2. APPROVAL OF MINUTES — THE REGULAR MEETING OF THE CITY COUNCIL
HELD ON FEBRUARY 20, 2024.
Motion: The City Council approved the Action Minutes of the Regular Meeting of the
City Council held on February 20, 2024.
3. RATIFICATION OF PAYROLL AND DEMANDS
The City Council has approved the use of Government Code Section 37208 to
expedite the payment of City of Tustin obligations that are in accordance with the
approved budget or continued operations authorizations.
Motion: The City Council approved Payroll in the amount of $1,027,600.77 and
Demands in the amount of $11,548,445.19.
4. RESOLUTION DETERMINING THE NEED TO CONTINUE THE PROCLAIMED
LOCAL EMERGENCY RELATED TO THE NAVY NORTH HANGAR
At its meeting on November 10, 2023, the City Council ratified the Acting City
Manager's Proclamation of Local Emergency related to the fire at the Navy's North
Hangar and release of chemicals of public health concern, including asbestos. At a
special meeting of the City Council on January 9, 2024, the Council reviewed and
determined the need to continue the local emergency. This item recommends that
the City Council once again review and determine that the need exists to continue
the local emergency, as required by State law.
Motion: The City Council adopted the attached Resolution 24-20 determining the
need exists to continue the local emergency related to the fire and release of
chemicals of public health concern, including asbestos, from the Navy's North
Hangar.

5. 2023 GENERAL PLAN ANNUAL REPORT AND ANNUAL MITIGATION
MONITORING STATUS REPORT FOR FEIS/EIR FOR TUSTIN LEGACY
SPECIFIC PLAN
The California Government Code requires that the Planning Commission provide an
annual progress report to the City Council on the status of the City's General Plan
and the progress in its implementation, including the progress in meeting our share
of regional housing needs and efforts to remove governmental constraints to housing
development, maintenance, and improvement.
In addition, the City Council certified the Program Final Environmental Impact

Statement/Environmental Impact Report (FEIS/EIR) for the Disposal and Reuse of
MCAS Tustin along with its Supplemental and Addendums. The FEIS/EIR evaluated
the environmental impacts of the reuse and disposal of MCAS-Tustin, which included
the adoption of a Mitigation Monitoring and Reporting Program (MMRP) pursuant to
CEQA Guidelines Section 15097. The MMRP requires annual review to ensure
compliance with required mitigations.
On February 27, 2024, the Planning Commission reviewed the General Plan Annual
Report and the Tustin Legacy Annual Mitigation Monitoring Status Report and
authorized staff to forward the reports to the City Council. With Council authorization,
staff will forward the General Plan Annual Report to the California Department of
Housing and Community Development (HCD) and Office of Planning and Research
(OPR) in fulfillment of the State's requirement, and receive and file the Tustin Legacy
Annual Mitigation Monitoring Status Report.
Motion: The City Council:
• Authorized staff to forward the General Plan Annual Report to the State OPR
and HCD; and
• Received and filed the Tustin Legacy Annual Mitigation Monitoring Status
Report and authorized staff to submit a subsequent report when considerable
and significant activities occur.
6. REQUEST TO INCREASE REVENUE BUDGET AND APPROPRIATION BASED
ON THE THIRD AMENDMENT TO THE COOPERATIVE AGREEMENT WITH THE
NAVY AS RELATED TO THE NORTH HANGAR FIRE INCIDENT
The City expects to enter into a third amendment to the Cooperative Agreement with
the U.S. Department of the Navy (Navy) to implement an emergency response
related to the North Hangar Fire Incident. Staff is requesting the City Council's
approval to increase revenue budget and related appropriation by the Navy's
reimbursement amount specified in the third amendment. The City expects the third
amendment will increase the reimbursement amount pledged by the Navy by
approximately $13 million — for a current not to exceed total of approximately $24
million. The City expects the balance of costs, currently estimated at more than $50
million, the City is incurring on the Navy's behalf to be pledged for reimbursement by
the Navy in subsequent amendments.
Mayor Lumbard noted that the City has not received the funds yet related to this
amendment and noted this approval is to authorize staff to use the funds when we
receive them.
It was moved by Mayor Lumbard and seconded by Council Member Clark to increase
revenue budget and related appropriation by the Navy's reimbursement amount
outlined in the third amendment to the Cooperative Agreement.

Council Member Clark proposed an amendment to the motion to direct staff to share
detailed information regarding the spending to date. Mayor Lumbard accepted the
amendment.

7. SECOND READING AND ADOPTION OF ORDINANCE NO. 1540 (CODE
AMENDMENT (CA) 2024-0001 - CANNABIS BUSINESSES AND ACTIVITY)
Adoption of Ordinance No. 1540 amends Tustin City Code (TCC) Sections 3141,
3152, 9270, and 9297 pertaining to the regulation of cannabis businesses and activity
within the City. Proposed CA 2024-0001 would update the TCC to ensure that it is
not inconsistent with the Medicinal Cannabis Patients' Right of Access Act, that
became effective on January 1, 2024.
Motion: The City Council had second reading by title only and adoption of Ordinance
No. 1540.
ORDINANCE NO. 1540 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF TUSTIN, CALIFORNIA, AMENDING TUSTIN CITY CODE SECTIONS 3141,
3152, 9270, AND 9297 TO UPDATE THE CITY'S BUSINESS AND LAND USE
REGULATIONS PERTAINING TO CANNABIS BUSINESSES (CODE
AMENDMENT 2024-0001)
8. AWARD OF CONTRACT FOR THE CONSTRUCTION OF CENTENNIAL PARK
IMPROVEMENTS PROJECT, CIP NO. 20090
Staff is requesting the City Council award a construction contract to the lowest
responsive/responsible bidder for the Centennial Park Improvements Project, CIP
No. 20090.
Motion: The City Council:
1. Awarded the construction contract to Elegant Construction, Inc., the lowest
responsive/responsible bidder, in the amount of $4,683,474.71, and
authorized the Mayor and the City Clerk to execute the contract documents
on behalf of the City; and
2. Appropriated $450,000 from the Land Sale Proceeds Fund (Fund 189).
9. AWARD CONTRACT FOR THE ANNUAL ROADWAY REHABILITATION AND
SIDEWALK REPAIR PROJECT - ZONE 5, CIP NO. 70023
Staff is requesting the City Council award a construction contract to the lowest
responsive/responsible bidder for the Annual Roadway Rehabilitation and Sidewalk
Repair Project for Zone 5, CIP No. 70023.

Motion: The City Council:
1. Awarded a construction contract to the lowest responsive/responsible bidder,
Onyx Paving Company, Inc. in the amount of $3,869,000 for the Annual
Roadway Rehabilitation and Sidewalk Repair Project - Zone 5, CIP No. 70023
and authorized the Mayor and the City Clerk to execute the contract
documents on behalf of the City; and
2. Appropriated $2,800,000 from the Gas Tax Fund (Fund 130) and $1,600,000
from the Road Maintenance and Rehabilitation Allocation Fund (Fund 140).
10. APPROVE PLANS AND SPECIFICATIONS AND AUTHORIZE ADVERTISEMENT
FOR BIDS FOR THE CIVIC CENTER ALTERNATE POWER SOURCE PROJECT,
CIP NO. 10069
The plans and specifications for the Civic Center Alternate Power Source Project
(CIP No. 10069) have been prepared and the project is now ready for bid.
Motion: The City Council:
1. Adopted Resolution No. 24-17 approving the plans and specifications for the
Civic Center Alternate Power Source Project (CIP No. 10069); and
2. Authorized the City Clerk to advertise to receive bids.

ENTER INTO AN AGREEMENT FOR THE TUSTIN SPORTS PARK ROOF
REPLACEMENT PROJECT, CIP NO. 20095
Staff is requesting authorization to award the Tustin Sports Park Roof Replacement
Project, CIP No. 20095, through use of the OMNIA Partners Purchasing Program.
Motion: The City Council:
1. Adopted Resolution No. 24-16 authorizing the use of OMNIA Partners;
Contract # PW1925 with Garland DBS, Inc. for the purchase, installation and
warranty in the amount of $365,399; and
2. Reallocated $310,000 of Park Development Funds (Fund 131) from the
Annual Major Park Maintenance Program (CIP 20054) to the Tustin Sports
Park Roof Replacement Project (CIP 20095); and

12. COLUMBUS TUSTIN PARK DUGOUT MURAL PUBLIC ART PROJECT
At their February 21, 2024, meeting, the Public Art Commission selected a design for
the Columbus Tustin Park Dugout Mural to recommend to the City Council for final
approval.
Motion: The City Council adopted Resolution 24-18 approving the wall mural design,
submitted by artist Mer Young, to be installed on an exterior dugout wall at Columbus
Tustin Park and authorized the Parks and Recreation Department to execute an
agreement with the artist.

The Public Art Commission has approved the acceptance and installation of the
"Make a House a Home" gifted public art sculpture with a recommendation to the City
Council for final approval.
Motion: The City Council adopted Resolution 24-19 approving the acceptance and
installation of the "Make a House a Home" gifted public art sculpture from artist Hiromi
Takizawa, at the island on El Camino Way.

14. COMMUNITY DEVELOPMENT BLOCK GRANT SUBRECIPIENTS
PERFORMANCE EVALUATION
The Housing and Community Development Act of 1974, as amended, established
the Community Development Block Grant (CDBG) program to return federal funds to
local communities for the purpose of developing viable urban communities by
providing decent housing, suitable living environments, and by expanding economic
opportunities, specifically for low- and moderate -income persons. The City of Tustin's
CDBG grant award for the 2024-25 program year is anticipated to be approximately
$750,000 based on the prior year funding allocation provided by the federal
Department of Housing and Urban Development (HUD).
Pursuant to CDBG program regulations, to carry out the program, the City will need
to have at least two public hearings. One hearing is conducted during the preparation
of the Action Plan, and another for the adoption of the Action Plan. This is the first
public hearing, with the purpose to inform interested citizens about the CDBG
program, obtain citizens' views on CDBG

15. TEMPORARY SUSPENSION OF AFFORDABLE HOUSING IN -LIEU FEE
Associate Planner Jorge Maldonado provided a PowerPoint presentation.
This report is a follow-up to the December 5, 2023, City Council meeting where the
City Council directed staff to prepare resolutions for applicable policy options
identified in the Mayor's Economic Development Ad -Hoc Committee's
recommendation list. This item is the implementation of the policy option to, for a
period of 36 months, temporarily suspend the affordable housing in -lieu fee for
residential projects located in the Downtown Commercial Core Specific Plan
(DCCSP) and Red Hill Avenue Specific Plan (RHASP) areas.
The City Council will be asked for direction in April for review of the current Voluntary
Workforce Housing Program's (mid-term goal) effectiveness and feasibility analysis
to optimize rules consistency with the Housing Element, evolving State laws, and
economic consideration.

correspondence to the City Council.

16. PROPOSED FORM OF ORDINANCE TO AMEND THE CITY'S TERM LIMITS FOR
MAYOR AND CITY COUNCIL MEMBERS
In accordance with the City Council's direction at its January 16, 2024, meeting, this
item returns to the Council for consideration and approval of the attached form of City
ordinance that would, if approved by Tustin's voters at the November 2024 election,
amend the City's term limits.

It was moved by Mayor Lumbard and seconded by Council Member Schnell to:
Approve staff recommendation as outlined in Ordinance 1542 with an adjustment to
the cooling off period to eight years off, for inclusion with a measure to be placed
before Tustin's voters at the November 5, 2024, election; and
Direct staff to return to the Council with proposed resolutions related to calling the
election on November 5, 2024, for: (1) the proposed term limits measure, and (2) the
elections for Council Districts 1, 2 and 4 in accordance with Tustin City Code section
1309 d.(2)(d).
City Attorney David E. Kendig read the proposed revision to subsection (b) and
clarified the proposed revision to subsection (b)(1) in Tustin City Code Section 1307:
(b) Limitation on Consecutive Elected Terms: Any person who has served as a
member of City Council or in the office of Mayor, or any combination thereof, for more
than three consecutive terms or for more than twelve consecutive years, whichever
is less, shall not be eligible to be elected to the City Council or to the office of Mayor
for a period of eight calendar years from the last date of service on the City Council
or as Mayor.
(1) If the person's service of the third consecutive term or the twelfth consecutive
year ends in December after a general election, that person shall be eligible to run
and be elected in the general election in November of the calendar year eight years
later. (For example: if a Council member's third term ends upon certification of
election results in December 2050, then that person would be eligible to be elected
in November 2058 notwithstanding that the election is less than eight full years after
the last date of service in 2050.)

Attended the Tustin Police Department's Promotion and Swearing in Ceremony; was great
to see the brave men and women stand up and swear an oath to protect the residents of
Tustin.

rest for a few minutes; reported the weather was beautiful for the event.

Attended the Tustin Police Department's Promotion and Swearing in Ceremony; welcomed
the new officers and congratulated the newly promoted officers; reported it is great to have
new talent added to the Tustin police family.
Announced the following Orange County Public Libraries' events:
• A Slice of Literary Orange; stated the event will feature A.J. Finn, #1 New York Times
bestselling author of "The Woman in the Window", which is the basis for the hit film
starring Amy Adams; mentioned Finn's second novel, "End of Story", was released
in February 2024; reported a book giveaway will be happening; the event will be on
March 13, 2024, at 6:30 PM in Rancho Santa Margarita.
• Kinderpalooza, is a series of events designed for children and families preparing to
enter kindergarten; reported the series demonstrates essential skills needed for
children to thrive in kindergarten while delivering a fun family experience; stated each
event will feature children performers, photo opportunities with storybook characters,
early learning activity stations, giveaways, and resources from Tustin's many
community partners; announced Kinderpalooza will be at the Tustin Library on
Thursday, March 21, 2024, at 4:00 PM; for more information call the library at (714)

Thanked California State Senator Josh Newman, Senator Tom Umberg, and
Assemblywoman Cottie Petrie -Norris, for their efforts to encourage Congress and President
Biden to provide 100 million dollars in supplemental funding dedicated to clean- up and
mitigation efforts for the Navy North Hangar Fire; appreciated their efforts to urge President
Biden to declare a national emergency in recognition of the impact of the Navy's North
Hangar Fire.

expedite the payment of City of Tustin obligations that are in accordance with the
approved budget or continued operations authorizations.
Motion: The City Council approved Payroll in the amount of $1,028,789.23 and
$990,618.94 and Demands in the amount of $11,170,314.69.
4. LEGISLATIVE UPDATE
Staff and the City's consultant Townsend Public Affairs (TPA) have prepared a
summary of state legislative activity.
Motion:
1. Received and filed the updated legislative matrix as of March 20.
2. Received and filed legislative updates prepared by TPA.
5. HOUSING ELEMENT REZONE STATUS UPDATE
In October 2021, the City submitted its Housing Element 2021-2029 to the California
Department of Housing and Community Development for review. After making
revisions based upon State feedback, the City received certification in September
2022 and the City Council adopted the State Certified Housing Element on October
4, 2022.
The City of Tustin's Housing Element (HE) must demonstrate the ability to meet the
assigned housing needs, established as part of the Regional Housing Needs
Allocation (RHNA), through the provision of sites suitable for residential development
over an eight -year period (2021 to 2029). To meet the assigned housing needs, the
Housing Element identifies candidate sites that are suitable for residential
development and sites that are required to be re -zoned to allow for housing
development. The sites to be re -zoned include Enderle Center, Tustin Market Place
and Tustin Legacy.
Motion: The City Council received and filed the report.
6. POLICE OFFICER HIRING INCENTIVE PROGRAM
Staff is seeking City Council approval to implement a proposed Police Officer Hiring
Incentive Program to improve the City's success in recruiting, hiring, and retaining
lateral Police Officers.
Mayor Lumbard thanked Council's support in getting this item on the agenda and
thanked the collective support with staff, Chief Greenberg and the Police Department
for the collaboration that they have enjoyed and will continue to enjoy.
It was moved by Mayor Lumbard and seconded by Mayor Pro Tern Gallagher to

Adoption of the attached Resolutions will transfer the responsibility for performing
liability claim administrative functions and determining an employee's eligibility for a
CaIPERS disability retirement from the City Council to staff.
Motion: The City Council adopted the following Resolutions:
Resolution No. 24-21 to delegate authority to the City Manager or their
designee to perform liability claim administrative functions; and
2. Resolution No. 24-22 to delegate authority to the City Manager or their
designee to make determinations on Local Safety employee eligibility for a
CaIPERS disability retirement.

8. CODE AMENDMENT 2024-0002 (ORDINANCE NO. 1536) — (CODE
STREAMLINING AND IMPROVEMENT PROGRAM)
Assistant Director of Community Development Jay Eastman provided a PowerPoint
presentation.
The City's Strategic Plan identifies development streamlining as one of its goals. The
proposed Code Amendment (CA) 2024-0002 is a City -initiated request to amend
Tustin City Code (TCC) Article 9 (Land Use) as part of the Community Development
Department's Code Streamlining and Improvement Program. The goal of the Code
Streamlining and Improvement Program is to evaluate the City's land use code and
propose amendments to sections that lack clarity, are outdated, or do not respond to
current market trends. The proposed CA also streamlines the entitlement process in

order to increase effectiveness and efficiency. The Community Development
Department will continue to evaluate land use related codes and practices on a
regular basis and will introduce amendments when appropriate in the future.
On February 27, 2024, the Planning Commission adopted Resolution 4471
(Attachment A), recommending that the City Council adopt Ordinance No. 1536,
approving CA 2024-0002. The Planning Commission Minutes are provided as
Attachment B for reference.

to introduce and have a first reading, by title only, of Ordinance No. 1536, amending

and Improvement Program to provide clarity, consistency of terms and definitions,
and compliance with State law.

Associate Planner Jorge Maldonado provided a PowerPoint presentation.
The 2023 Year in Review summarizes Community Development Department's
programs and activities conducted from January through December 2023. The 2023
Year in Review report highlights activities under the following categories:
• Current Planning - Industrial, commercial, mixed -use, and residential
development and projects under review.

Announced he will be attending Orange County Fire Authority's (OCFA) and Orange County
Local 3631 Firefighters' Fire Ops 101 educational training on May 4, 2024; received a fire
suit fitting recently for the program.

accomplished women sharing their professional experiences; was an amazing event.

Economic Development Deputy Director, Jerry Craig, was in attendance.
• Attended the Orange County Fire Authority meeting with President of Orange County
Firefighters, Chris Hamm.
• Attended the Public Works Department's Arbor Day event at El Camino Real Park
with Mayor Lumbard; reported a tree was planted and gave a presentation to
elementary school students explaining the meaning of Arbor Day.

future of infrastructure, how to increase housing and water trends.

Attended the Newport Bay Watershed Executive Committee meeting; reported Orange
County Supervisor, Fifth District Katrina Foley, is the Chair of the Committee; received
updates on projects happening all over Orange County; was inspiring to see what can be
done in Tustin.

Attended the Navy North Hangar site tour with California Senator Josh Newman's staff and
Mayor Lumbard; reported Newman's Chief of Staff, Brendan Murphy, stated someone does
not understand how large the crisis was until they are up close to it.
Attended the Los Angeles Times B2B Publishing Inspirational Women Awards event;
thanked Sona Shah, President of the Tustin Public Schools Foundation, for moderating the
event; reported many inspiring and empowering women were honored at the event.
Announced Lemonade Day is on Saturday, April 6, 2024; stated this event is to encourage
and promote young entrepreneurs; asked everyone to go out and support the young
entrepreneurs.
Announced Girls in Government event is coming up on June 7, 2024; reported the event is
open to high school seniors and college women; reported there is no fee to participate;
stated discussions and workshops will be presented; thanked Acting City Manager, Nicole
Bernard and City Clerk, Erica N. Yasuda for their support with the event; encouraged
individuals to apply online at www.tustinca.org/girlsingov.
Congratulated the One Seed Community Garden on its one-year anniversary; thanked One
Seed for all the hard work securing grant funding for the garden and their partnership with
the city.

Attended California District 73, 2024 Women of the Year event hosted by Assemblywoman
Cottie Petrie -Norris; reported Council Member Clark presented Soledad Rivera with the
honor of being Tustin's Woman of the Year.

Attended the Orange County Mosquito and Vector Control District Board meeting; reported
the following items:
• Received two presentations on the 2024 campaign that will focus on increased
engagement during California Mosquito Week and National Mosquito Week; and
• Received a presentation from Kosmont Realty regarding the market update on a
potential new district facility; was a robust discussion on the future location of the
district; and

• Reported new policies for computers and information technology, and changes to job
descriptions were approved; and

district mission and values statement; and
• Announced a Public Information Officers (PIO) Lunch and Learn workshop will be
held to inform local cities of the district's efforts; and
• Reminded everyone spring is the start of mosquito season; asked everyone to
remove any standing water to reduce the number of mosquitos throughout the entire
summer season.

Attended the Orange County (OC) Forum's event on housing options; reported an extensive
discussion regarding new housing and the mix of retail with open space.
Announced the Columbus Tustin Park Dugout Mural Public Art Project is complete at the
corner of Irvine Boulevard and Prospect Avenue; stated it enhances the corner.

Attended the Tustin Parks and Recreation's Easter Egg Hunt event; thanked the Tustin
Parks and Recreation staff for their hard work to convert the event to indoors; reported many
parents were appreciative of the last-minute effort transition to indoors instead of cancelling
the event.
Asked staff to promote Tustin as the City of Trees.

Attended the Tustin Parks and Recreation's Easter Egg Hunt event; was a great event;
thanked all the Parks and Recreation staff for their hard work to pivot the event to indoors.
Thanked the One Seed Community Garden for all the ways the community garden is
connecting back to the Tustin community; asked staff to investigate creating a porthole in
conjunction with a public art project in the fence to inform everyone the garden is located
within.
Attended three Orange County Sanitation (OC San) District meetings; stated the OC San is
utilizing its low yield reserves to pay down higher interest debt in the amount of over 20
million dollars in long term savings; asked Tustin's Finance Department to seek out similar
creative financial opportunities.

Mentioned the Annex at Tustin Legacy was formerly a part of South Orange County
Community College District's (SOCCCD) ATEP facility; stated through time the facility was
land swapped in an agreement with the City and SOCCCD; stated this shows progress.
Mayor Lumbard
Mentioned in 2021 he attended a stakeholder meeting with the partners on the Marine Corps
Air Station (MCAS); is grateful for the partners, including South Orange County Community
College District (SOCCCD) and others; stated the city will continue the outreach and keep
pushing through.
