HomeMy WebLinkAbout08 NOTICE OF COMPLETION-JOINT COUNTY PROJECTDocuSign Envelope ID: F5B9B721-6016-49F9-9B8B-4ED6E5B475C9 Agenda Item 8 DS AGENDA REPORT Reviewed: Or, City Manager_ Finance Director MEETING DATE: FEBRUARY 20, 2024 TO: NICOLE BERNARD, ACTING CITY MANAGER FROM: MICHAEL GRISSO, ACTING DIRECTOR OF PUBLIC WORKS SUBJECT: ADOPT RESOLUTION NO. 24-09 TO ACCEPT IMPROVEMENTS FOR THE JOINT PROJECT WITH THE COUNTY OF ORANGE FOR ROADWAY MAINTENANCE WITHIN SHARED BOUNDARY AREAS — NORTHWEST TUSTIN, CIP NO. 70022 AND AUTHORIZE THE CITY ENGINEER TO FILE A NOTICE OF COMPLETION SUMMARY Construction of the joint project with the County of Orange and City of Tustin for street maintenance located at shared boundaries on Newport Avenue, Warren Avenue and 17th/Prospect has been completed to the satisfaction of the City Engineer and is now ready for City Council acceptance. The joint project is part of the County of Orange Public Work's Annual Major Maintenance Project titled Northwest Tustin (South of 17th Street) with Newport Avenue, JOC 2022-23, and is consistent with the County's Job Order Contract (JOC) Master Agreement for Pavement Maintenance. Orange County Public Works has taken the lead for the project and the joint work was aligned and coordinated with the annual maintenance plans for both jurisdictions. RECOMMENDATION It is recommended that the City Council take the following actions: 1. Adopt Resolution No. 24-09 accepting the construction of the Joint Project with the County of Orange and City of Tustin street maintenance within shared boundary areas (Northwest Tustin - Newport Ave, Warren Ave, and 17th/Prospect), CIP NO. 70022; and 2. Authorize the City Engineer to execute and file the Notice of Completion with the Orange County Recorder's Office. FISCAL IMPACT The final construction cost for the Joint Project with the County or Orange, Northwest Tustin, CIP No. 70022 is $91,446.10. Sufficient funds were budgeted and appropriated in the Capital Improvement Program and funded by the Gas Tax fund (Fund 130). The work was included in the Annual Pavement Rehabilitation Project (CIP 70022). CORRELATION TO THE STRATEGIC PLAN Rehabilitation of roadways contribute to the fulfillment of the City's Strategic Plan Goal B: Public Safety and Protection of Assets. Specifically, the project implements Strategy #5, which among other items, is to ensure continuous maintenance and improvement of public facilities. Second is implementation of Goal D, Strategy #2 by working collaboratively with agencies to address issues of mutual interest and concern. To more efficiently acquire construction services through administrative efficiencies and cost savings of the use of a joint contractor, the City piggy -backed on the County of Orange's Cooperative Purchasing Program which utilized their Job Order Contract (JOC) Master Agreement for Pavement Maintenance. The project was awarded to R.J. Noble Company. The County took the lead for the project and the joint work was aligned and coordinated with the annual maintenance plans for both jurisdictions. Noble Company, having a contract with the City of Tustin to construct the hereinafter described public works and improvement; and WHEREAS, the City Engineer has duly certified to the construction and completion of said public improvement hereinafter mentioned in a manner satisfactory to the City Council of the City of Tustin; and WHEREAS, the City Council finds that said contractor has completed said public improvement hereinafter more particularly described in accordance with the provisions of the contract documents and the Notice of Completion, and acceptance of said public works and improvement should be filed and payment of the balance due said contract authorized in accordance with the contract documents. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tustin that said public works and improvement is found to be complete, and the same is hereby accepted. Said public works and improvement is more particularly described as follows: Joint Project with County of Orange and City of Tustin Street Maintenance within shared boundary areas (Northwest Tustin — Newport Ave, Warren Ave and 17t"/Prospect) — CIP 70022 BE IT FURTHER RESOLVED that the City Engineer of the City of Tustin is hereby authorized to execute and file a Notice of Completion for the acceptance of said public works and improvement described herein as required by law.
