The California Department of Parks and Recreation is responsible for administering this appropriation. City Council adoption of the attached resolution approving the submittal of an application for this funding is required. RECOMMENDATION Staff recommends the City Council approve Resolution No. 24-04. FISCAL IMPACT Funds in the amount of $750,000 have been awarded to the City for the Tustin Legacy Park Improvements Project. CORRELATION TO THE STRATEGIC PLAN The recommended action contributes to the fulfillment of the City's Strategic Plan Goal C: Fiscal Strength by identifying revenues beyond sales and property taxes and Goal B: Public Safety and Protection of Assets by ensuring continuous maintenance and improvement of park facilities. DISCUSSION Representative Petrie -Norris secured this funding on behalf of the City of Tustin as part of the California state budget for FY 23/24. The California Department of Parks and Recreation is the department responsible for administering the funding and has requested the City Council approve Resolution No. 24-04 as the first step in the funding process. Upon receipt of the Resolution, the City will be provided with a contract to secure the funding. The project must be complete by December 31, 2026 and final project reports documenting reimbursable expenses must be submitted to the State by January 31, 2027. (B) (30) $750,000 TO THE CITY OF TUSTIN, FOR THE CITY OF TUSTIN LEGACY PARK IMPROVEMENTS WHEREAS, the State Department of Parks and Recreation has been delegated the responsibility by the Legislature of the State of California for the administration of a grant to the City of Tustin, setting up necessary procedures governing application(s); and WHEREAS, said procedures established by the State Department of Parks and Recreation require the City Council to certify by resolution the approval of Project application(s) before submission of said applications to the State; and WHEREAS, the City of Tustin will enter into a contract with the State of California to complete Project. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Tustin hereby: 1. Approves the filing of project application(s) for specified grant project(s); and 2. Certifies that the City of Tustin, has or will have available, prior to commencement of Project work utilizing specified grant funds, sufficient funds, including those provided by this grant, to complete the Project; and 3. Certifies that the City of Tustin has reviewed, understands, and agrees to the General Provisions contained in the contract shown in the Procedural Guide; and 4. Delegates the authority to the City Manager, or designee to conduct all negotiations, sign and submit all documents, including, but not limited to applications, agreements, amendments, and payment requests, which may be necessary for the completion of the Project scope(s); and 5. Agrees to comply with all applicable federal, state and local laws, ordinances, rules, regulations and guidelines.
