AND ORDINANCE NO. 1244 AMENDING CITY CODE SECTION 5331n TO DESIGNATE MYRTLE AVENUE BETWEEN MAIN STREET AND SECOND STREET FOR PARKING BY PERMIT ONLY SUMMARY The residents on Myrtle Avenue between Main Street and Second Street have expressed concerns regarding an overflow of on-street parking from adjacent apartments along Main Street. These residents have requested that the City establish overnight' on-street permit parking and add Myrtle Avenue betWeen Main Street and Second Street as a designated on- street permit parking zone. RECOMMENDATION It is recommended that the City Council approve the request for permit parking on Myrtle Avenue between Main Street and Second Street, and have first reading by title only and introduction of Ordinance No. 1244 to amend City Code Section 5331n to designate Myrtle Avenue between Main Street and Second Street for on-street parking by permit only. FISCAL IMPACT It is estimated that the cost to install permit parking signs on the subject street is approximately $900.00. Funds are currently available in the Public Works/Engineering Division and Field Services Division operating budgets to accommodate this work. BACKGROUND In June 2001, the City received a petition from Mr. Thomas Knybel of'695 West Main Street. The petition was generated based upon property owners' concerns with the on-street parking of vehicles overflowing from the apartment complexes on the south side of Main Street in the area of the subject street. The petition further requested that the City investigate the possibility of designating Myrtle Avenue between Main Street and Second Street with on-street parking by permit only. The.subject street is located north of Main Street and south of Second Street (see attached exhibit). Mr. Knybel has obtained signatures (attached) from 15 of the 17 property owners on Myrtle Avenue between Main Street and Second Street in support of establishing overnight permit parking on the subject street. Approval of Permit Parking on Myrtle Avenue September 17, 2001 Page 2 DISCUSSION Engineering staff has reviewed the area for parking conditions and has observed numerous vehicles parking on this section of Myrtle Avenue where the drivers and passengers of those vehicles have walked southerly to the apartment complex on the south side of Main Street. It was observed that this section of Myrtle Avenue is most heavily parked during the nighttime and on the weekends. The section of Myrtle Avenue north of Second Street does not appear to be impacted at this time, however, it is anticipated that the parking displaced by the permit parking may move north of Second Street, as well as to other streets within the area. The residents on Myrtle Avenue north of Second Street did not provide a majority support for permit parking at this time. Section 5331n of the Tustin City Code currently provides for parking by permit only on Heatherfield Drive, Sandwood Place, Rosalie Place, Quent Drive, Cindy Lane, Letty Lane and, more recently, Cloverbrook Drive. The residents on those streets are issued special parking permits for their personal use as well as their guests by the Tustin Police Department to park on the streets between the hours of 2:00 a.m. and 6:00 a.m., seven days a week. It is envisioned that permit parking on Myrtle Avenue would address the on-street parking concerns and be consistent with other previous permit parking areas established by the City since the implementation of the first permit parking program in 1987. Based upon staff's evaluation of the resident's request and observations in the area, it is recommended that the City Council approve permit parking on this section of Myrtle Avenue. Tim D. WHEREAS, th'e City has received numerous complaints regarding the on- · street parking of vehicles overflowing from apartments and condominiums within the City; and WHEREAS, the City Council has determined that the most appropriate method of managing the problem of. overflow street parking in residential areas would be the implementation of a "Parking by Permit Only" .system during certain hours'for residents of those streets.
