SUMMARY: The Zoning Administrator will consider Design Review (DR) 2023-0018, a
request to establish a Master Sign Plan (MSP) for a multi-tenant industrial center located
at 1100 Valencia Avenue and 1101 Bell Avenue. The DR application was filed by Ryan
Ybarra from Signs and Services Company on behalf of Dermody Properties.
PROJECT DESCRIPTION: The proposed MSP would include the installation of tenant
window and door signs, identification wall signs, addressing signs, and eight lifestyle
graphics. The lifestyle graphics are considered a deviation from the Tustin City Code
(TCC) sign regulations, whereas the other proposed signage within the MSP comply
with the TCC. The project site is currently under construction and has an Industrial (M)
Zoning Designation and an Industrial (1) General Plan land use designation. Each
proposed lifestyle graphic will be a maximum total of 594 square feet and will not
exceed 75 percent of the primary elevation. Six of the eight lifestyle graphics will face
the 55 North Freeway at the north elevation, with two lifestyle graphics located on the
exterior wall of Building 1 at the west elevation adjacent to the parking lot on Bell
Avenue. The lifestyle graphics display lifestyle and product imagery associated with the
business. A condition of approval (Condition No. 2.5) is included that would prohibit text,
advertising, and animated copy to be displayed on the lifestyle graphics. The lifestyle
graphics are identified in the Master Site Plan (Figure 1) below as LG 1-8.

JUSTIFICATION: The north elevation for Building 1 and Building 2 span is
approximately 1,030 feet in width and the east elevation along Bell Avenue for Building
1 is approximately 337 square feet. With these two large building footprints, the
approval of the lifestyle graphics would be compatible in size, and complementary with
the visual characteristics of the buildings, and would not detract from adjacent
properties.

DEVIATIONS FROM THE TCC: Per TCC 9404 (b)(6), a MSP is required for proposals
that deviate from the sign standards contained in the City's sign code provided that
the project is in a center and a single development project that contains a building of
at least 30,000 square feet or one -acre in project size. A MSP is required for the
project site because it is a total of 13.29 acres and includes a 133,676 square foot
building (Building 1) at Bell Avenue and a 178,094 square foot building (Building 2)
at Valencia Avenue.
The proposed MSP would complement and enhance the two new industrial buildings that
are currently under construction, and offer a different design and scale than what is
allowed by the TCC. Table 1 provides a comparison between the proposed MSP and the
TCC.

As proposed, the MSP demonstrates a coordinated and quality sign design which is
integrated with the architectural style of the buildings and complies with the TCC. A
prior DR 2022-0001, authorizing the redevelopment of an existing industrial property
to include 1101 Valencia Avenue and 1100 Bell Avenue, was approved by the Zoning
Administrator on June 16, 2022.
APPROVAL AUTHORITY: Pursuant to TCC Section 9403(h), a MSP is required for
developments which include multi-tenant centers. In accordance with Section 9299(m)

of the TCC, the Zoning Administrator shall review applications for MSPs requesting
deviations from the standards within the Tustin City Sign Code.
ENVIRONMENTAL REVIEW: The Community Development Department has evaluated
the project pursuant to the California Environmental Quality Act ("CEQA") and has
determined it to be exempt pursuant to Section 15311 (Class 11) of the State CEQA
Guidelines.
RECOMMENDATION:That the Zoning Administrator adopt ZAA 24-003 approving DR
2023-0018 which would allow the roof eight lifestyle graphics in conjunction with a
MSP for the new buildings located 1100 Valencia Avenue and 1101 Bell Avenue.

SIGN CONSTRUCTION / MAINTENANCE
SIGN CONSTRUCTION&MAINTENANCE:
The following are general guidelines to ensure proper construction,installation and maintenance of Tenant Signs at
1100 Valencia Avenue and 1101 Bell Ave.
•All Signs and their Installation,shall comply with all applicable Tustin City Code Sign Code Regulations Section 9404 Standards and Codes and bear ILL Labels(Out of view of Customers).
•Wall Signs shall be pegged-off the Wall Surface 1/2"Minimum,to allow for Rain Water Drainage and to minimize Wall Staining.
•Signs shall be Mounted&Installed with NO VISIBLE Means of Attachment.
All Illuminated Signs must be connected to Tenant's Electrical Panel and must remain Illuminated during general business operating hours,as
defined by the Landlord,unless otherwise agreed upon by the Landlord.
•The Tenant's Sign Contractor shall completely install and connect their Sign Display and Primary Wiring at Sign Location per the Landlord's
Approval and approval from the City of Tustin Building&Safety Division.Tenant Signs are to be connected to the J-Box provided by
the Landlord at a central location within e'-0"of Sign's center.Final Electrical connection to be completed by a Licensed Electrician.
•All Wall Penetrations of the Exterior Fascia are to be sealed Watertight and finished to match adjacent wall materials,finishes and colors.
•Letter Fastening and Clips are to be concealed from public view and must be galvanized,stainless steel,aluminum,brass or bronze metals.
•All Signs shall be kept in good condition,free of dirt,corrosion&oxidation.Signs must be legible,adequately repaired,maintained&painted by
the Tenant thereof,at all times.All Repairs shall be equal in quality and design to that of the Original Signs.The standards for maintenance&repair
of Signs shall be that which will assure the Highest Visual Quality.The Landlord reserves the right to periodically hire an independent electrical
engineer,at the Tenant's sole expense,to inspect the Installation of all Tenant's Signs.Tenants will be required to have any discrepancies and/or
code violations corrected at the Tenant's sole expense.Any cede violations,requests for Sign Removals or discrepancies not corrected within
Fifteen(15)Days of notice,may be corrected by the Landlord at the Tenant's sole expense.
•Building permits must be obtained from the Building Division prior to any work performed for all maintenance and repairs on existing and new signs.
•Signage Coloration:Tenants with Established Logos&Branding may use their Brand Colors with written Landlord approval.Tenants without Logos or
Branding are to choose Colors that they feel best represent their Brand and work well within the Shopping Center's existing Color Palette.These will
require written approval from the Landlord prior to sign approval from the Planning Division and permit issuance from the Building Division.

PROHIBITED SIGN TYPES:
In addition to those Signs indicated in the City of Tustin Sign Code Ordinance,the following Sign Types are Prohibited for
Tenants at 1100 Valencia Avenue and 1101 Bell Ave.All Sign Designs are subject to the Landlord's Final Written Approval and approval from Planning Division
Animated Signs:Signs consisting of anything Swinging,Swaying,Rotating,Blinking,Strobe Lighting or Flashing,including any Moving Electronic Message Signs or temporary Lighting,such as but not limited to Search Lights,
Flood Lamps or Fluorescent Gel Lights or Projected Image Signs
Exposed Skeletal Neon Letters,Neon Borders,Neon Building Accents,Neon Graphics,Neon Characters or Neon Window Outlines
Cloth,Paper,Cardboard,Foamcore,Gatorboard,Stickers or Decals
Inflatable Advertising Devices,Blimps,etc...
No Advertising Placards,Banners,Pennants,Names,Insignias,Trademarks,Graphics or other descriptive material shall be affixed or maintained on windows and supports of
the show windows and doors,or upon the exterior wall of the buildings without the previous written approval of the Landlord and a temporary Sign Permit from the City of Tustin.A maximum of Ten(10%)percent
of the window area may be used for Temporary Promotional Signs,subject to Landlord&City of Tustin's Approval
Exposed Junction Boxes,Transformers,Power Supplies,Lamps,Ballasts,Tubing,Conduit,Raceways or Exposed Neon of any type
Sign manufacturer's Names,Stamps or Decals visible from the street or normal pedestrian viewing angles

TENANT WINDOW AND DOOR SIGN TYPES
Tenant Window and Door Signage:
Each Tenant shall be permitted to place upon each entrance of its store(inside the storefront glass)no more than 144 square inches of
Gold Leaf Decal or Vinyl Application,lettering not to exceed 2 inches in height,indicating Tenant's hours of business operations,contact
phone numbers,emergency phone numbers,etc.
Tenant shall submit Window Sign Proposals to the Landlord for their Approval prior to installation and per Tustin City Code Section 9412.
Receiving Doors may have a e inch tall block letter sign identifying the Tenant's Name.The Landlord shall install the Address Numerals
above the door in a inch tall block numerals.The Numerals should be black and applied directly to doors.

SUBMITTALS &APPROVALS
SUBMITTALS&APPROVALS:
Each Tenant shall provide a minimum of One(1)Primary Identification Wall-Mounted Sign in accordance with the
Approved Master Sign Plan for 1100 Valencia Avenue and 1101 Bell Ave,herein provided:
1A). Only those Sign Types provided for and specifically approved in writing by the Landlord and permitted by the City of Tustin,will be allowed.
The Tenants will be required,attheir sole expense,to remove any sign that is installed without the City of Tustin and the Landlord's approval.
1 B).All Signs shall be reviewed for compliance with this Criteria and overall design quality.Approval or disapproval of Sign Submittals based on aesthetics of design
shall remain the right of the Landlord.
1 C). Prior to manufacture of any sign in the Shopping Center,the Tenant shall subm it to the Landlord for approval,two(2)copied sets of complete detailed fabrication
drawings.These drawings shall include the Building Elevations to which tha signs are to be attached,sign materials,all dimensions,graphics,colors and method
of attachment to the wall surface.Drawings required must include the following:
•Storefront Building Elevations drawn to Scale
•Sign Elevations Drawn to Scale,indicating Materials,Colors and Dimensions
•Section Details through the Letters or Sign Panel,showing the Dimensioned Projection of the Sign Face from the wall surface and the type of Illumination to be used

1 G).The Tenant's Sign Contractor shall carry Workman's Compensation and Public Liability Insurance against all damage suffered or caused by any and all
persons and/or property while engaged in the construction and erection of Signs in the amount of$1,000,000.00 per occurrence.Evidence of Insurance
must be provided to the Landlord prior to installation,naming Logistic Center at 55,or other party as may be required,as additionally Insured.

1100 VALENCIA AVENUE AND 1101 BELL AVENUE
The Zoning Administrator of the City of Tustin does hereby resolve as follows:
I. The Zoning Administrator finds and determines as follows:
A. That a proper application for Design Review (DR) 2023-0018 was filed by
Ryann Ybarra with Signs and Services Company on behalf of Dermody
Properties, requesting authorization to allow eight lifestyle graphics in
conjunction with a Master Sign Plan (MSP) for two new industrial buildings
Located at 1100 Valencia Avenue and 1101 Bell Avenue.
B. That the project site is located within the Industrial (M) zoning district and
pursuant to Tustin City Code (TCC) Section 9403(h), a MSP is required for
developments which include multi-tenant centers. In accordance with Section
9299(m) of the TCC,the Zoning Administrator shall review applications for MSPs
requesting deviations from the standards within the Tustin City Sign Code.
C. That the eight lifestyle graphics are considered deviations to the TCC sign
regulations and the MSP is being forwarded to the Zoning Administrator for
review.
D. That the Industrial (1) land use designation of the General Plan provides an
opportunity and growth for industrial business activities and related signage.
E. That a public hearing was duly called, noticed, and held for DR 2023-0018 on
January 25, 2024, by the Zoning Administrator.
F. Thatthe proposed eight lifestyle graphics and corresponding MSP, will not, under
the circumstances of this case, be detrimental to the health, safety, morals,
comfort, or general welfare of the persons residing or working in the
neighborhood, nor be injurious or detrimental to the property and improvements
in the neighborhood of the subject property, or to the general welfare of the City
in that:
1) As proposed, the eight lifestyle graphics and MSP would be compatible
with the visual characteristics of the development, would be compatible
with other signs in the surrounding area, and would not detract from
adjacent developed properties.

2) The scale and massing of the proposed eight lifestyle graphics and overall
MSP are consistent with the size and scale of the site and the overall
development within the community. The lifestyle graphics would be
appropriately visible and legible in terms of spacing and proportion of the
images, and would not dominate the visual quality of the site.
G. This project is Categorically Exempt pursuant to Section 15311 (Class 11) of the
California Code of Regulations (Guidelines for the California Environmental
Quality Act).
II. The Zoning Administrator hereby approves DR 2023-0018 to allow eight lifestyle
graphics, in conjunction with a MSP, for a multi-tenant industrial center that is under
construction located at 1100 Valencia Avenue and 1101 Bell Avenue, subject to the
conditions contained within Exhibit A, attached hereto.
PASSED AND ADOPTED by the Zoning Administrator of the City of Tustin, at a regular
meeting on the 251" day of January, 2024.

CONDITIONS OF APPROVAL
1100 VALENCIA AVENUE AND 1101 BELL AVENUE
GENERAL
(1) 1.1 The proposed project shall substantially conform with the plans dated
January 25, 2024 on file with the Community Development Department,
as herein modified, or as modified by the Community Development
Director in accordance with this Exhibit. The Community Development
Director may also approve subsequent minor modifications to plans if
such modifications are consistent with provisions of the Tustin City Code
(TCC) and other applicable codes.
(1) 1.2 The conditions contained in this Exhibit shall be complied with as specified,
subject to review and approval by the Community Development
Department.
(1) 1.3 This approval shall become null and void unless the use is established
within 12 months of the date of this Exhibit. Time extensions may be
granted if a written request is received by the Community Development
Department within 30 days prior to expiration.
(1) 1.4 Approval of DR 2023-0018 is contingent upon the applicant and property
owner signing and returning to the Community Development Department
a notarized "Agreement to Conditions Imposed" form and the property
owner signing and recording with the County Clerk-Recorder a notarized
"Notice of Discretionary Permit Approval and Conditions of Approval"form.
The forms shall be established by the Community Development Director,
and evidence of recordation shall be provided to the Community
Development Department.
Failure to comply with the Conditions of Approval of the establishment
creates undue burden to City resources, or if the CUP is abandoned for a
twelve (12) month period, these circumstances shall be grounds for
revocation of the CUP.

(1) 1.5 Any transfer of ownership of the establishment and/or operator shall
require the new owner and/or operator to sign and return an "Agreement
to Conditions Imposed" form provided by the Community Development.
Failure to do so would be a basis for revocation proceeding.
(1) 1.6 Any violation of any of the conditions imposed is subject to the issuance of
an Administrative Citation pursuant to TCC Section 1162(a).
(1) 1.7 As a Condition of Approval of DR 2023-0018, the applicant shall agree, at
its sole cost and expense,to defend, indemnify, and hold harmless the City,
its officers, employees, agents, and consultants, from any claim, action, or
proceeding brought by a third party againstthe City, its officers, agents, and
employees, which seeks to attack, set aside, challenge, void, or annul an
approval of the City Council, the Planning Commission, Zoning
Administrator, or any other decision-making body, including staff,
concerning this project. The City agrees to promptly notify the applicant of
any such claim or action filed against the City and to fully cooperate in the
defense of any such action. The City may, at its sole cost and expense, elect
to participate in the defense of any such action under this condition.
(1) 1.8 The applicant shall be responsible for costs associated with any necessary
code enforcement action, including attorney's fees, subjectto the applicable
notice, hearing, and appeal process as established by the City Council by
ordinance.
SIGNAGE
(1) 2.1 A sign permit shall be applied for and obtained from the Community
Development Department prior to constructing, erecting, altering,
replacing, moving, or painting any sign, except for signs exempt from a
permit according to the Tustin Sign Code. Permit applications shall be
accompanied by information as required for a standard sign plan or master
sign plan, pursuant to the Tustin Sign Code.

(1) 2.2 All signs shall be structurally safe and maintained in good condition at all
times. The Community Development Director shall have the authority to
order repair, replacement, or removal of any signs which constitute a
hazard or nuisance to the safety, health, or public welfare by reason of
inadequate maintenance, dilapidation, or obsolescence.
(1) 2.3 All signs shall be constructed of a non-corrosive, rust-resistant finish so as
not to degrade in adverse weather conditions.
(1) 2.4 The locations for any signs shall comply with the City of Tustin Guidelines
for Determining Sign Location Visual Clearance and Public Safety Areas.
Signs shall not be placed in a manner that will obstruct or inhibit sight
distance or visibility for the motorist. At plan check submittal, all signs shall
be clearly identified on plans as to the exact locations. Any signs in
proximity to the public right-of-way that could impact driver sight shall be
shown at a larger scale that will be adequate for plan check purposed.
(5) 2.5 The eight-lifestyle graphics shall be limited to only lifestyle and product
imagery that relates to the business. No text, no advertising and no
animated copy is allowed.
(5) 2.6 Page 11 of the MSP shall be revised to include note that states, "No text,
no advertising and no animated copy is allowed on any lifestyle graphics."
PLAN SUBMITTAL
(1, 5) 3.1 Atthe time of sign permit application,the plans shall comply with the latest
edition of State and City of Tustin adopted codes: California Building Code,
California Electrical Code, California Plumbing Code, City Ordinances, and
State and Federal laws and regulations.
FEES
(1,5) 4.1 On the day of the approval of the subject project,the applicant shall deliver
to the Community Development Department, a cashier's check payable to
the COUNTY CLERK in the amount of fifty dollars ($50.00) to enable the
City to file the appropriate environmental documentation for the project. If
within such 48-hour period the applicant has not delivered to the
Community Development Department the above-noted check, the statute
of limitations for any interested party to challenge the environmental
