APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL HELD ON JUNE 6, 2023 Motion: The City Council approved the Action Minutes of the Regular Meeting of the City Council held on June 6, 2023. 3. RATIFICATION OF PAYROLL AND DEMANDS The City Council has approved the use of Government Code Section 37208 to expedite the payment of City of Tustin obligations that are in accordance with the approved budget or continued operations authorizations. Motion: The City Council approved Payroll in the amount of $936,418.97 and Demands in the amount of $2,511,596.26. 4. LEGISLATIVE UPDATE Staff and the City's consultant Townsend Public Affairs (TPA) have prepared a summary of state legislative activity. Motion: 1. Took a SUPPORT position on AB 573 (Garcia) Organic waste: meeting recovered organic waste product procurement targets. 2. Took an OPPOSE UNLESS AMENDED position on AB 1082 (Kalra) Authority to remove vehicles. 3. Received and filed the updated legislative matrix as of June 9. 4. AMENDMENT NO. 14 TO CONSULTANT SERVICES AGREEMENT WITH SO CAL SANDBAGS INC FOR PROPERTY MANAGEMENT/CARETAKER SERVICES AT TUSTIN LEGACY Amendment to existing Consultant Services Agreement (CSA) with So Cal Sandbags, Inc. Motion: The City Council authorized the City Manager to execute Amendment No. 14 to the CSA with So Cal Sandbags, Inc. 6. APPROVE THE ANNUAL OC GO (MEASURE M2) ELIGIBILITY SUBMITTAL PACKAGE, FISCAL YEAR 2023-2024 In order to maintain eligibility to receive OC Go (also known as Orange County Measure M2 Program) funding, the City is required to annually submit a compliance package to the Orange County Transportation Authority (OCTA). Approved the City's Resolution No. 23-23 informing the OCTA that there have been no changes to the City's Circulation Element of the General Plan and that it is consistent with the Master Plan of Arterial Highways and that the City concurs with the Mitigation Fee Program for new development; and 3. Approved the City's Resolution 23-24 for the Local Signal Synchronization Plan Update; and 4. Approved Resolution No. 23-25 informing the OCTA that the City updated a Pavement Management Plan that is in conformance with the OCTA format; and 5. Authorized the Director of Public Works/City Engineer to submit the City of Tustin's Measure M2 eligibility package to the OCTA. RESOLUTION NO. 23-35 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA APPROVING PLANS AND SPECIFICATIONS FOR THE RED HILL AVENUE PAVEMENT REHABILITATION PROJECT BETWEEN SAN JUAN STREET AND MELVIN WAY, CIP NO. 70220, AND AUTHORIZING ADVERTISEMENT FOR BIDS 9. SECOND READING AND ADOPTION OF ORDINANCE NO. 1535 (CODE AMENDMENT 2023-0003) — DENSITY BONUS ORDINANCE AND ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS ORDINANCE UPDATES Adoption of Ordinance No. 1535 amends Tustin City Code Sections 9112 and 9121(a), adds Section 9126 relating to incentives for the development of affordable housing, and amends Sections 9279 and 9297 relating to Accessory Dwelling Units and Junior Accessory Dwelling Units. Motion: The City Council had second reading by title only and adoption of Ordinance No. 1535. ORDINANCE NO. 1535 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, AMENDING TUSTIN CITY CODE (TCC) SECTIONS 9112 AND 9121(a), AND ADDING TCC SECTION 9126 RELATING TO INCENTIVES FOR THE DEVELOPMENT OF AFFORDABLE HOUSING, AND AMENDING TCC SECTIONS 9279 AND 9297 RELATING TO ACCESSORY DWELLING UNITS AND JUNIOR ACCESSORY DWELLING UNITS (CODE AMENDMENT 2023-0003) PUBLIC HEARING ITEM 10 10. ADOPTION OF A RESOLUTION UPDATING THE COMPREHENSIVE FEE SCHEDULE The City's Comprehensive User Fee Study, which was completed in May 2021 determined the cost of providing governmental services and ensured that user fees and charges do not exceed the costs of providing these services at the time of the study. Industry best practices recommend that annually, the user fees be reviewed and updated to ensure that the user fees are consistent with the cost of living and/or to reflect any operational changes. Staff has completed this annual review and compiled an updated user fee schedule (attachment 1). Staff recommends that the City Council proceed with a public hearing to consider the adoption of the updated fees if approved, which will take effect on September 1, 2023. Roll Call — City Clerk Motion carried: 5-0 RESOLUTION NO. 23-30 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TUSTIN, CALIFORNIA, ESTABLISHING AND ADOPTING UPDATED DEVELOPMENT PROCESSING FEES AND OTHER CITY RATES, CHARGES, AND USER FEES FOR VARIOUS GOVERNMENT SERVICES REGULAR BUSINESS ITEMS 11 -12 11. FISCAL YEAR 2023-2024 BUDGET ADOPTION On May 23, 2023, the City Council conducted a budget workshop on the Proposed Biennial Operating Budget and Capital Improvement Program for Fiscal Years 2023- 2024 and 2024-2025, which allocate resources that reflect the City Council's priorities. City Manager, Matthew S. West, introduced the proposed budget and Director of Finance, Jennifer King, provided a PowerPoint presentation. Public Input — Michele Mallonee It was moved by Mayor Pro Tern Clark and seconded by Council Member Gomez to direct staff to look at grant funding to support the Climate Action Plan portion of the General Plan Update. Substitute Motion: It was moved by Mayor Lumbard to approve staff's recommendation: 1. Adopt Resolution No. 23-34, Adopting the first year (Fiscal Year 2023-2024) of the 2023-2025 Biennial Budget and Related Documents for Fiscal Year 2023-2024; 2. Adopt Tustin Housing Authority Resolution No. 23-01, Adopting the Housing Authority Budget for Fiscal Year 2023-2024; City Council June 20, 2023 Meeting Minutes Page 8 of 13 DocuSign Envelope ID: 63A42991-01B5-4C3D-A20E-28CA97933E8E 3. Adopt Resolution No. 23-33, Updating the Citywide Salary Schedule and the Position Control Schedule consistent with the Proposed Budget for Fiscal Year 2023-2024; and, 4. APPROPRIATION LIMIT FOR THE FISCAL YEAR 2023/24 Article XIII B of the State Constitution requires each City to annually adopt a limit on appropriations for all governmental funds. Stack, Director of Public Works, and his staff for their hard work; was a great event. May 29 Attended the Memorial Day Remembrance Ceremony, along with Mayor Pro Tern Letitia Clark, to recognize all the Veterans and Service Members; was a wonderful event. June 2 • Attended the Tustin Area Man and Woman of the Year event; congratulated Kurt Bensworth and Sharon King on their award; thanked them for their volunteerism and dedicated service to the Tustin community. • Met with Virgin Galactic; they requested to be more involved with the Tustin community and with the Tustin Unified School District; will connect Virgin Galactic with Dr. Mark Johnson, Superintendent of the Tustin Unified School District. .hinP 17 Attended the Ribbon Cutting ceremony for the Tustin Legacy Animal Hospital, beautiful new facility. June 15 • Attended the Tustin Chamber of Commerce, Business Recognition Luncheon at the Marconi Automotive Museum with Council colleagues; thanked everyone who was involved with the planning of the event, was a great event; congratulated all the businesses; requested to have information on the event on the City's website. • Congratulated the Tustin Meadows Tiny Tots Parent Cooperative Preschool program for their fifty (50) plus years of service to the community. • Attended the Orange County Mosquito and Vector Control District Board meeting; two (2) presentations were given: o First presentation was on the West Nile Virus response for 2023; watched the video 'Just One Bite'; video showed the impacts of the West Nile Virus to the community; video link is: www.Voutube.com/watch?v=CBP sDCMwr4; and o Second presentation provided information on the District's Pool and Schools program and the proactive work District staff does to identify and address potential out of service pools in the community which can be big mosquito breeding grounds; they also did a schools program which began in 2023 and the staff were able to inspect all public schools in Orange County to identify potential mosquito breeding sources; will begin the process of looking at private schools next year. Business item was approving the cancellation of the July Board meeting; announced National Mosquito Control Awareness Week, observed June 18 — 24, 2023; the Communication's staff have started a comprehensive summer campaign; District staff had a full staff meeting to discuss goals and begin the process of a new Strategic Planning cycle; please visit www.ocvector.org for more information. June 16 Attended the Tustin Area Senior Center Father's Day Luncheon; was a well -attended event; the seniors enjoyed dancing to a three (3) piece live band. June 17 Shared that the Tustin Community Foundation held their Sip & Stroll event in Old Town Tustin; heard many positive comments regarding the event; thanked the Tustin Community Foundation and the volunteers for hosting the event. Council Member Gallagher June 7 Attended the Orange County Sanitation District Operations Committee meeting. June 14 Attended the Orange County Sanitation District Administration Committee meeting; discussed finalization of the Strategic Plan; also discussed updating the procurement limits for the General Manager and on -call contracts, something that has not been done in thirty (30) years; this update was a move towards efficiency; it streamlines the process and cuts down on procurement from three (3) months to one (1) month. June 15 Attended the Tustin Chamber of Commerce, Business Recognition Luncheon at the Marconi Automotive Museum with Council colleagues. Mayor Pro Tem Clark Shared that in 1999, she was a contestant in the Miss Tustin program; has witnessed the program change and grow through the years; the program has become more diverse; have had many Miss Tustin winners be women of color; platforms contestants have adopted have been on substantial issues from equal pay to domestic violence; the program focuses on body positivity and women empowerment; it's a great program, geared around scholarships; would like to advocate for the support of the program. Mayor Lumbard Mentioned for Item No. 11 Fiscal Year 2023-2024 Budget Adoption, two (2) positions were added to the Police Department; one (1) of the positions was a second School Resource Officer position; thanked City staff for adding the position. June 8 Attended the Transportation Corridor Agencies (TCA) Joint Board of Directors meeting. June 14 • Attended the Orange County Fire Authority (OCFA) Budget and Finance Committee meeting; adopted the California Governor's Office of Emergency Services (Cal OES) Fire Integrated Real -Time Intelligence System (FIRIS) Program; FIRIS is a public - private partnership program that provides real-time intelligence data and analysis on emerging disaster incidents in California; is a partnership with Cal Fire and University of California San Diego (UCSD).
