STACK, DIRECTOR OF PUBLIC WORKS/CITY ENGINEER SUBJECT: ADOPT RESOLUTION NO. 23-37 TO ACCEPT IMPROVEMENTS FOR THE TUSTIN LEGACY NEIGHBORHOOD "D" SOUTH PHASE 1 INFRASTRUCTURE BACKBONE (CIP NO. 70246) AND NON -BACKBONE (CIP NO. 70250) CONSTRUCTION PROJECT, AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the Tustin -Legacy Neighborhood "D" South Phase 1 Infrastructure Backbone (CIP No. 70246) and Non -Backbone (CIP No. 70250) Construction Project has been completed by R.J. Noble Company to the satisfaction of the City Engineer and is now ready for City Council acceptance. RECOMMENDATION It is recommended that the City Council take the following actions: Adopt Resolution No. 23-37 accepting the construction of the Tustin -Legacy Neighborhood "D" South Phase 1 Infrastructure Backbone (CIP No. 70246) and Non - Backbone (CIP No. 70250) Construction Project, and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for The Tustin -Legacy Neighborhood "D" South Phase 1 Infrastructure Backbone (CIP No. 70246) and Non -Backbone (CIP No. 70250) Construction Project is $12,830,180.55, including authorized contract change orders. The contract change orders are comprised of miscellaneous field modifications and final quantity adjustments. Sufficient funds were budgeted and appropriated in the Capital Improvement Program in the total amount of $13,500,000.00. CORRELATION TO THE STRATEGIC PLAN The construction of the N-D South Phase 1 Infrastructure Improvements Project contributes to the fulfillment of the City's Strategic Plan Goal A: Economic and Neighborhood Development; specifically, implementation of Strategy #1 which, among other items, is to develop critical phases of Tustin Legacy. Due to continued ongoing negotiations with Brookfield Homes Southern California LLC ("Brookfield") regarding residential development on several parcels within Neighborhood "Y South, authorization of the award of the construction contract to R.J. Noble Company by the City Council was delayed until November 17, 2020, with the Notice to Proceed issued on March 1, 2021. The infrastructure construction of Neighborhood "D" South Phase 1 is within the area generally bounded by Tustin Ranch Road, Warner Avenue, Barranca Parkway and Armstrong Avenue, and consisted of clearing and grubbing, grading, construction of storm drain, water, reclaimed water, sanitary sewer, dry utility work, roadway improvements and traffic signals installation including a new signalized entry into The District parking lot from Tustin Ranch Road and a new median on Tustin Ranch Road. Several infrastructure construction milestone dates were set forth in the Disposition and Development Agreement with Brookfield including wet utilities completion in Flight Way, Southern California Edison inspection completion, and Flight Way to be open to traffic. Noble Company, having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Tustin -Legacy Neighborhood "D" South Phase 1 Infrastructure Backbone (CIP No. 70246) and Non -Backbone (CIP No. 70250) Construction Project BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
