Legislative Background
Proposition 215. Approved by California Voters in 1996.
Medical Marijuana Regulation and Safety Act ("MMRSEffective
January 1, 2016.
Ordinance No. 1466. Adopted by City Council on January 19, 2016.
Prohibits medical marijuana dispensaries in all zoning districts in the City.
Proposition 64 - Adult Use of Marijuana Act ("AUMA"). Approved by
California voters on November 8, 2016.
Ordinance No. 1478. Adopted by City Council on April 4, 2017. Prohibits
marijuana dispensaries (recreational and medicinal) in all zoning districts
in the City.
Senate Bill (SB) 1186
Medicinal Cannabis Patients' Right of Access Act.
Prohibits local jurisdictions from adopting or enforcing any regulation that
prohibits, or has the effect of prohibiting, the retail sale by delivery within the
jurisdiction of medicinal cannabis to medicinal cannabis patients or their
primary caregivers by licensed medicinal cannabis businesses in a timely
and readily accessible manner, and in types and quantities that are
sufficient to meet the demand from medicinal cannabis patients within the
local jurisdiction.
Draft Ordinance 1540
• Replace existing definition of and references to "Marijuana Dispensary" with
"Cannabis Business".
• Retains existing prohibitions on cannabis businesses and related activities in
the City, while allowing for the retail sale by delivery of medicinal cannabis in
accordance with SB 1186.
• Adds local regulatory provisions:
• Cannabis business must be State licensed;
• Deliveries made in accordance with state law; and
0 Delivery only to residential addresses.
Planning Commission
Recommendation
• On January 23, 2024, the Planning Commission held a public hearing
regarding the proposed ordinance.
• On that date, the Planning Commission adopted Resolution 4481, which
recommends that the City Council adopt Ordinance No. 1540.
