATION: 1. Adopt Resolution No. 4472 finding the MND adequate for DR 2022- 0013 and SUB 2022-0003/TPM 2022-153 for the proposed project at 14321 and 14351 Myford Road. 2. Adopt Resolution No. 4473 approving the following: • DR 2022-0013 for site layout and building design of a new 148,437 square foot industrial warehouse building on approximately 7.18 acres located at 14321 and 14351 Myford Road; and • SUB 2022-0003/TPM 2022-153 to merge two (2) adjoining parcels into one (1) parcel located at 14321 and 14351 Myford Road. Minutes— May 23, 2023 - Page 2 of 8 Carver Presentation given. 7-19 p.m. Opened the Public Input portion of the meeting. Ms. CaseyKelle Ms. Casey Kelle, representative of Young's Holdings, voiced her concern with flooding/drainage issue that may impact her client's property, which is Located immediately behind the proposed project site. Mr. Michael Mr. Michael Sizemore, representative of the applicant, commended City staff Sizemore for their assistance throughout the application process. In response to Ms. Kelle's concern with the drainage issue, Mr. Sizemore informed the Commission that the civil engineer for the project, Brian Thienes (Thienes Engineering), was also in attendance and could address her concern with drainage. Higuchi Higuchi asked about the existing conditions for hydrology and WQMP and if there were existing catch basins at the project site as well as the location. Mr. Brian Mr.Thienes stated that the flooding, which recently occurred on an adjacent Thienes property near the proposed project site, was planned. The existing storm drain system can process stormwater from a 25-year storm event (4% chance of occurring). Due to the deficiency of the existing storm drain system,the project was designed to constrict drainage so that it would pond in the truck yard and not send any water downstream. The engineer will be using the exact same design for the proposed project where there are two (2) orthree (3) existing catch basins, butthere is no wayto contain the water. Mr. Thienes explained in detail, the stormwater containment process of the 100-year storm event relative to the new development. Higuchi Higuchi reconfirmed with the applicant that the new design would address the 100-yearflood event, as well as address a 25-yearflood event. He also mentioned the flooding across Young's Market. Higuchi asked if there is an easement for drainage purposes along with stormwater treatment prior to the water leaving site. Mr. Thienes Mr. Thienes' response to Higuchi's Young's Market comment, was there is no requirement to contain the stormwater onsite. The design of the existing site does not provide for stormwater containment. He stated there is no easement providing for the drainage conditions and that the applicant and engineer are now trying to correct the condition through infiltration devices. Mr. Thienes also explained, in detail, the stormwater system. Minutes— May 23, 2023 - Page 3 of 8 Mello Mello asked about the negotiations with Kitz Nation due to the work that will occur onsite and the possibility of encountering tribal remains. He also asked at what point does Kitz Nation monitor the site. He also asked the applicant if a tenant was identified for the project site. Mello then asked staff how circulation (i.e. truck traffic) would be addressed as well as the industrial area when there is growth. Mr. Michael In response to Mello's question regarding the mitigation for tribal remains or Sizemore artifacts at the site, Mr. Sizemore stated that Kitz Nation provided conditions to the applicant if any remains were to be found and that they are able to monitor during the ground disturbing phase up until the tribal monitor decides there is no further need for monitoring. Mr. Sizemore stated he does not yet know who the tenant will be. Per the applicant, the design of the site is a starting point and that the proposed project could be used for a warehouse distribution user and the site can be accommodated for a variety of different users. Barragan In response to Mello's question regarding circulation, Barragan, referred to the General Plan. The circulation element provides for industrial related roadway infrastructure which is already in place and would support the land uses in the proposed project area. Additionally, Walnut Avenue is nearing the end of its seven (7) year maintenance cycle and will be part of Public Works' subsequent three (3) annual major roadway maintenance cycles. The truckloads on Walnut Avenue west of Tustin Ranch Road are limited to six (6) thousand pounds. Barragan added thatthe General Plan provides for these types of industrial uses both in the circulation element and the land use element. Nishikawa Nishikawa's response to Mello's previous question generally included overall: the cycle for the entire City is a seven (7) year cycle (i.e. major CIP projects for Tustin Ranch Road, Red Hill Avenue) due to wear and tear of the roads; special CIP projects have to be addressed (i.e. Red Hill Avenue); and Tustin Ranch Road will be addressed when needed. Higuchi Higuchi asked if the proposed project is being paid with impact fees or if there is credit from the existing building. Mr. Michael Mr. Sizemore stated the proposed project is receiving credit for the existing Sizemore building toward the development impact fees, school fees and the Toll Road Minutes— May 23, 2023 - Page 4 of 8 Corridors.The calculation accounts for proposed project square footage less the existing square footage on-site. Mason Mason asked if a traffic study would be included in the proposed project. Wi[[kom WiRom stated if the proposed use changes then the City has the ability to review not only the traffic study but also parking and any other amenities that may be required to accommodate the use. Huitron Huitron referred the Commission to the Project Trip Generation Memo, which was part of the appendices to the MND, and does evaluate the speculative building at its most intense use and is already being designed from a parking perspective and analyzed as a trip generation perspective. It is unlikely that any future tenants will require a traffic study, but staff would ensure through the business license review process that future tenants comply with any entitlements that may be approved by the Commission. 7.39 Closed the Public Input Portion of the Meeting. Douthit Douthit thanked the Thienes for the thorough plan and for addressing the Commission's comments/concerns. Douthit provided favorable comments for staff and the applicant for this thoughtful project. Mason Mason also provided favorable comments regarding the project and recommendation. Higuchi Higuchi's final comments generally included: the lower impact fees; good project; fixing the existing problem at this site; and his concern that this should have been a CEQA exempt project except for the fact that tribal consultation and mitigation measures were included. Mello Mello's final comments generally included: great project— reinvestment in the community; concern with truck traffic in the area; need to address traffic concern and keep the streets in good condition. Motion: It was moved by Mason, seconded by Mello, to adopt Resolution Nos. 4472, as amended and 4473. Motion carried 5-0. Minutes— May 23, 2023 - Page 5 of 8 REGULAR BUSINESS: Adopted Reso. 3. FISCAL YEAR 2023-2024 CAPITAL IMPROVEMENT PROGRAM No. 4474, as FINDING OF CONFORMANCE WITH THE GENERAL PLAN presented. Under Section 65401 of the California Government Code, the Planning Commission is to review the list of proposed public works projects recommended for planning, initiation or construction during the ensuing year and report to the City Council as to conformity with the General Plan. RECOMMENDATION: That the Planning Commission adopt Resolution No. 4474 finding the proposed FY 2023-2024 Capital Improvement Program in conformance with the General Plan pursuant to Section 65401 of the California Government Code. Nishikawa Presentation given. Higuchi Higuchi asked if Rule 28 is funded by the City. He asked if the funding covers both transmission lines and communication lines. Higuchi also asked if the City has an undergrounding ordinance. Nishikawa In response to Higuchi's question, Nishikawa stated Rule 28 is funded by Southern California Edison. No contribution from the City except for the costs for the City's dry utility consultant. The Rule 28 funding could be used for any undergrounding utilities. Wi[[kom In response to the undergrounding ordinance, Willkom stated the City does have an ordinance in place. All new development will be required to place all of the utilities underground with certain exemptions for single-family homes. Douthit Douthit referred to traffic signal synchronization on Red Hill Avenue and if the speed limit would be affected. Nishikawa In response to Douthit's question, Nishikawa stated the synchronization should help the synchronization of the traffic on Red Hill Avenue, but there will not be any changes to the speed Limits (signals at 1-5 still controlled by Caltrans). Minutes— May 23, 2023 - Page 6 of 8 Mello Mello asked Nishikawa if the City has any long-term plans for underground utilities. He asked about the paving being done in Tustin Meadows. Mello also commented on the trees replaced in Tustin Meadows. Nishikawa Per Nishikawa, the transmission lines are tremendously expensive on Red Hill Avenue and currently, there has been no discussion about the topic. As for the paving, yes, it would be complete in Tustin Meadows and on Red Hill Avenue. Some streets may only need slurry seal if they are in "good condition." Nishikawa stated the City has an arborist on staff who takes into consideration the following when inspecting trees: longevity, disease prevention, pests, root issues, etc. Mason Mason asked if there are any plans for Tustin Branch Trail and connecting the trail through to the Old Town area. Nishikawa Nishikawa was not aware of any plans for the Tustin Branch Trail. He stated he would look into it further. Higuchi Higuchi asked about Heideman Park progress since on the CIP list. Nishikawa Nishikawa stated he spoke to Chad Clanton, Director of Parks and Recreation, regarding Heideman Park. They are still working on the Joint Use Agreement with Tustin Unified School District, so the design has not yet started, but Clanton is anticipating construction will commence in 2025. The project is slated to be a public and school joint use park. Mello Mello commented on the Armstrong Bridge and anti-graffiti concrete. Motion: It was moved by Mello, seconded by Mason, to adopt Resolution No. 4474. Motion carried 5-0. STAFF CONCERNS: Wiiikom No concerns.
