After making revisions based upon State feedback, the City received certification in September 2022 and the City Council adopted the State Certified Housing Element on October 4, 2022. The City of Tustin's Housing Element (HE) must demonstrate the ability to meet the assigned housing needs, established as part of the Regional Housing Needs Allocation (RHNA), through the provision of sites suitable for residential development over an eight -year period (2021 to 2029). To meet the assigned housing needs, the Housing Element identifies candidate sites that are suitable for residential development and sites that are required to be re -zoned to allow for housing development. The sites to be re -zoned include Enderle Center, Tustin Market Place and Tustin Legacy. RECOMMENDATION: It is recommended that the City Council receive and file the report. FISCAL IMPACT: The Housing Element RHNA Rezone is a City -initiated project. The cost associated with the preparation of this project has been appropriated in the 2023-2025 biennial budget. The implementation of the policies and programs within the rezone program may result in fiscal impacts to the City which will be addressed at a project or program's implementation. CORRELATION TO THE STRATEGIC PLAN: This project supports the implementation of Goal A within the City of Tustin's Strategic Plan pertaining to Economic and Neighborhood Development. Goal A of the Strategic Plan strives to enable business opportunities and job development and to enhance the vibrancy and quality of life in all neighborhoods and areas of the community. DocuSign Envelope ID: 95D788E0-2431-48113-81D81`4613131CA5B447 Housing Element Rezone April 2, 2024 Page 2 DISCUSSION: Program Overview To meet the assigned housing needs, the Housing Element identifies candidate sites that are suitable for residential development and sites that are required to be re -zoned to allow for housing development. Note that no development is proposed as part of this project. The Rezoning Program specifies that the City will revise the zoning of the following three sites: • Enderle Center • Tustin Legacy • Tustin Market Place The City is currently working to implement the rezoning project specified in the City's certified Housing Element. Rezoning of these three sites requires the preparation of environmental studies and technical documents in conjunction with the Re -zoning project. The City's environmental consultant has begun preparation of Environmental Impact Reports (EIRs) that evaluate potential environmental impacts associated with these three project sites, and the EIRs are being prepared pursuant to the California Environmental Quality Act (CEQA). Once drafted, the environmental and technical documents will be released for public review and posted on the City's dedicated webpage at https://www.tustinca.org/HousingElementRezone for the rezone project. Following the completion of the EIRs, the rezoning project will be considered by the Planning Commission and City Council. Additional noticing to the public will be provided at that time. Enderle Center Enderle Center (Housing Element Site 17) is identified by Housing Element Program 1.1f as a location that must be rezoned to allow residential/mixed-use development. Enderle Center consists of approximately 11.80 acres of privately -owned property, currently developed as a commercial center. Of the site area, seven acres within the southeastern portion of the Project site are currently made up of paved parking areas and have been identified as suitable for housing development. The Rezoning Program requires a General Plan Amendment (GPA) to allow residential uses in the Planned Community Commercial Business designation, a Zoning Code Amendment to establish a Housing Overlay District, and a Zone Change (ZC) to amend the City's zoning map to apply a Housing Overlay (HO) District to the Project site. Based on the proposed overlay zone, redevelopment of up to seven acres of the site would accommodate up to 413 housing units. The Market Place (Tustin) The Tustin Market Place (Housing Element Site 18) is identified for rezoning under Housing Element Program 1.1f to allow for residential development. The Tustin Market Place is an approximate 76.9-acre shopping center and 18 acres of the Project site currently used as surface parking have been identified as being suitable for housing development. Per the adopted City DocuSign Envelope ID: 95D788E0-2431-48113-81D81`4613131CA5B447 Housing Element Rezone April 2, 2024 Page 3 General Plan 2021-2029 Housing Element, redevelopment of the 18 acres is expected to accommodate up to 900 housing units. The Rezoning Program requires a GPA to allow residential uses in the Planned Community Commercial Business designation, a Specific Plan Amendment (SPA) to establish "High Density Residential" as a new residential density category available within the plan and identify "High Density Residential" as an allowable use within the Mixed Use (MU) land use of the East Tustin Specific Plan (ETSP). Tustin Legacy Tustin Legacy (Housing Element Sites 1 & 2) is identified by Housing Element Program 1.1 a as having its residential capacity increased in Neighborhoods D South, D North, and G. To accommodate RHNA, the rezoning program will add a total of 855 additional residential units to these three neighborhoods. The Rezoning project also includes 1,356 buffer units that are intended to provide additional residential units to meet the City's RHNA in the event that identified sites become no longer feasible for development of affordable or market rate housing. The Rezoning program requires a Specific Plan Amendment to increase the capacity at Tustin Legacy. Proiect Status To meet the implementation deadline for Housing Element Program 1.1 a and f, the City held three scoping meetings during the month of March 2024 inviting property owners, outside agencies, and other interested parties to learn about the proposed rezone project and to provide comments on the information to be considered during the preparation of each Draft EIR. The dates for each scoping meeting and the corresponding review periods for each Notice of Preparation (NOP) and Initial Study (IS) is provided in Table 1 below. A copy of the presentations provided at the Scoping meeting have been included in the Attachments to this staff report. Comments generally include concerns about the ability to fit 413 units on the site, water availability during a drought, parking impacts, hazardous materials in the soil, traffic impacts, school impacts, and the process for determining hazardous materials in the EIR. Additionally, DocuSign Envelope ID: 95D788E0-2431-48113-81D81`4613131CA5B447 Housing Element Rezone April 2, 2024 Page 4 questions were raised about penalties for not rezoning, the notification area for the project, and the possibility of approving plans for updating Enderle Center without housing. Tustin Market Place: One resident and a representative of The Irvine Company attended the scoping meeting. The individual was curious about the process and brought up concerns related to potential traffic in the area. Tustin Legacy: One individual from the Tustin Unified School District and one individual from The Irvine Company attended the scoping meeting. No specific comments were identified at the meeting. The City will compile all comments received throughout each response period (currently ongoing) and address them when drafting and reviewing the upcoming EIRs (or SEIR). Next Steps The City's environmental consultant has begun preparation of EIRs that evaluate potential environmental impacts associated with these three project sites. Once the draft is complete, the City will prepare and file a public notice of Draft EIR Availability (NOA) and begin a Public and Agency review period for the Draft EIRs. The Draft EIR for Enderle Center and for The Tustin Market Place are anticipated to be released in mid -May, with the Draft SEIR for Tustin Legacy to follow at the end of May. The City expects to prepare the Final EIRs, including a response to any comments, over the summer with public hearings before the Planning Commission and City Council to take place in September and October 2024.
