HomeMy WebLinkAboutCC RES 97-061 RESOLUTION NO. 97-06 2 A R ESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 TUSTIN, CALIFORNIA, APPROVING FINAL TRACT MAP 15316 (TRACT NOS. 15373, 15374, 15375 AND 15316) 4 5 The City Council of the City of Tustin does hereby resolve as follows: 6 I. The City Council finds and determines as follows: 7 A. That Final Tract Map 15316 (Tract Nos. 15373, 8 15374, 15375 and 15316) has been submitted by Kaufman and Broad Coastal, Inc; 9 B. That a public hearing was held by the Planning 10 Commission on October 28, 1996. At this hearing the Planning Commission recommended that the City 11 Council approve Tentative Tract Map 15316. Subsequently, the City Council approved Tentative 12 Tract Map 15055 on November 18, 1996; 13 C. Pursuant to Section 15268 (b) of the California Environmental Quality Act (CEQA), the Final Map is 14 considered statutorily exempt from the requirements of CEQA. 15 D. That the proposed subdivision is in conformance 16 with the Tustin General Plan, the Tustin Zoning Code and Subdivision Map Act; 17 E. The 0.5964 acres of parkland required for this 18 development was previously dedicated with recordation of Tract 15055; 19 F. That the City has reviewed the status of the School 20 Facilities Agreements between the Irvine Company and the Tustin Unified School District for the 21 impact of Tentative Tract 15055 on School District facilities, and changes in state law. Impacts 22 associated with this approval on School District facilities are adequately addressed; 23 G. That the site is physically suitable for the type 24 of development proposed; 25 H. That the site is physically suitable for the proposed density of development; 26 I. That the design of the subdivision or the proposed 27 improvements are not likely to cause substantial environmental damage or substantially and avoidably 28 injure fish or wildlife in their habitat; Resolution No. 97-~., Page 2 1 2 J. That .the design of the subdivision or the type of improvements proposed will not conflict with 3 easements acquired by the public-at-large, for access through or use of the property within the 4 proposed subdivision; 5 K. That the design of the subdivision or the types of improvements proposed are not likely to cause 6 serious public health problems; and, 7 L. That the Final Maps are in substantial conformance with the Vesting Tentative Tract Map. 8 II.
